The concept of crisis assistance by participants of social services planning in Liberec

Society is currently struggling with various negative phenomena, one of which is suicide. According to the latest available sources, the highest rate of suicide in the Czech Republic is in the Liberec region. One possible tool for reducing the suicide rate could be social crisis assistance services. However, when we look at the social services register of the Ministry of Labor and Social Affairs of the Czech Republic, we find that crisis assistance is not available in all regions. According to this register, no such service exists in the Liberec region, including its capital city Liberec. Social service planning is essential to community planning in the city of Liberec. How is it possible that this type of service is not available here? To answer this question, it is necessary to go back to the beginning and first ask how this concept is perceived by the involved parties. This thesis aims to provide insight into the understanding of crisis assistance among the parties engaged in community planning in Liberec, and to show how it is reflected in different attitudes in the process of planning social services in the area. Media Discourse Analysis of rigt-wing weblog Altermedia.info

The thesis called Qualitative Analysis of Media Discourse of the Far-right Blog cz.altermedia.info deals with the discourse analysis of the Czech version of an international project Altermedia.info. Discourse analysis aims at differences between the discourse of the founding editor and the current one and analyses the neo-fascist nature of the blog. The theoretical framework of the analysis is based on the postmarxist theory of discourse introduced by Ernesto Laclau and Chantal Mouffe. The theoretical part of the thesis summarizes the findings of researchers who are engaged in discourse analysis (structuralism, poststructuralism, Michel Foucault, Louis Althusser, Norman Fairclough, Teun van Dijk). The thesis also examines how specific meaning is constructed within the nationalist discourse of Altermedia and to what extent a new team of authors contributed to the change of discourse. The analysis identifies the main nodal points, which are involved in the construction of discourse, and examines the antagonistic processes within the two different editors. Discursive analysis reveals particular inclination of the current discourse of Altermedia for the neo-Nazi ideology, and thus indicates the fundamental antagonism between the founding editors and current one.

99 The Principle of Proportionality: Critique of Theoretical Standpoints and Its Relevance Abstract: A decision concerning a fundamental rights conflict needs to respect the principle of proportionality in order to be compatible with a constitutional order. The principle of proportionality obliges the court to adequately assess and weigh the conflicting fundamental rights or other constitutional principles in light of the particular facts. The proportionality of the decision is to be ensured by the so-called proportionality test. It consists of three steps: an assessment of the suitability, necessity and proportionality in a strict sense. The thesis The Principle of Proportionality: Critique of Theoretical Standpoints and Its Relevance describes the proportionality principle and the proportionality test in a specific legal- philosophical and legal-theoretical context. The first chapter introduces discursive theory as an important starting point for the rational application of fundamental right norms and the use of the proportionality test. For this purpose, it identifies the relationships between discourse, norms of justification and the proportionality principle. Discourse theory and the contradictory principle in law

The subject of this diploma thesis is discourse theory and its reflection on the style of judicial decision-making and argumentation. Discourse theory is based on the fundamental assumption that an interaction of more people is needed to achieve right and just knowledge. This is so because an individual is not capable of surmounting her or his own subjective perception of reality. On the contrary, a dialogue enables the articulation of opposing points of view and thus makes it possible to arrive at a more objective and just knowledge. The discourse theory of law, developed by J. Habermas and primarily by R. Alexy, ranks among the theories of legal argumentation with the dialogical approach to the desicion- making as a basic feature. The judge is no longer perceived as an authority that dictates a binding solution of the case to the parties. He or she cooperates with the parties to find and co-create the law to be applied. Discourse theory also stresses the claim to the equal position of parties. According to the contradictory principle, all parties have the same possibility to defend their statements and points of view.
