Application of municipal and regional legislation in ligt of their right to self-government

57 Aplikace právních předpisů obcí a krajů ve světle práva na jejich samosprávu Abstrakt: Tématem práce jsou podzákonné právní předpisy vydávané územními samosprávnými celky a především otázka jejich aplikace. Obecné soudy jsou dle článku 95 Ústavy oprávněny samy posoudit soulad podzákonného předpisu se zákonem. Autor se v práci zabývá otázkou, jak mají postupovat správní orgány, pokud se dostanou do obdobné situace. Autor v práci shrnuje dosavadní diskusi k vázanosti správního orgánu podzákonnými právními předpisy a rozšiřuje ji o úvahy ve vztahu k podzákonným právním předpisům, které vydávají územní samosprávy. Dochází k závěru, že Čl. 95 odst. 1 Ústavy je třeba vykládat tak, že shledá-li správní orgán, že je k tomu oprávněn, smí při vydání rozhodnutí neaplikovat podzákonný právní předpis územně samosprávného celku. Je zohledněn mezinárodněprávní dopad, především dopad do práva Evropské unie. Autor položenou otázku poměřuje s judikaturou Nejvyššího správního soudu, dle které je správní orgán povinen při své činnosti posuzovat soulad vnitrostátního práva, které aplikuje, s právem Evropské unie. A dále rozvádí úvahy, jaké má tato judikatura dopady na řešené téma. Constitutional definition of the mechanisms of control of territorial self-governing units

The aim is to answer the question of whether effective control mechanisms exist in the Czech Republic which would guarantee the fulfilment of legal regulations by municipalities and regional authorities dealing with public property. It is also my aim to explore whether such control mechanisms result from the constitutionally guaranteed rights to local government and, if they do, to what extent they may be incorporated in the Czech legislation. My diploma thesis is based on specific case studies, the case law of general courts and the current jurisprudence of the Czech Constitutional Court. After the description of the current state of affairs in the Czech Republic, I further focus on the definition of the control mechanisms of local governments in Czechoslovakia between the two world wars (1918 - 1938) and partly also during the Austro-Hungarian Empire. This diversion leading to this era has been selected to reflect the efforts to resume the local government traditions in the context of the renewal of the local government scheme in the Czech Republic after 1989. It is proven towards the end of the historical survey that unlike today, there were effective control mechanisms available before World War II, with several alternatives. The Harper Government, the Aboriginal Right to Self-Determination, and the Indian Act of 1876

In its relatively unchanged form and effective for nearly 140 years the Indian Act of 1876 is the basic law governing the rights and responsibilities of First Nations and their status within Canada. The law protects the special status of Indigenous groups in Canadian society albeit it has been criticized as discriminatory. Voices calling for change of the legislation are growing stronger with the deepening socio-economic problems of Aboriginal peoples. First Nations primarily require the assertion of their constitutional right to self-determination in any future reform. In contrast, the current Conservative government of Stephen Harper emphasizes self- sufficiency and financial responsibility of Native peoples. Legislative actions that Conservatives rarely consult with representatives of the Indigenous peoples themselves correspond to the general priorities of the Harper Government based on the principles of market economy and do not reflect the demands for self-determination and self-government of Indigenous communities. The Idle No More protest movement founded in 2012 in reaction to some of Harper's laws pertaining to Aboriginal peoples fights for their rights and environmental protection inextricably linked with their identity. Right to Local Self-Government - Summary The diploma thesis deals with topic of Right to Local Self-Government in the Czech Republic. Chapter one is introductory and summarizes contemporary theoretical approaches to the concept of territorial Self-Government and the nature of the right on it. Furthermore this chapter explains the importance of territorial Self-Government and describes its evolution in the bohemian lands, while it puts closer look to the restoration of territorial Self-Government and its design after 1989. Finally, this chapter looks at position of the Czech Republic in the typology of local government systems. Second Chapter examines all Constitutional complaints on the infringement of the rights of Self-Governments (municipalities), while it describes the circumstances under which the lawsuit emerged, and discusses the argumentation of the Czech Constitutional Court. The thesis summarizes data on author of the complaint, authority accused of the infringement, and result of the case. The Harper Government, the Aboriginal Right to Self-Determination, and the Indian Act of 1876

A debate on the reform of the frequently criticized Indian Act of 1876 - the basic law governing the rights and responsibilities of First Nations and their special status within Canada - has been getting more intense with the ongoing socio-economic problems of Aboriginal peoples. Whereas the previous Canadian government of Stephen Harper emphasized self-sufficiency and financial responsibility, First Nations have required the assertion of their constitutional rights to self-determination and self-government in any reform. This piece of work examines various proposals to reform the Indian Act and their potential effect on the status of First Nations. It focuses on Aboriginal policy stances of the Harper Government and the First Nations' reaction to the federal government's approach. In particular, it analyzes the ideas and demands of the Idle No More protest movement that emerged in response to some of the legislative proposals of the Harper Government. The author concludes by arguing that any effort to change the unfavorable situation of Aboriginal peoples in Canada would run into problems because of the discrepancy of ideas of the Conservative Government and First Nations on how to implement the reform of the Indian Act and how to enforce the right to self- determination.
