Tato diplomová práce analyzuje právní základy a užití občanského zákoníku, majetkových zákonů, občanského soudního řádu a exekuční řádu v obchodu s nemovitostmi. Skrze případové studie se snaží poukázat na kritická místa a proveditelnost jednotlivých investic do exekucí zasažených či jinak právně znehodnocených nemovitostí. Závěrečná část hledá standardizované postupy, které nachází optimální mix rizika a profitability.

Court execution of immovable assets in the Czech in the age of 1918 - 1963 Abstract: The work deals mainly with executory proceedings and distrainments in the period of the First Czechoclovakian Republic and after the year 1950. It introduces procedural rules concerning exekutory proceedings in the 1890s which were juridical regulations of a big and detailed extent and which were accepted into the legal code of the First Czechoslovakian Republic and procedural rules issued after 1950 which already didn't know a whole range of exekutory institutes of the previous age. On the other hand, these laws introduced a number of new institutes of enforcement, such as an incidental dispute, debating the debtor's objections directly in the enforcement proceedings. In 1955, a new form of wage enforcement was introduced to enforce maintenance for minor children when the seizure of part of the wage obliged not only the original payer but also all the following to which the debtor eventually went. The work is also patterned on the period legal decisions of individual courts of the First Czechoslovakian Republic, particularly of the Supreme Court. Criminal Law Aspects of Performing a Bailiff's Activities

The aim of the dissertation "Criminal Law Aspects of Performing a Bailiff's Activities" is to assess the legal position of a relatively new legal profession-bailiffs, define the types of legal liability that bailiffs bear, and focus primarily on one such type-criminal liability. At a practical level the aim of this dissertation is to contribute, using case law from Czech criminal courts, to the understanding of the issue of the performance of a bailiff's activities, in particular in terms of the powers entrusted to a bailiff at the statutory level in the field of seizure law, with a focus on the level of work by bodies active in criminal proceedings.
Legislation and implementation of distraint procedures in Czech Republic

The Masters thesis is titled Legislation and implementation of distraint procedures in Czech Republic. The theoretical part explains the concepts that relate to issues including specifics of a bailiffs office and the Czech Republics Chamber of Bailiffs. The process of distraint from the beginning until the seizure and termination is then fully depicted. Description of methods by which such distraints may be carried out, including the costs and fees of the bailiff are also covered. In the practical part are evaluated statistically the number ordered and completed foreclosures in the 2010-2015 period, including influences on her work immediately. The practical part of thesis contains statistically evaluated numbers of ordered and completed constraints during the years from 2010 to 2015, inlcuding influences that they may correlate with. Subsequently, an analysis of two homogeneous regions was carried in the sense that unemployment rate, criminal activity and social benefit payments are often at the beginning of the indebtedness and the consequent execution order. The practical part ends with an evaluated existing legislation, including its amendments and practical examples that are currently becoming a tradition.
Selected aspects of the execution proceedings

The bachelor thesis is dealing with the problems connected with the execution proceedings. The first part is focused on defining the different types of enforcement, with emphasis on execution proceedings. The theoretical part is focused on the general definition of the execution, the analysis of the contemporary legislation and the position of a bailiff in the Czech legal order. The course of execution proceedings and subsequent characterization of its individual parts is described in other sections of the work. The end of the theoretical part includes the selected means of defense against mandatory execution. The practical part is focused on the shortcomings of execution proceedings based on the specific example of practice. The author analyzes the defects that were associated with the execution proceedings and attempts to draft a solution to prevent similar situations.

In the theoretical part are described activities of private executor. The work is described in detail the course of execution from the start after the end of the claim, including ways to recover execution and ordered a defence against enforcement proceedings. In the practical part are explained indebtedness and debt phases before and after pumping foreign sources and consequences that debt entails. An important chapter in the practical part is the analysis of three exemplars of recommendation.
