Incorrect application of the EU law by authorities of Czech Republic

The goal of this dissertation is to evaluate Alternative Dispute Resolution (ADR) methods and eventually the possibility of success when seeking redress for damage resulting from incorrect application of the EU law by the authorities of the Czech Republic. This goal will be achieved primarily by using analysis and comparison. With help of these two methods it is possible to find out how individual institutions of ADR (SOLVIT network and Czech Ombudsman) proceed in resolving specific cases where, due to the incorrect application of european law, there has been some damage.
The legal status of the Ombudsman in the Czech Republic and abroad

The thesis deals with the legal status of Ombudsman in the Czech Republic and abroad. It focuses primarily on comparison with ombudsman institutions in selected countries (France, UK, Italy, Germany, Poland, Slovakia and the European Union).The first chapter describes the basic characteristics of ombudsman institutions, their development and significance for today's society. The second chapter is analyzed in detail the legislation of the Ombudsman in the Czech Republic. The third and fourth chapter is devoted to ombudsmen abroad. The last chapter provides a comparison of individual laws in mentioned countries.
The Ombudsman and his relation to the principles of good governance

This diploma thesis discusses the relationship of the Ombudsman to the principles of good governance. The rise in popularity of ombudsman institution in the 20th century caused his growing typological diversification. The concept of good governance in different countries takes different content. The goal is to capture the same characteristics and identify the differences between the selected models. The core of the work consists of analyzing Ombudsman's Institute in the Czech Republic, Greece and the European Ombudsman. The base of analysing is a comparison with regard to the legal status, legal basis of institutions and good governance principles.

Práce přináší přehled institucí zabývajících se ochranou lidských práv a státních koordinačních orgánů v oblasti lidských práv. Ochrana lidských práv je primárním úkolem soudů, přesto je možno konstatovat, že výkonná moc – vláda každého státu, provádí státní správu v oblasti lidských práv. Studie rozebírá způsoby, jakými státy přistupují k ochraně lidských práv a konstatuje, že existuje několik typů států podle toho, jak koordinují svou vládní politiku lidských práv. Tyto jednotlivé typy jsou v práci popsány a analyzovány.

The paper complexly deals with ombudsman function. It describes its origin, historical developement and powers of ombudsman. In second part, focuses on European Ombudsman. It describes law connected with EO and describes his work and his results for years 2008-2010. The purpose of this paper is to get the reader familiar with work and responsibilities of EO.
Ombudsman status and his role in medical organizations

In my thesis I would like to inform the public not only about the office of ombudsman as such but also about the special ombudsman{\crq}s office for public health service, the tasks that he is in charge of and the fact how he can be helpful to people. The objective of my research was to find out how the public perceives the office of the ombudsman for public health service, what issues the ombudsmen deal with within the scope their offices in the health care facilities and to map the frequency of ombudsmen{\crq}s offices in the health care facilities within the Czech Republic. The hypotheses, which I have predetermined, were as follows. The public does not have enough information on the office of the ombudsman for public health service; the most frequent issues, which the ombudsman for public health service settles, are the grievances of patients concerning the behaviour of clinicians and nurses; and teaching hospitals have established an office of the ombudsman for public health service. Through my research I have learned the following facts. The office of the ombudsman for public health service has been established in six health care facilities of the Czech Republic. It includes four teaching hospitals and two non-governmental health care facilities. There is no legal regulation stipulating the necessity to establish an office of ombudsman in the health care facilities. The issues most frequently settled by the ombudsmen concern the improper communication of medical staff with the patients and their relatives or visitors. Another problem is the patients{\crq} dissatisfaction with the fact that the medical staffs does not properly or fully inform them, as well as the issue of too long waiting time in the emergency facilities. Using a questionnaire to address the public I also found out that almost three fourths of informants have never heard the term of ombudsman, they do not know what tasks he is in charge of and have no idea that such and office exists in some health care facilities in the Czech Republic. The same number of informants would like to obtain more information on the issue of the ombudsmen in the health care facilities and the public evaluates the current awareness of this issue as insufficient. More than a half of informants consider the office of the ombudsman for public health service as useful and think that establishing of such an ombudsman{\crq}s office results in a higher quality of health services.
Public guardian of the rights in European Union, Czech Republic and Slovak Republic

The diploma thesis focuses on institution of ombudsman in European Union, Czech Republic and Slovak Republic. It is aimed at questions of legal regulations of this institution in the mentioned formations. Particular chapters of this thesis are structured into following 5 task parts. The first chapter describes the history of the origin of this institution, explains the term of ombudsman by using definitions, classifies existing kinds of institutes of ombudsman and specifies the field of action. The second chapter identifies the European ombudsman. It is focused especially on analysis of received complaints in practically whole period of existence this institution and evaluation of activities in 2008. In the third chapter is described the institution of ombudsman in the Czech Republic and in the fourth chapter in the Slovak Republic. The last chapter of the diploma thesis deals with comaparison of ombudsman institutions in these two countries.

The thesis deals with a legal status of the ombudsman, one of the most important institutions of human rights protection. It offers not only a detailed analysis of legal regulations of the Czech ombudsman, but it also deals with a status of the similar institutions in selected countries from different parts of the world (Slovakia, Sweden, Denmark, Italy, South Africa, Georgia, Arizona - USA and European Union. First chapter provides fundamental characteristics of the ombudsman institutions, their history and significance to society of today. Chapter two discusses the legislation of the Czech ombudsman in detail, chapter three concerns itself with foreign ombudsmen regulations. Last chapter deals with comparison of regulations of all the above mentioned countries.
The institution of ombudsman in the czech legislation

We can consider the institution of ombudsman to be one of the traditional institutions of most democratic countries. The position of the ombudsman in the constitutional law system and his relation to other governmental authorities is relatively independent. The ombudsman is here primarily to help citizens who do not have any legal background and can be easily lost in the complicated system of governmental authorities. The Czech Parliament passed Act Number 349/1999 of the Law Collection, the Ombudsman Act, in 1999. The adoption of this act signified the implementation of another institute of law to the Czech legal system which should guarantee the abidance of human rights.

Obsahem diplomové práce je osvětlení a porovnání ombudsmanských institutů ve Švédsku, Nizozemí, Velké Británii a institutu evropského ombudsmana. Přes určité odlišnosti v počtu ombudsmanů, rozsahu jejich působnosti, pravomocech a jejich aparátu, institut ombudsmana ve všech těchto státech má za hlavní cíl ochranu osob před jednáním úřadů, pokud je jejich jednání v rozporu s právem, neodpovídá principům demokratického právního státu a dobré správy, jakož i před jejich nečinností, a tím přispívá k ochraně základních práv a svobod. Velice důležitým aspektem mé diplomové práce je také analýza možností, které by se daly aplikovat na instituci Veřejného ochránce práv v České republice. Tato analýza je založena na poznatcích o postavení a činnosti ombudsmanů ve vybraných státech a v Evropské Unii.
