The Principle of Subsidiarity of Criminal Repression

This diploma thesis deals with one of the key principles of criminal law - the principle of subsidiarity of criminal repression. This principle, now expressly formulated in Section 12 Subsection 2 of the Criminal Code, is the subject of interest of both legal theory and application practice. The research tries to answer the questions whether the current enshrinement of the principle of subsidiarity of criminal repression in the Criminal Code is necessary, whether the wording used is appropriate and whether this principle of application practice is handled appropriately. The thesis is divided into two parts: The first one deals with the theoretical definition of the examined principle and the concepts related to it. In the second part, specific practical cases are presented, which affect the principle of subsidiarity of criminal repression, and the methods of solving these cases are then compared with the conclusions made in the theoretical part. Hate Crimes Abstract The author of this thesis discusses the issue of hate crimes according to the Act No. 40/2009 Coll., The Criminal Code, as amended, and related case law. The thesis is divided into several parts. The first part is devoted to the definition of hate crime and related terms such as extremism, prejudice, race, anti-Semitism, nationalism and xenophobia. These concepts are important for the following interpretation and for the understanding of the existence of special protection in the context of hate crimes. The second part is devoted to the international regulation of hate crimes. Emphasis is places on the analysis of the case law of the European Court of Human Rights. The third and fundamental part of this master thesis analyzes hate crimes in the Czech Republic in the context of settled and current case law. In addition, examples of statements fulfilling the facts of individual crimes from practice are given. The fourth part analyzes the basic issues of hate speech and hate crimes in the United States legislation and case law. It also includes comparison of individual approaches with ideas of possible inspiration. Kuchtová, K. Cyber risk of non-cash and electronic payment. Bachelor thesis. Brno: Mendel University, 2017. The bachelor thesis is focused on cyber risk of non-cash and electronic payment. The first part of this thesis specifies the most popular electronic payments system and with that linked cyber risks. By questionnaire survey is then determined the extent and frequency of use of non-cash and electronic payment instruments. The survey also investigates the knowledge of users within the cyber security topic as well as the use of security measures and elements of individual instruments. At the same time, thesis should recommend steps to reduce the cyber risk.

Cyber risk of cashless and electronic payments

The author of this bachelor thesis deals with the present phenomenon, namely cyber risk narrowed to the field of payments. The subject of this thesis is to present comprehensive and understandable information about this phenomenon with the accent on defining vulnerable points to cyber risk connected with payments. At the same time, it should recommend steps to reduce the cyber risk and show how other users do so. A survey research is a part of this thesis and it analyses the awareness of society in this field. Last but not least it shows real cases of the cyber-crime.
