Legal regulation of animal welfare

The aim of this thesis is to summarize legal regulation of animal welfare in relation to the Czech Republic and to highlight its potential shortcomings and possible amendments de lege ferenda. Today, humans wield almost unlimited power over living conditions in which animals around the world live in, and so more and more attention is paid to the legal regulation of this area of law. This thesis, which is divided into three main parts, also pays attention to it. The first part contains the analysis of the concept of "animal welfare" and compares it to the concept of "animal protection". It also deals with a brief history of animal welfare and various ways of determination of its level. The second part describes and summarizes legal regulation of welfare, whereas the author proceeds from the international law through European law to national law. With the international law, the biggest emphasis is on the conventions signed under the Council of Europe, while with the European law, the thesis deals first with the primary law and then with the specific acts of secondary law. Pandemie Covid - 19 a ochrana životního prostředí z právního pohledu Abstrakt Pandemie Covid - 19 zásadním způsobem ovlivnila téměř všechny aspekty života na Zemi, životní prostředí a jeho ochranu nevyjímaje. Cílem této práce je zjistit, jaký vliv měla, má a případně bude mít koronavirová pandemie na jednotlivé složky životní prostředí a jejich ochranu z právního pohledu. Vliv pandemie v oblasti práva životního prostředí můžeme pozorovat ve dvou rovinách. Tou první je její přímý, respektive materiální vliv na jednotlivé složky životního prostředí. Práce se zaměřila na vzduch, vodu a odpady, jakožto složky, jež byly pandemií ovlivněny nejvíce. Materiální vliv pandemie na životní prostředí a jeho složky znamená, že se v přímém důsledku pandemie zlepšila, či zhoršila jejich kvalita, případně kvantita. Druhá rovina vlivu pandemie na jednotlivé složky životního prostředí se projevila nepřímo, a to reakcí práva na změny ve složkách životního prostředí způsobené pandemií Covid-19. V této rovině bylo možné pozorovat, jak pružně, rychle a efektivně zvládlo, nebo nezvládlo právo reagovat na aktuální události. Water conflict resolution in international law Abstract Riparian states across the world share common water resource in more than 200 international river basins. International law regulations of riparian states' rights and duties in the field of shared water resource utilization at the regional level is not sufficient. Conflicts between states arising from it constitute a threat to international peace and security. Given effects of climate change on freshwater resources, it is presumed that these conflicts would become more frequent in the future. This thesis deals with the topic of the water conflict prevention and resolution in the international water law. The aim of this thesis is to evaluate which conflict resolution mechanism is suitable for water conflicts. At the same time, the author asks the following research questions: What are the factors that determine the efficiency of conflict resolution mechanisms in maintaining international peace and security? How are the international legal principles of shared water resource utilization reflected in the water conflict resolution mechanisms? Legal regulation of the agricultural land fund

This diploma thesis deals with the issue of protection of agricultural land fund in order to define the various legal instruments and try to evaluate the current legislation in relation to the protection of quality and especially the quantity of agricultural land. The agricultural land is one of the most valuable types of land, representing about 54 percent of the total area of the Czech Republic which, however, has been quite negatively affected by interventions causing its loss and deterioration of its quality for decades. Legal instruments should thus be an effective means of averting and preventing growing interference with agricultural land as one of the components of the environment. The aim of this work is to evaluate the legal instruments by which agricultural land can by most affected and thus protected. The whole work is divided into four chapters, the key ones being the last three dealing with the subject of the work itself, ie the protection of the agricultural land, which has been increasingly affected by increasing and accelerating degradation processes in recent years. Legal aspects of the circular economy Abstract The diploma thesis deals with the issue of legal aspects of the circular economy. This concept is based on resource efficiency with the intention to minimize waste generation. This approach is considered to be the future of economies not only in the European Union, but also in the rest of the world. The thesis aims to provide a comprehensive overview of the circular economy and the legal background of this concept in the EU and the Czech Republic. Given that the legislation of the circular economy has so far been reflected at the EU and national level predominantly in the field of waste management, it forms a significant part of this thesis. The projection of the principles of the circular economy into the legal order as well as the future development of this concept is evaluated. Recognized advantages and disadvantages in the current circular economy legislation are formulated at the end of the thesis. Subsequently, the thesis sets recommendations for the future direction of the circular economy and for its efficiency enhancement.
The prohibition of discrimination on grounds of race in the case law of the European Court of Human Rights

The Prohibition of Racial Discrimination in the Case Law of the European Court of Human Rights The subject of this thesis is the prohibition of racial discrimination on a regional scale, which is discussed in relation to the European Court of Human Rights and its case law. The aim of this work is to present the prohibition of racial discrimination, as embodied in the most important international legal documents from the beginning of the twentieth century with a special focus on the rules contained in the legal documents of the Council of Europe, and the protection granted by the European Court of Human Rights. Race and ethnicity is seen mainly in terms of the Roma ethnicity, which is obviously not the only one who is in Europe facing the racial discrimination. Given the scope of the thesis it is not possible to address more groups belonging to the above mentioned category. The subject matter is elaborated by methods such as compilation, comparison and partially also analysis. The introductory chapter of the thesis contains general interpretation of equality and non-discrimination with explanations of important terms and concepts. Freedom of Movement in the Environmental Law

Freedom of Movement in the Environmental Law Abstract This thesis is concerning freedom of movement in the environmental law, i.e. the limitation of movement stemming from environmental legislation. Firstly, it is a current issue due to the COVID-19 pandemic - as the countryside has become a popular destination for many visitors. Secondly, it is a general issue - as the human population expands or as there are new possible ways of spending free time due to technological progress. The aim of this thesis is to analyse the current state of legislation in this area and to assess it in regard to satisfying its purpose, i.e. environmental protection. It was ascertained that the environmental legislation rather reached its goals, as it offered flexible protection to the specific needs of individual areas. The legislations drawbacks comprised of legal vacuums - it seldom contained provisions for movement in winter countryside or it did not include sufficiently general rules to apply on every manner of movement of people in nature. Another issue of the legislation is the lack of public awareness, its considerable fragmentation and limited chance of it being enforced due to understaffed public guards. Legal regulation of beekeeping

1 Abstract This diploma thesis deals with legal issues related to beekeeping and bee protection. The beekeeping legislation in Czech Republic is not regulated in just one comprehensive legal act but consists of many partial provisions that can be found in a large number of various acts and decrees. The fragmentation of the beekeeping legislation is its biggest shortcoming and causes, that beekeepers are unable to get proper knowledge of the issue. It is necessary to ensure that all beekeepers are informed as best as possible of their rights and obligations, so that the legislation is followed in practice. Reader of this thesis is being presented with a detailed legal analysis of the most important provisions concerning beekeeping which is also here and there accompanied with ideas de lege ferenda. This diploma thesis is divided into five parts, which are further subdivided into chapters and also into subchapters and lower levels if needed.
