Criminal Aspects of Corruption

Corruption is a very current problem, which occurring in both the public and private sectors, poses a great threat to society as a whole. The main goal of the diploma thesis is to provide a thorough analysis of the legal regulation of corruption in the Czech republic. Therefore, this work presents both substantive law, with focus on criminal offenses of bribery, and procedural law. The introductory section of the thesis introduces the theoretical aspects of corruption; namely the definition of this term as well as other related terms, types of corruption or the possibilities of measuring it. The author does not omit the relevant European and international aspects of the fight against corruption. The main part of the thesis is devoted to the Czech legislation currently in force related to bribery; but it deals with the development of legislation in the Czech Republic, too. Thus, the work discusses criminal offenses of bribery; corruption sanctions regime, as well as procedural tools focused on uncovering corrupt conduct. The final part of the work focuses on the comparison of legislation in the Slovak republic and French Republic. Criminal Aspects of Corruption

This doctoral thesis deals with the selected criminal aspects of corruption pointing out the possibilities to sanction its most severe forms by means of the Czech criminal law. From the substantive point of view, the core of the thesis is the analysis of the bribery crimes and the thorough analysis of their selected elements, which can bring about interpretative and related application problems. It also refers to the issue of corruption in the private sector and the manner in which the Czech national legislation of corruption crimes copes with a requirement for its sanctioning, which follows from international commitments. In terms of procedural aspects, the thesis focuses on certain particulars of detection, investigation and evidence procedure relating to corruption criminality. Corruption criminality is regarded as latent criminality and in its most serious forms it is also connected to organized crime, which consequently requires application of specific means and methods in criminal procedure. However, in the course of their realization they are predominantly connected with an interference with individual's fundamental rights, so, as a reaction to that, a consistent legislation of conditions for their realization ought to be adopted. Post-Socialist Corruption as a Legacy of the Past? The Experience of Central European Countries

This Bachelor's thesis deals with the phenomenon of post-socialist corruption. Corruption is a frequent topic of discussions within society, yet almost always the focus is on the current situation and contemporary scandals. This work tries to apply a more in-depth approach. It examines to what extent corruption in Central Europe is a legacy of the socialist regimes and of the subsequent period of transition. Corruption is not a modern phenomenon, it has been present in Central Europe for centuries. However, it seems that the beginning of socialism represents a turning point, which changed whole structure of the society. This work examines structural characteristics of the former regimes such as: their hierarchical nature, shortage economies and its effects on the emergence of corrupt practices, and the mechanism beyond it. Social norms and clientelist networks created in the former regimes survived even after year 1989. Moreover, the period of transition brought new options for corruption such as: privatisation, legislative and institutional vacuum, and economic recession. An analysis of certain aspects relevant for corruption in the period of socialism and transition could help us better understand contemporary corruption in the countries of Central Europe.
Economic impacts of corruption in government

Bachelor thesis evaluates impact of corruption inside state administration on the economy of state. Analyzes modern forms of organized crime, clientelism, white collar crime, particularly the issue of public procurement and tax evasion. Used correlation analysis and graphs compare selected macroeconomic indicators with level of corruption within three European countries (Finland, Czech Republic and Bulgaria). The task of this thesis is to evaluate how corruption affects the economic performance of state.
Corruption in Slovakia: The role of non-government organizations in fight against corruption

Corruption as a contemporary phenomenon attracts attention of laymen but also experts who are trying to define this notion on the basis of various criterions. The aim of this thesis is to theoretically define corruption as the attendant phenomenon of the current society and to analyze methods of its solution. The studied country is Slovak republic which as a post-communist country shows some specifics. There are many proposed ways how to solve the problem of corruption however this thesis concerns itself primarily with the role of non-government organizations and their ability to actually influence political acts concerned with restricting of corruption possibilities. The intense cooperation among these non-government organizations and especially their cooperation with the government is crucial in order to be able to influence the political agenda. Therefore this thesis deals with this non-government organizations -- government relationship as well.
Public-private partnerships and their praxis in EU member states

The aim of this final thesis is to analyse and compare the PPP practices of EU member states and to evaluate the current situation of their PPP markets as well as the issues faced at present. The study consists of four chapters. The first chapter deals with the theoretical and legal concept of public-private partnerships: the definition of PPPs, their characteristics, advantages and disadvantages of PPPs and the factors influencing the success of PPP projects. The section thereafter analyses the position and role of the EU, EIB and EBRD in promoting and supporting the implementation of PPP projects. The section is followed by an assessment of the PPP market development trend, high lightening the basic quantitative differences between the EU member states. Chapter four forms the core of this thesis in which, based on specified criteria (legal and institutional PPP conditions, average value of a project, corruption, transparency and the nature of the public sector) the PPP praxis of Great Britain, Italy, Greece, Sweden, Poland and Slovakia are analysed and compared. The states are characterized by national PPP markets of diverse quality as well as significant differences in the national conditions for implementing PPP projects.
