Specific aspects of using trusts in business relations

The main aim of this thesis is at examining and describing the legal conditions and limits of the use of trusts in commercial relations, primarily the advantages that trusts can offer to commercial relations and the possible difficulties of their legal regulation. The thesis is based on the fact that the current legislation does not contain special provisions regulating the specifics related to the existence and activities of a commercial trust. It is the absence of explicit regulation and relevant case law, as well as the lack of Czech legal literature focused on commercial trusts, that lead the author of this thesis to use foreign literature, not only to describe and answer some of the uncertainties associated with the current legal regulation of trusts, which are most evident in their involvement in commercial relations. The first part of the thesis contains a brief description of the history of the institute of trust, which originally developed as an institute for the preservation and maintenance of family property and as a more flexible alternative to the inheritance law. The Specifics of Use of Trusts in Business Relations This thesis deals with possibilities brought by trusts (in Czech: svěřenský fond) to business relations. It analyses the key features of a trust, thanks to which it has a unique and often irreplaceable position in number of financial transactions. Selected financial transaction are described in detail and the importance of trusts in these transactions is explained. The main objective of this thesis is to show that trusts have benefits far beyond the governance of personal property and its intergenerational transfers. By this I want to prompt interest in further research of the use of trusts in business relations in the Czech legal environment. After the introduction, the first chapter of this thesis briefly introduces the history of the trust. It is outlined which role the trust played in different legal systems and what were the motives for its development. The second part describes trust as an institute of civil law. There is also described the implementation of the trust into the legal system of the Canadian province Québec, because this regulation served as a model for the Czech lawmakers. Principle of good faith and of good faith and fair dealing in commercial relations

This dissertation focuses on the principle of good faith and on the principle of good faith and fair dealing. The differences between the two mentioned principles and the problems with terminology are covered. The author suggests and reasons for her own terminological solution. Furthermore, the dissertation discusses on the general delimitation of the two principles, their content and relation to other related principles. Moreover, it focuses on the legal frame of good faith and good faith and fair dealing principles including historical and comparative aspects of the issue. The author of the dissertation describes the practical impact of the two principles in question and compares the recent and current legal regulation. She analyses the practical impact of the principles of good faith and good faith and fair dealing in commercial relations: not only in the business contractual law but also in the life of a business corporation. Furthermore, the relevant judicature is covered including the delimitation of its possible applicability on the current legal regulation.
Italian - Czech relations on the example of exportanion of Italian gastronomy to the Czech republic

The thesis deals with relations between Italy and the Czech republic on the example of exportanion of Italian gastronomy to the Czech republic. The theoretical part tries to describe the principal aspects of Italian gastronomy in general terms and the relations between Italy and the Czech republic. It's concentrated on all the relations that have something in commom with gastronomy. The analytical part is based on questionnaires and quite a detailed analysis of Italian gastronomy in the Czech republic. The principal goal of the thesis is to find out whether the Italian gastronomy in the Czech republic is really Italian. Another aim is to reveal to which extent the eating habits of Czech people visiting Italian restaurants are influenced by Italian ones.
A comparison of the economy and commercial relations of Ancient Greece with the European union

The subject of this paper is a comparison of the economy and commercial relations of Ancient Greece with the European union. It is an analysis of the two economies and their way of establishing the business relations. The work explores the ancient civilization between 499 BC and 31 BC and the European Union, particularly in the years 1993 to 2012. The aim is to illustrate similar economic development of Ancient Greece, as the European nations have undergone hundreds of years later and to compare the maturity of Ancient Greece with the current state of the European Union.
