Obligations of Patients and Medical Facilities in Public Health Protection

Personality rights are fundamental human rights which are the subject of much attention also during the provision of health care. A patient has right, above all, to data protection in his medical documentation, medical facilities have an obligation to maintain confidentiality on matters relating to the patient?s state of health. All therapeutic actions can be carried out only with the consent of a patient. However, the personality rights can be limited in order to protect public health. Legislation can impose a whole range of obligations and duties to patients and medical facilities in order to protect public health. The thesis summarizes fundamental legislation and regulations of the above mentioned issue. It describes a possibility to break the confidentiality in order to protect public health, a regulation of imposition of compulsory medical treatment and anti-epidemiological measures. The thesis briefly informs about company preventive care and related limited choice of a physician and a medical facility. The objective of the thesis was to find out the views of general public of limitations of personality rights in order to protect public health. For the practical part the method of quantitative research was chosen, the technique of a questionnaire. The research was conducted from January 2011 to March 2011 in the region of České Budějovice. The research group included 460 respondents, 405 respondents filled in the questionnaires properly and these were included in the research. To achieve the research objectives, three hypotheses were set. Hypotheses 1 and 3 were proven on the basis of obtained and statistically evaluated data. Hypothesis 2 was not proven. The research results demonstrated especially differences in respondents´ views of a possibility to refuse obligatory vaccinations.
Organ extraction (de lege lata)

The thesis is bent on systematic analysis of Czech legislation de lege lata in organs taking for transplantation then on the part of received legal regulations. Subsequently equate to law those problems with other countries around the world and serves a comprehensive view of different solution of law. The way out of the theoretic parts is to incorporate problems among basic human rights, the right to live and the right of protection of personality, according to international convention and Czech laws. Theoretic part leads to the characteristics internationally recognized law principles for transplantation which is above all legal protection of organ donors warranted formulation of agreement or dissent from organs taking and pertinent grant the same possibilities for families. Further then certainty to define deaths brain and anonymity for deceased donors but also protection for the organs recipients and data confidentiality preservation with the possibility to antedate the donors and last but not least to ban pecuniary benefit and dealing with organs. The thesis comments on how these principles are projected in their legislation in particular countries in the world. The research was aimed to find out the relation between knowledgeable agreement or if you like knowledgeable dissent from fulfilment of organs taking and measurable transplantation records in particular countries. It used data, which were for the first time published on a world-wide scale by the world's health organization. As measurable result for transplantation was selected a number of deceased organs donors to one million inhabitants. The hypothesis confirmed that a country with legislation knowledgeable agreement, which means the country where the right requires knowledgeable agreement individually with organs taking, has worse measurable record than the country where's by law is to agreed to take organs expectedly unless it is used the right to deny it during the life of the organ donor. The other research investigated also the right that families can express their opinion on taking organs from deceased relative with a hypothetical presumption that the family decision can implicate to disrespect the universal personal law if it denies the will of the deceased person done during its life. At last the situation of absence of the right on family decision-making was surveyed. Such cases of other access to universal personal law did not notice better results in transplantations than there, where this right thoroughly applied in laws. This research brought a lot of interesting information on access of organs taking for transplantations in different parts of the world. This fact contributed to recognition on how important is the influence of morale and ways on legislation of appropriate country and how legislation influences results of transplantation in creditable life-saving process.
Transfer of personal data abroad

The purpose of the work is to evaluate the stage of development of the rules for tranfer of personal data for the European union to the third countries. First it gives necessary information regarding the protection of personal data in general including the key terms, basic principles and also the legal framework. The second part explains the legal mechanism of tranfer of personal data from EU abroad with the use of the term "adequate protection." Possible methods of such tranfer which are in compliance with the requirement of provision of the adequate protection to the protection ensured in the European Union are given. The third part concentrates on the development of the negotiations between the United States and the European Union about the transfer of personal data of air passengers and resulting legal arrangement. The work also describes current trends and provides possible future development of this sphere.
Zákon o ochraně osobních údajů a právní vztahy

Tato diplomová práce pojednává o ochraně osobních údajů. Osobní údaje jsou velice citlivým tématem, které se dotýká každého z nás. Teoretická část objasňuje některé základní pojmy nově přijatého zákona o ochraně osobních údajů, který upravuje tuto problematiku. Pozornost je taktéž věnována výkladu samotného zákona a nově vzniklé instituce Úřadu pro ochranu osobních údajů.Praktická část je zaměřena na aplikaci získaných poznatků z teorie na konkrétní příspěvkovou organizaci Nemocnice Jihlava. Osobní údaje zpracovává zdravotnické zařízení v době od přijetí pacienta, po celou dobu léčby a v malé míře i po ní. Tato praktická část diplomové práce se především zabývá povinnostmi zaměstnanců příspěvkové organizace Nemocnice Jihlava při vedení zdravotnické dokumentace a právy občanů a pacientů v oblasti ochrany osobních údajů v tomto zdravotnickém zařízení.
Ochrana osobních údajů ve zdravotnictví

Tato práce si klade za cíl seznámit s ochranou osobních údajů ve zdravotnictví. Nejprve ze zabývá historií ochrany osobních údajů, od jejího prvního zakotvení v právním řádu, poté přechází k obecné platné právní úpravě. V následující, hlavní části práce je rozebírána zdravotnická dokumentace, jako nositel citlivých osobních údajů, co všechno obsahuje a její možné formy a podoby. S příchodem informačních technologií se nebezpečí zneužití nepovolanou osobou zvyšuje, práce se proto zabývá v jakých případech mohou především orgány vykonávající státní zájem přistupovat do zdravotní dokumentace, a to i bez souhlasu pacienta. Také je rozebírána možnost pacienta a jeho příbuzných na nahlížet a pořizovat kopie dokumentace. V závěru je popsán národní zdravotnický informační systém a v něm používané osobní údaje.
