Analysis of strengthening intellectual property rights on selected economic indicators in selected world countries in years 2013 to 2015

This paper analyzes the relationship between the protection of intellectual property rights, and selected economic indicators between 2013 and 2015. The topic is the impact of intellectual property protection to economic growth and development. The theoretical part analyzes the different views on the issue of intellectual property, its forms of protection and analysis of international protection. It also defines GDP, GDP per capita, foreign direct investment and research and development expenditure. The practical part analyzes the correlation between these economic indicators and index of intellectual property rights, as an indicator of the strength of protection of intellectual property rights in selected countries. The work focuses on industrial property.

Pre-Marital Agreement as a means of protection of marital property and business

This thesis deals with the possibilities of adjustment of marital property in the form of concluding marriage contract as a way to protect assets in case of divorce or business of one of the spouse. The aim of the work is to identify shortcomings in the current leg-islation. Based on these shortcomings suggest solution to improve the current state. According to this suggestion compile a model of marriage contract. The draft of rec-ommendation is compiled with the help of comparison with the Austrian statutory of matrimonial property relations and through questionnaire survey among students of University of Economics who have experiences with the adjustment of community property.

Participative management – key to minimaze conflicts between protection of biodiversity and socio-economic development of local communities

The project was aimed to propose a model of optimal coexistence of biodiversity protection and socio-economic development in large-scale protected areas. Its main output was identification of principles of participative management of protected areas and estimation of circumstances necessary for its practical implementation. The project focused on description of biodiversity in particular model areas, on eventuality of changes in biodiversity due to human activities and thus on identification of actual and potential conflicts. In parallel, selected parameters of quality of life of local population, behaviour the population and its relation to the Administration of protected area and to nature protection in general were studied. Analysis of behaviour of the administration of protected areas as social institution became also part of the project. The project was designed as empirical comparative study of three biosphere reserves (BR) - BR Šumava, BR Třeboňsko a BR Křivoklátsko.

Copyright protection of computer's programs Summary The mainly points of my thesis are to show and provide with the basic information about the legal protection of computer's programs. This is in my opinion the mainly topic. In my diploma paper I've focused on valid computer's programs legal protection based on the Czech Author Act No. 121/2000 Sb., right of authorship, related rights of authorship and the variation others rights (the right of authorship) and also supportive by criminal rights. This valid legal protection corresponds to Europe's and international law systems. The computer's programs are protected by the rights of authorship like literary work (if they fulfill the conditions mentioned in § 2 art. 1 or § 2 art. 2 rights of authorship). With respect to computer's programs the rights of authorship contain this law special § 65 and § 66 which explain the limitation of the rights. The other points of the thesis are about licence's agreements and about how to get legal computer's program. I also mentioned author's pretension following from the rights of authorship. Regarding to the discussion about protection the programs I mentioned often arguments pro and con rights of patents. Recently European Parliament closed the discussion about draft of the patent's bylaw, but I would say that this case...

Registered (prescribed) capital of capital companies, its creation and protection

Résumé Authorized Capital of Stock Companies, its Formation and Protection Czech legal regulations related to authorized capital stem from the European concept of the real formation and preservation of the authorized capital that leads particularly to providing minimum guarantee rate of the stock company to its creditors. Authorized capital is an abstract number and it expresses the financial value of assets invested in the stock capital by its partners. The Commercial Code shall expressly stipulate the duty of authorized capital formation for the limited liability company as well as joint-stock company. The duty to form authorized capital at their formation may be indirectly permitted also for limited partnerships. In professional literature, the three basic functions of authorized capital are traditionally listed. Guarantee function, authorized capital as profit and loss measure and authorized capital as a mean to specify partner's share in the company. The concept of real authorized capital formation adopted by most European legal systems is based on achieving correspondence between the authorized capital and real capital and capital preservation through protective rules. Legislator's protective tools include the ban on return of deposits, ban on acquiring own company shares, compulsory reserve fund...

Possible ways to breach the water supply system a draft of the measures to prevent its abuse in South Bohemia.

