Material aspect of Administrative Offences

The thesis is devoted to the examination of the material aspect of administrative offences. It opens with the basic theoretical background, summary of the literature and historical excursion. Main part of the thesis is focused on a detailed analysis of the material aspect of the administrative offences from the perspective of legislation, case law and administrative practice. The author approaches the topic in an analytical manner, identifies possible ambiguities and offers suggestions for their elimination.
Crimes against humanity in the practice of the International Criminal Court.

1 Summary Crimes against humanity, together with war crimes, crime of agression and Genocide, create a group of so called crimes under the international law. For these crimes it is characteristical that they are so grave and so dangerous that their punishment is a matter of the whole international community. Such punishment for these crimes has already been carried out several times on international level. As an example we can use the tribunals for former Yugoslavia and Rwanda, which are still operating. This thesis deals with crimes against humanity in practice of International Criminal Court. This court, unlike the previous international criminal tribunals, is a permanent judicial institution. The main focus of the research is a substantive law characteristic of crimes against humanity i.e., physical and mental elements of these crimes. The aim of the thesis is to find out whether the International Criminal Court brought some progress to substantive law definition of aforementioned crimes. The thesis is divided into four chapters. Selected facts of cases of traffic violation in the exercise of public administration

Rigorous thesis brings the focus on selected facts of cases of traffic violation by author, who deals with this agenda for 6 year term. Rigorous thesis deals with the problems connected with aplication and interpretation of laws. Text is devided into four basic parts: historical context of laws regulates traffic violation, the term of "offence" and it's relationship between other violation of law such as criminal act and administrative offence, selected facto of cases of traffic violation, conclusion. Text is completed by model cases and references to actual decision of Supreme administrative court, criminal senat of Supreme court and Constitutional court of the Czech republic. In the case of application problem, author brings the comparation of legal acts of Czech republic with Slovak republic and Poland, which are the states with high number of traffic violation as well and also brings the proposals for "de lege ferenda" solution.

Tato práce se zabývá komparací zákonných úprav některých evropských států pokud se týká určitých forem aktivní součinnosti pachatelů podplácení (včetně oznámení činu) s orgány činnými v trestním řízení. Zabývá se zvláštní formou účinné lítosti u uvedeného trestného činu. Pokud pachatel podplácení dobrovolně a sám oznámí svůj čin, za splnění určitých dalších podmínek je jeho čin podplácení beztrestný. Tato práce reaguje na změnu zákonné úpravy resp. na vypuštění účinné lítosti u podplácení, které přinesl nový trestní zákoník.

Characteristics of the facts of the criminal offence

This bachelor thesis deals with the characteristic of the facts of the criminal offence according to the Criminal Code. The introduction deals with the concept of criminal law and it's main principles (legality and subsidiarity). It also covers the aspect of "social harmfulness". The main part of the thesis deals with the facts of the criminal offence and its classification. In the very end is the analysis of few criminal offences.

Criminal Analysis of Czech Republic

Společnost rozlišuje několik protiprávních činů, nejzávažnější z nich je trestný čin. Vlastnosti, které musí každý trestný čin splňovat, se nazývají znaky skutkové podstaty. Aby byl pachatel trestně postihnutelný za spáchání trestného činu, musí být zletilý a v době spáchání trestného činu příčetný. Za spáchaný trestný čin, který byl pachateli řádným soudem dokázán, je možno udělit jen přesně zákonem stanovený trest. Práce výstižně analyzuje časové řady osob stíhaných za určitou skupinu trestných činů. Zaměřuje se především na odhad trendu v těchto skupinách a následně na prognózu budoucnosti. Zpracovávány a analyzovány jsou i časové řady počtu objasněných trestných činů. Práce též mapuje kriminalitu, resp. stíhané osoby, v krajích ČR.
