The Civil Service Act: Monitoring the Process of Making of the Act No. 234/2014 Coll., of the Civil Service

I devote major attention to the Act no. 234/2014 Coll., of the Civil Service, which was accepted despite the veto of the President on 1st October 2014. I briefly characterize the law and in the practical part I analyze and interpret the process of making of this law through a theoretical concept "Multiple Streams Approach". Within the theory I focus on the context of agenda setting to the issue and simultaneously I take into account the role of Policy Entrepreneurs in the legislative process of the Civil Service Act. After reading the reader will have an overview of the process of making the Civil Service Act. The reader will be also familiar with the shortcomings of this Act, for which it was criticized. The theoretical part is used for introducing to the issue. In the theoretical part I outline the historical development of the civil service in Czech Republic and I also briefly characterize the Civil Service Act. Subsequently the reader gets the knowledge about the content of "Multiple Streams Approach" in this part. The practical part of diploma work is enriched by attitudes and opinions of two political actors, who directly attended of discussing the law in Chamber of Deputies. It will be possible to compare the data received from expert survey with the results of the analysis process of making law.
The Act on Civil Service (Act No. 234/2014 Coll.) - its preparation and entering into force

The thesis focuses in its first part on a brief description of the history of civil servants and the fundamental civil service legislation concerning the civil servants in the Czech lands. The survey starts by the first legislation regulating status of the administrative apparatus, to be exact by the Joseph II's Pastoral Letter of 13 December 1783, and continues up to the present. The second part analyses the circumstances of creation of the Act No. 234/2014 Coll., on Civil Service, and first months after its coming into force. This law is a novelty in the legal order of the Czech Republic and it plays crucial role in the proper functioning of the state administration in compliance with the Constitution of the Czech Republic with the aim of professionalization and depoliticization of civil service. The theme of the thesis is linked to several important concepts from the field of public law, such as public administration, public service, state administration, civil service, good administration, relation governed by public law, administrative authority, service authority, service body. Depoliticization of the state administration in the Czech republic

The Master´s thesis describes the development of public administration-civil service and depoliticization. It is focused on the period after revolutionary year 1848 until now. During this time the state system changed. Based on that and different regulations, the thesis shows differences and same things between each other. It compares with each individual period. The thesis deals in detail with the current legislation. There are highlighted parts related to depoliticization. In the end of this thesis is the sociological survey, which shows, how feel staff of civil service about new legislation. The result is that the current legislation is important for our modern civil service, but does not make any deeper changes meantime.
The Act Of Civil Service from the aspect of related legislation

The master thesis analyzes the Act No. 234/2014 Coll., On Civil Service, from the aspect of related legislation, Act No. 312/2002 Coll., On Public Officials of the Local Self-Government Units. When the Law On the Civil Service came into force, at the beginning of last year, two categories of officials were created. On the one side there are civil servants who are in service of the Czech Republic, on the other side there are officials who are employed by local self-government units. The analysis is focused on five areas, where it is possible to compare the method of legislation under both laws. After review of these selected areas, the application problems of the civil service are identified. At the end of the thesis, there are legislative proposals for changes that are inspired by relevant legislation.
Implementation of Service Act in practice

The master thesis focuses on the new Act no. 234/2014 Coll., of State Service, which introduces a new law regulation of labour relations of employees in the state administration. Service Act has been frequently a discussing theme in recent years, especially in connection with a threat from the European Commission which by accepting this law conditioned a drawing of European grants from structural funds for the period 2014 - 2020. This dissertation analyses the issue of the state service, here are an outlined principles of the state service in selected European countries and the historical development of the state service in the Czech Republic. The goal was to highlight the possible problematic provisions which appear in the law, and the problems that have shown up during the implementation of this law, even the example of the Labour Office of the Czech Republic.
Reform of the State Administration in the Czech Republic: Case of the Civil Service Act

The master´s thesis focuses on the reforming of the Czech civil service. The quality of the state administration is one of the most important political and economic topics. By passing the Civil Service Act the representatives aimed at depoliticization, stabilization and professionalization of the situation of civil servants. The main goal is to evaluate the law-making process of the Act and find out if the amendatory proposals and obstructions had the professional and apolitical state administration in view or aimed at lowering of the quality of this Act. Also, the objective is to assess, if the Act meets the requirements stated in the documents regarding the reforming of the Czech civil service. The master´s thesis is divided into four chapters. The first part of the thesis covers the state administration in theory. The second chapter contains a historical overview of the state administration in the territory of the Czech Republic from 1848 up to the present day. The third chapter presents the main documents regarding the reform and their key requirements. Furthermore, the law-making process is analysed and his crucial problems are identified. The final part concentrates on the Civil Service Act and evaluates it with reference to the main requirements stated within the reform.
