The Application of Fuzzy Logic for the Choice of Supplier

The diploma thesis employs modern analysing and simulating methods. It enables the application of fuzzy logic in supplier selection and evaluation of its potential risks to construction companies. This work is aimed at defining the problem and determining the overall and particular goals, namely theoretical description of the principle of used artificial intelligence theory, problem description and analysis, current situation as-sessment, proposed solution implementation and evaluation of proposed solution con-tribution.
Selected problems in the process of building operation appraisal for the purposes of expert opinions

The basic requirement for a good quality expert opinion are high quality sources of information, i.e. adequately detailed and valid groundwork. This dissertation analyzes groundwork for expert activities in the area of building operation appraisals, handling of information and its transmission within the life cycle of a construction. For this purpose, it is possible to divide the construction according to its functional parts. The thesis puts emphasis on drawing up a budget according to its functional parts, which is clearer for the investors, contractors and real estate administrators as well as the expert. A significant part of the dissertation is dedicated to recommendations on how to determine the usual price of building operations. In this section I define some options of how to determine the usual price of building operations, including their comparison. Likewise, I investigated and compared real agreed prices of building contracts for public commissions. The basic recommendation resulting from this chapter is the recommendation for the Czech statistics department to automate the data collection based on registers of building operations created with one of the budgeting programs (preferably according to functional parts). For the experts, I prepared a set of recommendations based on the analyzed differences between the budgeted prices and those applied in real contracts. There is no generally accepted method to evaluate the losses created due to delays in construction. For the purposes of this dissertation, I investigated the common prices of rent of the individual equipment and then established two approaches to put value on the cost of equipping the site, percentage rate and individual calculation. I examine in more detail the issues related to quantification of costs for wintertime arrangements. At the end of the chapter I define recommendations for experts. With regard to recommendations for establishing discounts from the construction price due to occurrence of defects and unfinished tasks, I analyzed real examples of distribution of defects and unfinished tasks at the moment of delivering the building operation to the investor and discovered that approximately 50% of defects are part of the surface working. Additionally, I analyzed the Czech technical regulations regarding surface working in order to find basis for assessment of the presence or absence of a defect. While investigating the approach to non-removable defects, I discovered incorrectly considered shelf life of waterproofing within the appraisal. Based on this, I investigated the market and determined the shelf life of common waterproofing systems. At the end of this dissertation I carry out a comparison of selected items of the two pricing systems most commonly used in the Czech Republic, URS and RTS. The differences are a result of contemplating using different technologies, varied mechanisms and diverse approaches to determine the costs of material.
The subcontractor’s role in construction projects

The goal of the Bachelor’s thesis is to create an overview of the methods of planning and management of subcontracts for a construction company and to formulate the organization of a construction project, which is based on a specific project with subcontractors, both in terms of time and money. The introduction describes the subcontracts and how to work with them in the company. In addition, it describes the legalities surrounding the basic contracts. The Diamant project on Wenceslas Square is described in detail in the practical part. The project’s structure, function, approval of component parts, schedule, and financial evaluation are also described. The thesis will emphasize on the organization and management of subcontracts.
The means of custody substitution in criminal proceeding

The aim of this thesis is to outline the general assumptions of custody in criminal proceedings, the historical development of institutes of custody means up to the present legal form, and interpretation of current legislation of means of custody substitution. Among these alternatives belongs association or trustworthy person guaranties, written promise of accused, probation officer supervision and bail. Furthermore, this thesis includes the means of custody substitution for juveniles, comparison with foreign legislation in area of custody substitution with the Federal Republic of Germany and the Slovak Republic and also includes an outline of a new form of treatment of these institutes with a view to preparing the new version of the Criminal Procedure. This work is complemented by specific findings and results concerning the use of funds in the custody of compensation practice. The conclusion includes my own arguments relating to means of custody substitution and form their proposals de lege ferenda, which aim to streamline and modernize the criminal proceedings so that this better fulfill its true social purpose, which is to detect and prosecute the real criminals.
Obligational means of securing claims in the international trade

Obligational means of securing claims in the international trade Abstract The subject of this dissertation is obligational means of securing claims and their functioning in the commercial transactions with international coverage. The thesis is primarily concentrated upon the statutory securing instruments most often encountered in practice i.e. surety, financial (bank) demand guarantees, contractual assignment of receivables causa cavendi, letters of credit and letters of intent. The thesis is divided into four parts. The first part deals with the introduction into the subject of negotiable instruments of securing obligations, provides an overview of the historical development of selected instruments, endeavours to outline the difference between the securing instruments conceived as rights in rem and those seen as obligations and eventually raises the issue of methodology. Afterwards the analysis is carried out on two levels: in the second part the author focuses on the applicable approach in determining the governing law in accordance with international and national regulations and afterwards on the topic of the unified norms developed by the international organisations that may be relevant in the light of the thesis' subject-matter. Liability for defects in a Sold Thing as one of the Protection Instruments of the Weaker Party

The thesis deals with the topic of the liability for defects in a sold thing with an emphasis on the relevant provisions of private law, particularly the Civil Code, and with regard to legislation concerning consumer protection. The thesis does also not forget to highlight the changes that have occurred recently with respect to the accession of the Czech Republic to the European Union, and even the planned impacts on liability for defects in a sold thing in the upcoming re-codification of private law are examined. The thesis is divided into four chapters. Introductory chapters focus on defining of the concept of civil liability and its classification. The key aspect of this thesis becomes the third chapter, which deals with the institute of liability for defects in a sold thing, taking into account current legislation. Part of this thesis is the comparison of current Czech legislation with relevant German provisions. A summary of problematic aspects of the liability for defects and suggestions of their possible solution are presented at the end of the thesis.
