CONSUMER PROTECTION IN CZECH REPUBLIC AND EUROPEAN UNION

A consumer ´s protection is relatively young and dynamically developing discipline which blends with other branches for example the economy, the law, the business, the marketing etc. This graduation theses describes the consumer ´s protection in the Czech Republic in comparison with the European Union. The Czech Republic made a tremendous progress in adopting Union ´s norms in recent years, but still is behind stricter norms of the western countries. In the Czech Republic still dominates inexperienced and ignorance of the Czech consumers in relation to their rights. Accordingly to this, it is necessary to make other steps, which will inform much more the consumer about his or her rights. Higher informedness, stricter application of norms and the laws, and their verification in business use will lead to the existence of more perfect internal market of free trade.

The Diploma thesis deals with consumer protection in the field of rights from defective performance. The literature review contains the rights and obligations of entrepreneurs and consumers in the field of rights from defective performance in the sale of goods in the shop, definition of defective performance and types of defects. The terms that are related to the topic are also listed and explained. The practical part of the Diploma thesis is consisted of survey among the inhabitants of the Czech Republic and in-depth interviews aimed at identifying consumer behaviour and expectations in this field. For business companies there are recommendations that result from the survey and in-depth interviews.
Problematika reklamací v oblasti cestovního ruchu

The bachelor thesis deals with the issue of complaint resolution, specifically the non-uniform form of quantification of compensation in case of trip failures. In the literature search there is an overview of legal regulations concerning defects of tours, complaints and customer damages with the use of complaint tables, among others by examples from Czech and foreign judicial practice. In the practical part, using the questionnaire survey, the attitudes of domestic travel agencies to the question of introducing a single compensation form were investigated. This could ultimately significantly reduce the number of litigation between clients and travel agencies. The conclusion of the thesis evaluates the opinions of the travel agency on the unified form, evaluates the possible impact on the travel agency when in-troducing such a form and makes recommendations to reduce the number of un-justified claims.

Draft measures to reduce customer complaints

This diploma thesis deals with customer complaints of headlamps in Automotive Lighting s.r.o. The goal is to analyze the state of customer complaints for 2018 and to evaluate the biggest source of nonconformities in terms of the type of complaint based on Pareto analysis. The thesis focuses on solution of one particular type of complaint. The key part of the thesis is also the processing of the process analysis, the evaluation of the causes of the complaint and the draft of corrective measures that would eliminate the problem. The conclusion of the thesis contains evaluation of the proposed corrective measures, including from the economic point of view.

Liability of the seller for defects in international commercial transactions under the United Nations Convention on Contracts for the International Sale of Goods Abstract This thesis deals with the liability of the seller for defects in international commercial transactions, contained in the UN Convention on Contracts for International Sale of Goods. The document, which is binding for 89 states from different parts of the world, is the most important document in international trade law that contains unified regulation. The Convention determines substantive rules for contracts on international sale of goods defined as a contract on sale concluded between two parties, each of them having its place of business in a different state. If both of these states are parties to the Convention, it is directly applicable, i.e. it is used without reference of conflict of laws rules. Unification of regulation is important in the field of international trade, especially in the area of contracts on sale of goods, which is the most often used type of contract. The most problematic situation in business relationships is when a party fails to meet its contractual obligations.
