Package Tour (Section 2521 - 2549a of the Czech Civil Code) Abstract The diploma thesis focuses on the description of the legal regulation of the package tour contract in the Civil Code and other legal regulations related to the package tour. The aim of the thesis is to describe and to analyse the legal regulation of the package tour contract in the Civil Code and in Act No. 185/2020 Coll., regarding some of the measures to mitigate the effects of the coronavirus epidemic reffered to as SARS CoV-2 on the tourism industry, also known as the so called Lex Voucher. The package tour contract is a key institution in the tourism legislation and is largely influenced by european legislation. Therefore this thesis also describes and often refers to the legal regulation of two basic directives, on which the regulation of the package tour contract in the Civil Code is based on. The essential directives are called Council Directive No. 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours, and Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements, amending Regulation (EC) No 2006/2004 and Directive 2011/83/EU of the European Parliament and of the Council and repealing Council Directive 90/314/EEC. Termination of travel contract due to force majeure

The subject of the thesis is the termination of travel contract due to unavoidable and extraordinary circumstances. The term of unavoidable and extraordinary circumstance is not legally defined in the Czech Civil Code. Therefore, the thesis analyses this concept in the light of the case law of several European countries and compares the term substantively with the liberation ground under art. 2913 par. 2 of the Civil Code. In the following sections, the thesis discusses the meaning of unavoidable and extraordinary circumstances for the right of the contracting parties to withdraw from the travel contract free of charge, defining the various conditions under which the right can be exercised. The thesis also covers the meaning of unavoidable and extraordinary circumstances for the subsequent impossibility of performance.

Claim from the incrorect fulfilment of the tour conract

The diploma thesis is focused on the claim from the incorrect fulfilment of the tour contract, which represents a part of the legal regulations of a tour. Considering significant development of travelling, this topic is very actual and issues that arise during implementing the legislation in practice need to be answered. The goal of my thesis is answer questions which are actual and often appearing in practice, but it does not exist clear legal opinion or sufficient resources to answer to these questions. The main resources for the writing of my thesis was the current text of the Civil Code, the Tourism Act, the Consumer Protection Act and Directive 90/314 / EEC, which were compared with the new Directive 2015/2302 and the proposed regulations of the Civil Code. The diploma thesis consists of six chapters, including the introduction and the conclusion. The basic direction of the thesis is presented in the introduction same as questions. The main goal is answer to these questions. This bachelor thesis deals with the issue of insurance in tourism. The theoretical part of the thesis describes the historical development of insurance, the basic legislation of contract of package tour and insurance contract according to the new civil code, and discusses the issue of travel insurance. The practical part analyses the specific risks in travel insurance. On the bases of questionnaire survey, given to travel agency's clients, is to investigate client's awareness in case of origin of individual insurance events. The main goal of this thesis is to create a manual for the clients of a particular travel agency which help them how to proceed in case of individual insured events.

Židová, K., The impact of enactment of the new Civil Code on the activities of tour operators and their clients. The Bachelor thesis. Brno: Mendel University in Brno, 2014. This Bachelor thesis focuses on the comparison of current and previous enactment of the Civil Code, concretely, tour contract and valuation of the impact on tour operators and their clients. The first part of the thesis contains the definition of tourism and legislation dealing with this business area and in particular changes in the Civil Code. In the second part, the practical part, deals the work with examining and observing the impact of the new Civil Code on tour operators and their clients. Specific examples are analyzed and possible consequences of selected changes to the new Civil Code, which result mainly in the threat of clients' unjustified claims for indemnification of disrupted vacation, are described. The conclusion contains recommendations for tour operators and their customers which are created in the interest of prevention from problems.
