Optimization of the procedure for the transfer of ownership of agricultural land

The Master´s thesis is focused on optimizing the procedure for the transfer of ownership of agricultural land, which will also form the aim of this work. The theoretical part consists of information on the acquisition of property rights to agricultural land. They also described the basic concepts related to the issue. The practical part is formed at the beginning of the analysis of the situation on the market of agricultural land type arable land species in the selected area. It is followed by the creation of objective work, which is creating the optimal procedure for the transfer of ownership of agricultural land. Conclusion the Master´s thesis contains a description of differences in the transfer of ownership of practice and also a summary of the law legislation in the Czech and Slovak Republics
Transfer of ownership rights in book-entry securities

In my thesis, I attempt to settle several legal issues pertaining to the matter of transfer of ownership title to book-entry securities. In our law, many legal instruments are only provided for in relation to certificated securities. The Civil Code then extends the scope of application of provisions on certificated securities to book-entry securities, except for where the nature of the latter or a different statutory provision prohibits it. Hence, the key question of my thesis is whether book-entry securities must be observed in a manner that respects their particular nature, and if so, how do said particularities influence the transfer of ownership title to the same. The core text of the thesis is contained within Part 2., designated Nature of Book-Entry Securities, and Part 3., designated Transfer of Book-Entry Securities. Part 2. is devoted to the nature and particularities of book-entry securities that often lie between private and public law and which influence means of their transfers. 1 Abstract Transfers of land ownership This thesis provides a clear and comprehensive explanation on the transfer of land ownership and institutions associated with this issue. Land from other things in the legal sense is so different that it raises the need to create specific legal regulations, which contain the basic institutions and principles of land law. The special nature of the land is determined by its specific characteristics that distinguish it from all other things. Although it has a long tradition of land ownership, it has still not developed it's uniform and comprehensive legislation. General law for the transfer of land ownership is a civil code. Special regulations are cadastral law and the law on registration of ownership and other rights in real estate, the law on transfers of agricultural and forest land, Land Act and others. Due to the adoption of a new civil code, there are some places to identify and compare to the current legal system, and possible adjustment for the future. The thesis is divided into four parts. The first part contains general characteristics of land ownership, and describes its object, subject, content, institutions and basic concepts that are associated. The right of ownership of a unit and the possibilities of its transfer after recodification This thesis deals with the right of ownership of a unit by the act No. 89/2012 Coll. (the civil code) with emphasis on the possibilities of its transfer. I chose the topic because of great practical importance of the issue and many changes brought by recodification of the civil law. This thesis is based on comparative method - the previous legislation by the act No. 40/1964 Coll. (the civil code) and by the act No. 72/1994 Coll. (about ownership of flats) is compared with current legislation. The main aim of the thesis is to clearly describe the most significant changes in the rules of ownership of a unit and its transfer and to point out the benefit of the new regulation as well as its weaknesses and eventual practical problems. This thesis is composed of eight separate chapters, each of them includes several subsections. First chapter contains an introduction to the issue of the ownership of flats and a brief description of the historical development of ownership of flats in the Czech Republic. The thesis deals with the terms of transfer of the ownership right to land. It is comprised of three main chapters. The first chapter defines the various basic terms relevant to this thesis with emphasis on the specific attributes of the soil. The second chapter is devoted to the first phase of the two-phase process of transfer of the ownership right to land, i.e. the acquisition title. The third chapter describes the second phase of the above mentioned process which is the registration of the ownership right into the Cadastre of Immovables.