The theoretical part of the thesis focuses on the characteristics of water as the basic structural element of the life on the Earth. It also mentions regulations related to critical infrastructure, water protection and water management. It describes water management system of the Czech Republic and the South Bohemian Region. It similarly characterizes the most probable chemical, biological or radiological water contaminants that might be abused by a man in the case of trespassing into waterworks system objects. The aim of the thesis was to map possible threats to the waterworks system and to propose follow-up measures preventing the South Bohemian Waterworks System from abuse. Upon identification of possible threats in the territory of South Bohemia and from the point of view of the extent of the thesis the text then focuses on intentional threat of waterworks object by a man. The research part first deals with more detailed description of the South Bohemia Waterworks System, from drinking water via its pumping, treatment, storage to its supply to final consumers. The system of drinking water supply to inhabitants of South Bohemia is divided into sectors by means of AKIS method here. A questionnaire to employees working in the water management sphere was based on this division and particularly vulnerability and the level of security measures in the individual South Bohemian Waterworks System sectors was evaluated from the information based on their answers. In the second plan the research part of the thesis focuses on description of security elements used in South Bohemian Waterworks System objects accompanied by my own photo documentation of objects and areas administered by the South Bohemian Waterworks Union. The elements of passive and active protection used by the South Bohemian Waterworks Union are documented and described here. Application of two operation analysis methods relates to this part. Quantitative research of security of waterworks objects based on evaluation of the best secured object of the South Bohemian Waterworks System was first performed. The obtained results enable us to determine which of the South Bohemian Waterworks System premises has the best active and passive security against trespass of unauthorized persons. To assess relevancy of the quantitative security research the method of relative comparison of waterworks objects security and its consequent interpretation by the security index is also used. The security index describes object protection against possible trespass within the whole area of the object. Application of this method brings numeric interpretation and identification of the overall security of the South Bohemian Waterworks System with regard to preference of the monitored parameters. The same result is achieved by both the methods. The applied operation analysis methods have revealed that the heart of the South Bohemian Waterworks System, the Plav drinking water treatment plant, the only drinking water treatment plant of South Bohemia supplying majority of South Bohemia inhabitants with drinking water, is the best protected object. Pumping stations and water towers are further well secured objects. There are also completely unsecured object in the South Bohemian Waterworks System. The conclusion contains some measures that should prevent unauthorized persons from trespassing into all waterworks objects and thus protect drinking water against contamination. As the observation has revealed the protection of waterworks objects should be improved with regard to the worsening safety situation in the world. This also involves the costs the South Bohemian Waterworks Union should invest in security to introduce the most up-to-date security elements into practice. We may conclude that the major part of waterworks objects are secured against abuse both passively and actively.

Current status of nature protection and management in Lužnice floodplain

Lužnice floodplain has been preserved in a semi-natural state in a cca 25 km long section located between the state border and the town of Suchdol n L. Meandering river is surrounded by pools and oxbows, which are flooded several timeas a year. Most of the area is now the subject of nature protection. Microorganisms (Algae), water plants, birds and other wetland biota found a refungium here. Biodiversivity is maintained by river activity and mosaic structure of the landscape, formed by e pastures and wet forests. This character of landscape is now endangered by ceasing of meadow management, hence, the large parts of floodplain are now under the succesional stages leading to the wet forest in the decrease of overall biodiversity.

Changes to rights to claim foster care benefits since year 2013

Foster care is a form of social care in the Czech Republic. A fostered children and foster parents receive from state a foster care benefits. Up until 2012 these benefits were set by Act No. 117/1995 Coll., on State Social Support. In 2012, Amendment No. 401/2012 Coll., transferred foster care benefits to Act No. 359/1999 Coll., for Social-Legal Protection of Children. With this change in law, there was also a change in the conditions of entitlement to claim foster care benefits and the establishment of efforts to professionalize foster care. The aim of my work is to analyse and compare the legislation of changes to foster care benefits from the perspective of the State Social Support Law and the Law of Social-Legal Protection of Children. I have tried to confirm or invalidate the hypotheses using quantitative research, this forms the empirical part of my work. Hypotheses were focusing on comparing the situation before and after the changes of Law for Social-Legal Protection of Children. As a technique I chose to study documents and using these documents I have provided secondary analysis. I have worked with the statistics of the Ministry for Labour and Social Affairs of the Czech Republic, the Labor Offices and the Regional Offices. The results of my findings have shown that more foster parents should be able to claim foster care benefits. Passing the bill on professional foster care has increased the interest in providing foster care, this must be seen as positive outcome. My research could be used as study material for other students of social science or for people who work in the area of social-legal protection of children. It could also be used as feedback for ministerial officials to sea the real situation since the changes in foster care law.
