This thesis is focused on the limitation of an ownership right to ground, especially to easements, as a one of the ways of the limitation of ownership rights to plots. The thesis describes the historical evolution of easements in the Czech republic, narrates and assesses the contemporary legal regulation, describes the future legal regulation of easements by The New Civil Codes and compares it with the contemporary legal regulation.

Miroslav Ottomansky Legal regulation of protection against air pollution from mobile sources The goal of this thesis is to map tools used for legal regulations of mobile pollution sources. Thesis focuses on problematic regulation of motor vehicles' pollution in Czech Republic, however it also outlines basic legal adjustements related to other mobile pollution sources. Thesis starts with basic introduction to this problematic followed by overview of international legal regulations and main conceptional tools used for legal regulations in European Union. In the chapter dedicated to the principles of european law in terms of regulation of mobile sources' pollution thesis tries to research how are those regulations already being applied to specific legal norms. One chapter is dedicated to protection of rights for convenient environment and their prosecution. In the next part of the thesis the normative regulations within emission standarts, approval of types, requirements for fuel quality and control of emissions of motor vehicles are examined. In the last chapter the new legal adjustment of mobile sources' pollution named in the law of enviroment protection is briefly explained in context with increasing number of problems with regulation of road traffic in cities. Role of civil associations in environmental protection ABSTARCT (Zusammenfassung) Das Ziel dieser Arbeit ist die Rolle eingetragenen Vereinen im Umweltschutz zu definieren. Eingetragene Vereine sind sog. Non-Profit-Organisationen, die das öffentliche Interesse am Schutz der Umwelt durchsetzen. Um diese Schlüsselfunktion zu erfüllen, müssen die Vereine als gleichberechtigter Partner der Staatsverwaltung betrachten werden. Ihre Hauptaufgaben umfassen vor allem praktische Naturschutz, Bildung und Aufklärung der Öffentlichkeit, Teilnahme an der Gesetzgebung des Umweltrechts als auch die Beteiligung an Entscheidungsverfahren in Umweltangelegenheiten. Alle oben genannten Aufgaben eingetragenen Vereinen im Umweltschutz gehören zum wichtigen Teil der Entwicklung offenen, und demokratischen Gesellschaft. Diese Arbeit besteht aus vier Hauptteilen, die weiter in Kapitel und Unterabschnitte unterteilt sind. This thesis describes the environmental damages legislation. Relevant parts of the work focus on the international legislation including special liability regimes, then it focuses on the European Union legislation, especially on the Directive 2004/35/EC, also it describes British legislation in this area and the legislation in the Czech Republic, namely the differences between environmental damages and environmental loss, it mentions also the old contaminations. Lastly the text tries to compare the British and Czech legislation in liability for environmental damage.

Implementation of the Third energy package into the legal order of the Czech Republic Summary This thesis discusses the implementation issue of the Third energy package, also known as the Third liberalization package, into the Czech national law. It consists of three regulations and two directives of the European Union, which determines the energy politics both on the European level and on the level of the member states. The first part of this thesis describes the ancestors of the Third energy package and their accomplishments or failures together with reasons for creating the next generations of liberalizing legislation. The author describes the liberalization in the form of the legal, functional and accounting unbundling separately for electricity and gas industry at the European level, and then the implementation at the level of the Czech legislation. In the next chapter it is further explained, what were the European legislator's incentives for creating the Third energy package, and what new institutes it stipulates. It is herein described that the European Union came with three different unbundling versions of the transmission system operators (TSO) - Ownership unbundling (OU), Independent system operator (ISO) and the Independent transmission operator (ITO). Regions and environmental protection

Thesis titled `Regions and environmental protection` is divided into three parts. The first part is devoted to planting regions in the necessary historical context. The second part describes the constitutional anchoring region, and their constitutive elements defining the concept of independent and delegated powers. In the last section, I focus on linking the county institute, and environmental protection. The conclusion is devoted to the role of the county in a separate and delegated powers in selected components of the environment. Counties in the environmental protection acts as a necessary link between the state and municipalities, since they deal with things that goes beyond the possibilities of their own communities, but also below the national importance.

116 9. Summary This work deals with the public participation in environmental decision-making. The institute of public participation is certainly a legitimate and useful tool of a democratic society. Properly used, it leads to streamlining of government activities and to the better environmental protection. It has its place anywhere where the natural and legal persons are wishing to defend their public interest and not solely rely on the state. In addition, the right to participate is the necessary secondary right to the right to favourable environment. The regulation of public participation do exists in all three levels - international law, ius communitaire and Czech national law. For international law, the main document is Aarhus Convention. It is not yet clear whether it is self-executing treaty in Czech law. Its main advantages are: mutual cohesion of right to information, right to participate and access to justice; the relative simplicity, brevity, and the high standard of obligations of the Parties. The most important requirement is to enable the effective public participation in principle to any decision-making whose subject could have an impact on the environment. Legal regulation of the protection of plants and animals

Legal regulation of the protection of plants and animals The subject of this thesis by the title " Legal regulation of the protection of plants and animals" are selected, the most significant legal standards, laying out the problematic of fauna and flora protection and their analysis in order to create a comprehensive scope of fauna and flora legal regulation in situ both on international, European and domestic level of law. The thesis is divided into four parts. The first chapter introduces the structure and extensity of the fauna and flora protection problematic, whereas it contemplates over the term biological diversity. The next chapters successively describe the legal regulations of fauna and flora on the international, European and domestic level of law. The introduction is always there to mention historical development and related standards that have given the present legal regulation its form. It is followed by summary of the most significant standards of the legal regulation in effect. To conclude my thesis, I am summarizing and determining whether the system of legal standards in effect truly results in the objective of legal regulations of fauna and flora protection, primarily in stopping the decrease of biological diversity and its restoration in the future.
Selected issues of nature and landscape protection in Czech law (The mining towers in Microregion Frenstatsko's case)

This diploma thesis deals with a historical development of the nature preservation. Then it shifts its focus to various commitments emerging from the international as well as EU laws. At the international level, the work individually describes several international contracts related to the preservation of natural ecosystems. Within the scope of the European law, the thesis focuses on the realization of the nature preservation, using the system called Natura 2000 and its factual implementation into the Czech law. The text also examines the nature preservation and its impacts in the constitution of the Czech Republic. After a brief introduction to the law no. 114/1992 Coll., on the preservation of nature and landscape, the work in detail analyzes individual categories of general and specific territorial preservation. Finally, the thesis examines the case study on the mining towers in the micro-region Frenštátsko in the context of several questions related to the preservation of nature and landscape.
