Comparison of the old-age pension insurance legislation in the Czech Republic and the Slovak Republic Abstract The main aim of this thesis is to compare the old-age pension insurance legislation in the Czech Republic and the Slovak Republic, to point out their differences and similarities, and to evaluate their significance. To a lesser extent, the thesis also deals with the theoretical foundations of pension insurance and the historical basis of social security law, which is common to both countries. The thesis is divided into seven parts. The first part introduces social security law as a legal branch and pension insurance as its subsystem. The second part concentrates on the historical development of pension insurance from prehistoric times to the end of the twentieth century. The following three parts of the thesis are focused on the pension insurance system from a point of view of legal theory. They primarily examine relevant legal principles and sources of law, but also individual social events and pension insurance benefits. Moreover, they deal with various options for financing pension insurance and also present its pillar framework. Development and Comparison of Legal Regulations Concerning the Social Insurance Systems in the Czech and Slovak Republics

The dissertation presented concerns the development trends in social security provision in the territory of the present-day independent states of the Czech and Slovak Republics, which, with only a short interruption in difficult Nazi occupation in World War II, made up the common state administration unit of Czechoslovakia, from 1918 to 1993. The dissertation continues tracing the evolution trends in the welfare system in each republic upon the dissolution of the federal state, and, finally, it focuses on the comparison of pension reforms implemented in both countries. Firstly, the developments in the legal regulations concerning social security schemes in the period preceding the First Czechoslovak Republic are studied. Both states were integral parts of the Austro-Hungarian Empire, where a social reform was implemented in 1888 in its Austrian part, known also as Taaffe's Reform. It introduced mandatory public social insurance in three separate acts. The reform was inspired by Otto von Bismarck, Chancellor of the German Reich. In 1918, after World War I, the Austro-Hungarian legislation was fully adopted by the newly formed Czechoslovakia and the burden of responsibility for all problems regarding the previous social security system assumed. Selected issues of the third phase of pension reform in the Czech Republic

Ausgewählte Fragen der dritten Phase der Rentenreform in der Tschechische Republik Das Ziel meiner Diplomarbeit ist die Beschreibung, die Analyse und die Auswertung der dritten Phase der Rentenreform mit dem Hinweis an die Probleme, mit dennen auch die letzte Entscheidung der Regierung über die Aufhebung des zweiten Pfeilers des Rentensparens verbunden wurde. Die Arbeit wird systematisch an die 5 Kapitel geteilt. In der ersten Kapitel werden die universale Prinzipen und Möglichkeiten der Konstruktion der Rentensysteme zusammen mit der Aufnahme des tschechischen Rentensystems in dem System der Sozialversicherung detailisiert. Die zweite Kapitel detailisiert die Gültigrechtsausgestaltung des tschechischen Rentensystems.In der dritten Kapiltel wird auf die Probleme verbundene mit der Einführung der Groβrentenreform hingewiesen und auf diese Problematik knüpft die letzte Kapitel an, die genau das nächste Prozess der Aufhebung des zweiten Pfeilers der Rentensparung analysiert. Am Ende meiner Arbeit werden die gewonnene Kentnisse allgemein gemacht und die Überlegung über die Erfolgsamkeit der Einführung einer Fondfinanzierung in das tschechische Rentensystem. Comparison of pension system in Czech and Slovak republic

The main aim of this dissertation is to compare the pension systems of Czech and Slovak Republic. The first part is dealing with the theory of pension systems and places emphasis on main philosophic concepts, from which these come from. The second part describes main attributes of Czech pension system and points out, that its reform is really needed. The third part of this dissertation analyses pension reform, which has been adopted in the Slovak Republic. Its aim is to consider all positives and negatives of this reform as well. The further development of Slovak pension system after adoption of this reform examines the fourth part of this dissertation. The last part compares the Czech and Slovak pension system and tries to evaluate, which conception of pension reform would be the best for the Czech Republic.

Práca sa zaoberá dôchodkovým systémom najmä na Slovensku, ale aj ako to funguje vo všeobecnosti. V prvej teoretickej časti autor predstavuje dôchodkový systém, jeho charakteristiku, výhody a nevýhody. V druhej časti analyzuje problémy, príjmy, výdaje a celkovú vybilancovanosť starého dôchodkového systému. Následne poukazuje na obdobie reformy a zmeny systému. Ako to bolo riešené na Slovensku resp. ako sa to dá vyriešiť inak. Cieľom práce je zistiť skutočný stav tohto dôchodkového systému.
