Immigration Policy of the European Union: Legal Status of Third-Country Residents

This master thesis deals with the issue of development of the EU immigration policy and expansion of the rights of third-country nationals who have been legally residing in the territory of the Union throughout this development. The aim of this thesis is to outline the crucial milestones in the form of primary and secondary legislation that led to the broadening of the scope of rights of third-country nationals in the Union, while examining their legal status in the Union in general and in the Member States in particular. The first part of this master thesis introduces the historical background, outlines the development in context of the European Union and provides the categorisation of legal third-country nationals residing in the territory of the EU, whereas the second part of the thesis deals with transposition of European legislation into national legislation of the selected Member States - Germany and the Czech Republic - while drawing a line of compliance and emphasising local requirements that were introduced in addition to (but not exceeding the scope of limitation provided by) EU legislation. Fundamental rights aspects of the free movement in the ECJ (case law)

This thesis analyses in depth the seminal cases of the Court of Justice, namely C-341/05 Laval, C-438/05 Viking Line and C-346/06 Ruffert. The analysis starts with description of the decisions. Those are laid out both from the perspectives of the Advocates General and of the Court of Justice (chapter 2). Central aspects of the decisions are analysed in chapter 3. First, it is the decision to apply Community law (now EU law) to national social policy. This is not new in itself, but it is taken to unusual depth. Second, the Court of Justice decided to apply Community law to trade unions. This horizontal application of Community law has crucial implications on the human rights discourse of the Court. Third, we analyse how the Court viewed the issue whether the strike action violated the Treaty, and the issues of justification and proportionality. Chapter 4 focuses on human rights aspect of the decisions. The very use of human rights in Community law is briefly sketched. In more detail the implications of the likely accession of the European Union to the European Convention on Human rights are considered. Position of third-country nationals in European Union law

The aim of this work is to clarify the position of third-country nationals in European Union law in terms of migration and free movement. The first chapter describes the development of European integration and formation of free movement within the European primary law. Great attention is paid to the Schengen acquis. The second chapter provides an overview of the specific directives, which directly concern the right of entry and residence of third country national in EU. The third and also final chapter focuses on the visa policy of the European Union. Individual chapters are interlaced by judgements of the Court of Justice of the European Union, which had a major impact on the interpretation of Community law.

Bachelor thesis deals with the European Employment Services, known under the acronym Eures which constitute the main instrument of the European Employment Strategy and an important information source in the field of profession mobility in Europe. The objective of the thesis is to analyse the functioning of Eures on European scale and in Czech Republic. The opening chapters present the principles of the free movement of persons and the employment politics of the European Union. The next chapters define the legal basis of the system Eures and its principal mission. The crucial part of the thesis is the analysis of the Eures in Czech Republic, its installation, organisation structure and the main activities.
