Current Issues of the Carrier's Liability for Breach of Contract of the Carriage of Goods by Sea

in English The transport sector represents about 7% of European GDP. It should be also noted that European companies own 41% of the total world fleet capacity. As it can be seen, transport itself is an important industry and a major contributor to the functioning of not only the European economy but also the international economy. The maritime transport covers 80% of all trade exchange and has become the major transport sector in international business. The Hague, Hague-Visby (together so called Hague-Visby rules) and Hamburg Rules have become the main reason for lack of uniformity in the field of the carriage of goods by sea with their different texts and legislative styles. These three sources of law are actually in force in different countries. As the maritime transport is mainly international, this heterogeneity causes problems in practice. This thesis analyses the maritime carrier's liability for loss of or damage to goods under convention based regimes. The Czech Republic has ratified the United Nations Convention on the Carriage of Goods by Sea signed on 30 March 1978 in Hamburg (called Hamburg rules). 1 Liability of the carrier in international carriage of goods in comparison Abstract The rigorosum thesis deals with the analysis of the legal regulation of the carrier's liability in the international carriage of goods, all that across every key type of international carriage, while these rules are being continuously compared with one another in the text of this rigorosum thesis. The thesis tries to point out the differences in the regulation connected to similar legal institutes within two or more types of carriage. The introducing part of the rigorosum thesis includes the interpretation of basic terms which are commonly found in international carriage, defines its subjects and their possible plurality. Furthermore, the thesis then explains the necessary definition of individual types of carriage, i.e. regimes in which international carriage can be performed. The role of freight forwarders in international trade and carriage is highlighted as well. The thesis diploma is focused on the issue of insurance in maritime transport of goods from international point of view. Marine insurance is very important part of sea transport and belongs among the most important components of its smooth functioning. The objective of the thesis diploma is to introduce and explain the topic of marine insurance in comprehensive manner, using domestic and foreing law, literature and judicial decisions. The thesis diploma is focused on English law which is considered to be the most developed in this field. The reason I chose this topic is my personal interest in both marine insurance and sea transport, since I consider both fields to be very important part of international commerce. The first chapter is dedicated to the definition of relevant terms, subsumption of sea transport into a legal framework of carriage and forwardning relations and division of sea transport. The importance of maritime transport for international trade

The diploma thesis deals with the topic of international maritime transport and its importance for the development of world trade. First, the basic theoretical background specific to maritime transport is explained. The thesis then deals with the analysis of the relationship between shipping and international trade. Emphasis is placed primarily on container transport. Furthermore, the current trends and problems that occur in maritime transport are discussed. Great importance is also put on the largest maritime routes and ports in the world. The last part of the thesis explores the potential use of the Northern Sea Route for commercial maritime navigation.
Applying CRM to maritime transport

Main goal of this diploma thesis is to make market analysis of CRM systems in field of maritime transportation and if there will be any opportunity to expand on this market, then propose changes that would fit needs of potential customers. In this diploma thesis, you will firstly be introduced into this topic by reading about enterprise systems, their advantages and disadvantages, distribution by several criteria, then you will learn something about system SugarCRM and in the end of theoretical part you will get necessary information about maritime transportation. Practical part starts with analysing of system SugarCRM from two points of view functions with user interface and database schema. After that there are provided results of questioner which was focusing on information systems and people working in maritime transportation. These results were then used to decide which functions should be implemented first and which of them are not so necessary. By getting results from previous two parts feasibility study was created. In the end you can find conceptual design of new suggested features.
Liability in International Sea Transport

Liability in International Maritime Transport Main aim of this thesis is a brief introduction to the maritime law, the applicable liability systems, impact of carriage of goods by sea on trade in the Czech Republic and possible future development of international trade. The relationships in the maritime area may be quite complicated and the purpose of this thesis is to present them in a reader-friendly, comprehensible manner. The original reason that led me into choice of this topic is my personal interest in both international trade and ships. International transport may be considered as subsidiary to the sale or exchange of goods but is of essential relevance for the conclusion of trade. Approximately 90% of non-bulk cargo is shipped via ocean. The importance of the international maritime transport is therefore enormous and together with broadening globalization, the legislation in the area of maritime transport gradually increases its effect on the Czech Republic. Moreover, the freight and other costs of shipping considerably influence purchase price of goods. The master thesis deals with the application of delivery conditions in the maritime and air transport which was done in forward company Hellmann Worldwide Logistics Ltd. The theoretical part describes air and maritime transport focusing on development in Europe. The international interpretative rules INCOTERMS 2010 were discussed. The practical part explains application of delivery conditions by using business cases from company Hellmann. This part includes their comparison. Export and import operations were chosen on route Europe and Far East.

This master thesis deals with the very current topic of ballast water management, a very specific field in the maritime shipping industry. The aim of the thesis is to introduce the subject clearly and to sum up the main issues which restrain a smooth implementation of new regulations that emerged from a recently adopted international treaty. This treaty, the so-called Ballast Water Management Convention, will possibly have immediate impact on the seafreight market rates and thus on the entire international trade. So purpose of this thesis is to estimate what the result might be like.

The aim of the diploma thesis is the comparison of maritime and rail freight transport between Asia and Europe. The thesis focuses on characteristic of rail transport as an alternative mode of transport and identification of possibilities, how to increase its competitiveness towards to maritime transport. First part of the thesis analyses current situation in maritime and rail transport and focuses on their specifics and future potential. The practical part deals with the change of fictitious company´s logistics system. Maritime and rail transport are compared in terms of risks, costs and shipping time. The last part of thesis deals with possibilities of increasing competitiveness of rail transport in the future.
The Study of Logistics Procurement with a View to Purchase

This thesis focuses on reduction of costs associated with the acquisition of amorphous cores from China, namely reduction of transport costs. The first part introduces the company’s production program. Then the thesis provides theoretical knowledge and analysis of the current state of the ordering process. Based on the analysis I have proposed measures which are reducing transport costs. Conditions needed for the implementation of these proposals are proposed as well. The final part offers quantified benefits of each proposal.
