Organized Drug Crime

This thesis focuses on the issue of organized drug crime. In the introduction of the thesis the terms related to this type of crime are defined, namely organized criminal group and addictive substances according to the Criminal Code. Furthermore, the introduction discusses organized crime in terms of criminology and the historical development of organized crime in the Czech Republic. The main part of the thesis is already devoted to organized drug crime. This part first describes how the perpetrators of this type of crime are organized, as well as explains the ways in which drugs can be smuggled, including the history of drug trafficking in the Czech Republic and other parts of the world. A significant part of the work is devoted to the use of information technology for drug smuggling, especially the dark web. A very interesting section in relation to the use of technology is the laundering of the proceeds of crime through cryptocurrencies, which gives an insight into the ways in which this new practice is being implemented. At the end of the main section, the thesis will give an insight into the current drug situation, summarizing the current trends in drug supply. Needs analysis of workers of Probation and Mediation Service in Prague on further education in the addictology field

Background: The Probation and Mediation Service (PMS) deals with offenders of criminal activity, some of whom also have addictive behavior. The addiction of the offender is considered as a significant risk factor for criminal recidivism. According to the PMS annual report, there has been an increase in the proportion of the drug crime by 2-3 percentage points per year since 2017, to 26 % in 2021. Working with addicted offenders requires specific knowledge and skills. Objectives: The thesis has the objective to identify and analyze the current needs of further education of probation officers of the Prague centre in the field of addictology. The partial objective is to find out how - according to respondents - the proportion of offenders of criminal activity with addiction problems is and its comparison with official statistics. Methods: The data was collected in the form of a questionnaire survey. The research sample included 32 probation officers from the Prague centre (out of 41 in total). The staff was selected by total sampling method, the return rate was 78 %. The data was analyzed using descriptive analysis method. The research was conducted in accordance with ethical principles. The methodology of drug-related crimes in theory and practice ABSTRACT This thesis is focused on issues of drug-related crimes, mainly from the investigative point of view. This means from the point of view of the methods and techniques that are used by police authority. According to the inherent connection between criminalistics and criminal law, the thesis also reflects procedural aspects of the acts and descriptions of particular crimes under criminal substantive law. The thesis consists of an introduction, eight chapters and a conclusion. The first chapter is dedicated to definition of particular terms which are commonly used within this topic. Each definition is expounded upon in the context of legal development. The system of legal adjustment is compared with foreign systems. The second chapter analyses the structure of realtionships and positions of each person within the drug's hierarchy which are reflected in investigative tactics. A description of the criminal acts under criminal substantive law is contained in the third chapter. This description must be included to properly explain the facts of the case. Criminal Aspects of Drug Crime

The thesis "Criminal Aspects of Drug Crime" presents selected aspects of the current global problem of drug abuse in the criminal law. The aim of the thesis is to point out the negatives of drug abuse and their image in the current wording of the facts of drug offences. The thesis is divided into four parts. The first part focuses on the frequently used term "drug", as well as the breakdown of drugs and the effects of selected drugs. The second part gives an overview of the development of domestic legislation, focusing in particular on the Criminal Law of 1950 and 1961. The third part is the core part and presents the current legislation, primarily the meanings of drug offences defined by Act No. 40/2009 Coll., the Criminal Code. The fourth and last part serves to present the Romanian legislation on drug offences, highlighting its most interesting aspects.
Methods of investigation of drug-related crime

The methodology for investigation of drug-related crime is the topic of this thesis. There are a few reasons why I have chosen this topic. The issue of drugs, drug-related crime, drug addiction and also illegal drug traffic has become recently the worldwide problem which intervenes into many areas of human life and therefore we must constantly pay attention to it. Especially this fact, together with other reasons as my personal connection with drug issue (few-year-long involvement in the program focused on the primary prevention from drugs at secondary schools) made me to choose this topic. My thesis is divided into 6 parts. In the first two chapters I define the general notions related to the drug issue and I provide with the division of drugs into groups under chosen criteria. For the better orientation in this issue I have listed the most common types of drugs with the description of their effect on the organism of humans. In the third part of my thesis I focus on the criminal prosecution of drug offences and the historical development of the legal regulation of this issue. 95 Summary - Crime Related to Substance Abuse This diploma thesis deals with the phenomena of drugs from the criminal law point of view. This topic represents a danger for a lot of domains, eg. criminality, therefore it is necessary to pay appropriate attention to it. The first chapter is introductory and it defines the basic terminology concerning drug problem. The next chapter looks at the drugs in international dimension. It focuses on international treaties handling narcotic drugs and psychotropic substances, which affected legislation in the Czech republic, especially by those adopted in the United Nations. I briefly mention overall situation in the Czech republic after 1989. The third chapter describes the evolution of legislation from the time of Austro- Hungarian empire until the times of new criminal code. The principal part of my diploma thesis concerns primary and secondary aspects of drug-related crime. The fourth chapter is a detailed analysis of drug crimes according to criminal code Nř 40/2009 Coll. Analysis of the individual merits follows after defining common features of these crimes. 107 Forms of crime committed by organized crime - Abstract The aim of this work was to map the range of criminal offenses and other criminal acts perpetrated by perpetrators of organized crime. Members and supporters of criminal organizations commit a large number of different offenses, primarily with the intention of obtaining illegal profits. However, some actions aim at legalizing previous revenues, establishing contacts in police, justice, and public administration, or to prevent these groups from being exposed. A specific crime may have multiple meanings in the overall strategy of the organized crime subject. Such an act is committed to both profits and cover- up (eg murder, extortion). This work is divided into three parts. The first part, consisting of Chapter 1, deals with the theoretical and legal definition of organized crime and other related concepts, such as organized groups and organized criminal groups. For these characteristics, both professional treatises and legal regulations are used, including international conventions, EU legislation and the laws of the Czech Republic. Secondary drug - related crime for clients contact center DRUG - OUT Klub, z.s. in Ústí nad Labem

Basis: Statistical data of the Police of the Czech Republic show that secondary drug crime is widespread among abusers of addictive substances in the entire Czech Republic. The crime is mainly due to the need for financial resources for buying the addictive substance. As a result, every addictive substance abuser is perceived as a potential perpetrator of a crime. Aim: The aim of this diploma thesis was to find out the incidence of secondary drug criminality in the clients of the contact center DRUG - OUT Klub, z. s. in Ústí nad Labem, and to study the effect of selected influential demographic factors (gender, age, type of addictive substance, duration of addictive substance abuse). Methods and Research Sample: The research was conducted in the drug addiction treatment center DRUG - OUT Klub, s. z. in Ústí nad Labem using a questionnaire. The research respondents were problem abusers of opioids and stimulants. The research sample was selected with help of the institution. Every client of the contact center, who was a problem opioid or stimulant abuser, was over 18 years old, and agreed to be part of the research could participate.
