Liability for damage to life and health in labour law (Abstract) This rigorous thesis deals comprehensively with the employer's liability for non-pecuniary damage caused by employees - ie damage to life or health of an employee in an employment relationship, ie both an employee and an employee working on a work agreement or work agreement. Civil servants will not be left out of the assessment either, as the amendment to the Civil Service Act refers in many respects to the Labour Code. The thesis contains a discussion of the basic institutes of liability with a focus on the prevention and prevention of risks in the workplace, a description of basic concepts in the field of accidents at work and occupational diseases, the extent of compensation. The text describes the system of individual compensations and the possibility of their application by the employer. The text of the thesis does not focus on a mere description of the current legislation but complements the individual institutes with short case studies from practice, which reflect, among other things, whether the legislation really responds flexibly to labour market needs. v anglickém jazyce The dissertation thesis deals with a very substantial and permanent part of the labour law's field and labour law-related and the other connected relationships, i.e. the issue of the work accidents and occupational diseases, mainly from the perspective of that arised reponsability's relationship, resp. the employer's obligations to damages' compensation in relation to employee and his individual rights (claims) to the damages' compensation due to the incurred accidents in the form of a work accident or occupational disease. The liability for damages caused by work-related accidents and occupational diseases

This diploma thesis deals with the employer's liability for damages caused by work-related accidents or occupational diseases of his employees. The reason for choosing this topic was partly because of the author's experience with the assessment of work-related accidents in legal proceedings, partly due to the high- frequency of work-related accidents and also the fact, the results of work-related accidents and occupational diseases not rarely cause a long-term adverse repercussion in real life of an employee. The main point of this thesis is to analyse elements of stated employer's liability for damages. Using the case law, detailed analysis of the concept of work- related accidents is performed in the same chapter. There are analysed specific situations with conclusions if the injury can be evaluated as an work-related accident or not. Besides work-related accidents, occupational diseases and other elements of liability, this chapter deals with the possibility of an employer to be absolved from any liability as well. Case law concerning the absolution from liability is also included in this chapter. The bachelor thesis deals with the issue of employer's liability for damage in the area of Labour law. Its purpose is to describe this issue and to clarify the most important terms. First part of the thesis analyses characteristic features of liability in Labour law area, especially employer's liability. It also explains particular types of liability for damage. Statistics from 2010, connected with occupational diseases and work accidents are mentioned in this part too. Chapter five is practical part of this thesis. Specific legal cases prove the compensation for damage connected with work accidents.

The purpose of this bachelor thesis is to analyse and clarify in detail the issue of liability for damage in Labour law with focus on liability for damage of employer. At first the thesis defines conception of liability and liability in Labour law in general. The thesis also deals with characteristic features, functions and prevention of liability for damage in Labour law as well. The main part is devoted to liability for damage of employer with regards to judicial decision. It explains general and special types of liability for damage of employer and explicates compensation for damage. Furthermore this thesis gives an attention to legal insurance of an employer's liability for damage incurred by work accident and occupational disease and accident insurance.
