1 Restrictions on personal freedom in theory and practice Abstract The subject of this rigorous thesis is the connection of the theoretical and practical concept of permissible interference with the personal freedom of an individual in criminal proceedings, with an emphasis on the protection of the fundamental rights and freedoms of the person concerned. The basis of the thesis is the description and more detailed definition of some specific institutes of criminal law, in the form of detention, arrest, detention and imprisonment, which seriously interfere with personal freedom and are directly connected with the imprisonment of persons. The rigorous thesis compares and analyzes the legal embedding of the above- mentioned criminal law instruments at the national and international level with their application in real life practice and points out some fundamental differences that occur when they are used by law enforcement authorities. Attention is primarily paid to the degree of compliance with the guarantees of permissible interference with personal freedom by public authorities, the legitimacy of individual interference and also their adequacy and proportionality in relation to the goal pursued by these means. The first part contains a translation analysis based on the model of Christiane Nord, which within intertextual factors includes also a typology of translation problems on several levels. The next part deals with problems that occurred during the process of translation and their solutions using the model of V. N. Komissarov. Institute of Pre-trial Detention in Criminal Proceedings

This bachelor thesis deals with the restriction of personal liberty of an accused person during the prosecution through the custody institute in the context of fundamental human rights and freedoms guaranteed by the rule of law including the international treaties to which the Czech Republic is bound. The thesis is divided into four chapters. The legal analysis of restriction of personal liberty through restraint or arrest that precedes the custody is followed by so-called material custodial law, specifically the custody institute focusing on the grounds for detention. The next chapter covers formal custodial law dealing with procedural aspects of the detention of an individual within the detention session, the detention order and the limits for accepting legal compensations for the detention by other measures. The last chapter deals with the detention in terms of rights and duties of an accused person in a detention including possible social-psychological aspects.

A Qualitative Study of Arrests as Perceived by Accused Juveniles

Juvenile crime and juvenile criminals are the focus of one key area of society. Criminal acts are commited by youth especially in big towns and cities and they are accompanied by increasing manifestations of aggression. The number of juvenile crimes commited under the influence of narcotics and psychotropic substances continues to rise. There was an important moment when a specific law, no. 218/2003 Sb. Which regards the responsibility of juveniles for unlawful acts and also the judicial system concerning youth, was enacted. Juveniles perceive imprisonment on a significantly worse scale than adults do. Therefore, it is quite possible to influence juveniles in a more positive way by means of a suitable penological and pedagogical approach. Placing juveniles under arrest, their eventual conviction and their eventual imprisonment and confinement is the last solution. This thesis focuses on the research of how juveniles perceive their arrest as they within the Czech prison system. The data was gained by means of the qualitative research method with the use of a half-standardized interview. These interviews took place with ten men, who spent time under arrest as juveniles or young adults (up to 26 years of age). The goal of the diploma thesis was to map the situation of the arrest solution problems due to juvenile criminal activities, to answer some research questions and to eventually offer an optimized solution. These goals have been reached. The findings of this thesis can be beneficial for everybody who deals with the problems of juvenile crime and juvenile criminals. The recorded interviews, which describe the cause, the progress and the results of crime and criminals, as well as the execution of the arrests are of particular importance.
