Court fees in the administrative justice system focused on problems in application

The purpose of my thesis is to analyze the current system of court fees in regards to administrative justice. The goal of this work is to find difficulties that occur within its application and to provide an easy well-arranged outlook on answers to these difficulties. The inspiration for the nature of this analysis is the fact that no such work has been focused on these issues and the application methods. My thesis itself is composed of six separate chapters with each chapter corresponding to an ideal or aspect of administrative justice. The first chapter is wholly introductory in nature, while the second chapter covers basic terminology associated with this process. While the third chapter deals with the historical elements and evolutionary process of the system of court fees in administrative justice. Composing the main body of my thesis or fourth chapter in this selection, is my analysis of the current legal system of court fees in administrative justice and the main difficulties associated within its application. Chapter five consists predominantly of my personal reflections and my notions as to how the system may be improved. v anglickém jazyce The aim of this thesis named Development aspects of the relationship between judicial system and administrative structure in Czechoslovakia (1918-1938) considering the development of the German administrative justice is to analyse the basic development aspects of the relationship between executive and judicial power in Czechoslovakia. The capstones of the thesis are particularly state administration of the courts, territorial scope and administrative justice. Moreover, a comparative part describing the administrative justice and the gradual elimination of the separation of powers in Germany in the thirties was added. The basement of the thesis consists in the institutional and material view-points, the organization of administrative justice as well as the material aspect. Obtained knowledge is compared with the current model of the administrative justice under the law of the Czech Republic. The main purpose of the thesis is to compare the above- mentioned models of administrative justice and to delimitate subsequently certain identical, similar and different elements.
The Case of Law in the Field of Value Added Tax and its Impact on Legislation

Harmonization of tax systems of the European Union member states has been going on since 1950s. This trend is followed to this day in order to achieve one of the primary objectives of the European Union, single domestic market. The harmonization of tax systems allows free movement of capital, goods, and services. Value added tax is harmonized through the EU Directives that have unified tax object, tax base and partly tax rates. The Court of Justice of the European Union also plays a vital role in the harmonization, because the European case law complements the interpretation of the directives and creates a comprehensive impact throughout the harmonization. This thesis analyses the judgments of the Court of Justice of the European Union, which have been implemented in the VAT Act, and examines at the same time impact of the implementation. The first implementation took place in the amendment of the VAT Act in 2006. The biggest changes occurred in the amendment of the VAT Act in 2012 and it was mainly in the realm of the conditions for exemption from VAT without deduction and the possibility of claiming a deduction. Finally, time frame of the implementation was also researched, judging from the outcomes of the research, one can say that the Czech Republic responds quite flexibly to the publication of the European case of law and the implementation takes place shortly following verdict of The Court of Justice of the European Union.
Czech administrative justice from the viewpoint of comparison with French and German system

Diploma thesis is devoted to the theme of Czech administrative justice, its current form and comparison with chosen models of European administrative justice, that is with French and German model. Goal of the thesis is on the basis of description and analysis of these models of administrative justice to get the comparison and evaluation of the differences and positive and negative elements of chosen models in relation to Czech system of administrative justice. The first part focuses on rather theoretical side and the introduction to this problem. Fundamental terms and characteristics are described and the concept of administrative justice is put to a broader scope. There is also mentioned the historical development of administrative justice in the Czech lands from year 1848 until the present day. The second part is devoted to the study of specific current legislation of chosen countries - Czech Republic, France and Germany. On this foundation is in the closing part accomplished the analysis and comparison of particular systems of administrative justice together with stating their mutual positives and negatives.

The bachelor thesis deals with remedies (ordinary, extraordinary and supervisory), especially in terms of Act no. 280/2009 Coll., The Tax Code, as amended. The aim of this thesis is to find, characterize, systematically describe and explain the remedies that are available to all persons involved in tax proceedings, including proceedings in administrative justice. Furthermore, relevant jurisprudence of the Supreme Administrative Court is described, which deals with appeals.
The comparison of the administrative justice system in the Czech Republic and selected European countries

This thesis analyses the administrative justice system, which represents one of the key control mechanisms of the public administration in The Czech Republic. The aim of this thesis is to compare the administrative justice system of The Czech Republic with selected European models of the administrative justice system such as the French and German justice systems. The result of this comparison highlights the differences in justice systems and considers the possibility of implementing these models in The Czech legal system.The administrative justice system in The Czech Republic has been developing since 2003, when The Act N. 150/2002 came into effect. The operating administrative justice system in The Czech Republic is characterized by the following criteria: statutory framework, power and jurisdiction of the administrative court, organization of the administrative justice system and the course of the judicial administrative proceedings. The following chapters discuss the French and German models of the administrative justice system and analyze the similarities with the Czech system.The final chapter compares the individual administrative justice systems and their most important differences.
