Effect of amendments to the Civil Code on the real estate practice

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

1 LAND REGISTRY ABSTRACT The aim of this rigorous thesis was to provide a comprehensive overview of the current legal regulation in the field of Land Registry, which is primarily regulated by two legal regulations, the Cadastral Act No. 256/2013 Coll. and the Decree on Cadastre No. 357/2013 Coll. The first chapter deals with the theoretical concepts with which the Land Registry works. The author has defined and explained in detail the concept of Land Registry and its purpose. The second chapter deals with the history of the Land Registry, which dates back to Ancient Egypt. It describes in detail the historical development up to the current legislation. The third chapter deals with the principles that run through the entire Land Registry and on the basis of which the Land Registry acts. Among others, the principles of material and formal publicity, the principle of superficies solo cedit, intabulation, and disposition can be mentioned. The fourth chapter regulates the filings to the Land Registry, specifically the entry, the record and the note. It also describes the entry procedure and concludes by explaining what is meant by the term seal. Entry record in the Land Register

The diploma thesis deals with the entry record to the Land Register of the Czech Republic. The adoption of the Act no. 89/2012 Coll., Civil Code and the Act no. 256/2013 Coll., On the Land Register, caused extended changes in the real estate register and cadastral legislation. This changes had a significant influence on some legal concepts relevant for this field of law. The diploma thesis in divided into four parts. The first part is used for the acquisition of basic knowledge on the issue of Land Register, with emphasis on principals that control the operation of the Lend Registry and making entries in it. The second part provides a thorough analysis of the current form of the institute of entry record and registration procedure with regard to previous legislation. The third section is devoted to examining of the German legislation, registration of real estate with an emphasis on the Land Registry, cadastral principles and registration of rights in the Land Register. Cadastre of real estate

This diploma thesis deals with the land registry. The purpose of my thesis is to compare old and new legislation relates to Cadastre of Real Estate. The reason for my research is that the new legislation came up with signicifant changes. At the beggining of my thesis you can find introduction. Introduction presents aims of my thesis and also structure. The thesis is composed of seven chapters. Chapter one concentrates on history of land registry. This chapter is subdivided into five parts. In each part is described one of important historical periods related to real estate record. Chapter two examines relevant Czech legislation of cadastral law. It briefly describes effective laws and ordinances. Chapter three deals with fundamental information about Cadastre of Real Estate. This chapter consists of three parts. Part one focuses on basic terms and their definition. Part two describes objects, which are kept recorded. Part three containts information about content of land registry.
