Easements in telecommunications

Resume in English. Easement in Telecommunication This thesis deals with the easements in the specifically chosen and therefore dedicated area - in Telecommunication field. The easement has its primary regulation in the Civil Code No. 64/1964 Sb., however the easements are regulated also within the public law area, namely the public law codes e.g. Water Act, Railway Act etc. In its very basic effect they represent the limitation of the property owner. We divide them into two groups easements ad personam and ad rem. The easement in the telecommunication belongs into the public law. They are currently regulated by the Telecommunication Act No. 127/2005 which has it's specific procedure of establishing these easements. Before this Act there were two previous Acts - the Act. No. 110/1964 Sb. which was replaced by Act No. 151/2000 Sb. The Act No. 151/2000 Sb was replaced by above mentioned valid act. Each of the Acts maintained the area of easement in different way. When we take into consideration the first and the oldest Act No. 110/1964 Sb. the easements were considered like public limitation of owner rights until the year 1992, when was the Act updated and specifically renamed the public limitation of the owner rights into the easements. Measure of a general nature

55 Summary of thesis - Measures of a general scope This thesis deals with the brand new tool in Czech administrative law, "opatření obecné povahy". Although the term is not used in English, it can be translated as "measures of a general scope". It was incorporated into Czech law in 2005, after hasty and not very well prepared procedure. It was electronic communication act, that brought this institute into the life in 2005. This has been subject of criticism until these days. The main reason is that it overtook general legislation incorporated in the Code of administrative procedure. In other foreign countries, the most often use for this institute is in traffic signs. It is simple and very well understandable thing, which helps authorities to know and learn how to use measures of a general scope. In our country, the first act that used it, was the one dealing with one of the most complex systems - telecommunications. As it is described in this thesis, it wasn't understood by authorities at all. Courts are dealing with cases in which measures of a general scope are used as acts or decisions, not as hybrids as which they were developed (in one case, it was even used as instruction for towing a car parking in the wrong spot). Expropriation of buildings and land

Resume This work deal with Expropriation of buildings and land in Czech Republic. Main part of this work is dealing with the new Expropriation Act, which became effective from 1 January 2007, but not only, because this act is one of several act, where expropriation is regulated. More important regulation is included inthe Czech Bill of Fundamental Rights and Freedoms, where is determined constitutional principles of Expropriation and limitation of property rights. These conditions are: "in public interest under the rule of law and with compensation." These constitutional principles are specificated in the Czech Civil Code and expropriation act. Very important for Czech regulation are international documents for example the European Convention for the Protection of Human Rights and Fundamental Freedoms from 1950. Specially the First Protocol to the European Convention, signed in Paris in 1952, includes the right to the peaceful enjoyment of possesion in the Article 1. Third chapter is dealing with definition of expropriation: "taking out property by public authority." Studium, psaní, přemýšlení i nezbytné konzultace, to vše, co mě provázelo při psaní této práce, považuji za nemalý přínos pro svůj další nejen profesní život. Práce s institutem vyvlastnění mi umožnila jak exkurz do části práva stavebního, tak do práva správního. Poznal jsem, s jakou citlivostí je třeba zacházet při porovnávání jednotlivých ustanovení speciálních a subsidiárních ustanovení jednotlivých zákonů a jaká úskalí skýtají nedokonale novelizované předpisy. Velkým překvapením pro mě byla rozmanitost vyvlastňovacích titulů a různorodost jejich zákonných úprav. V oblasti náhrady za vyvlastnění jsem se nepouštěl do výraznějších exkurzů, toto téma samotné by při důkladnějším rozboru vydalo jistě na více stran, než je třeba na diplomovou práci. K jeho lepšímu uchopení je však třeba znát onu pestrost praxe. Pasáž o vyvlastňovacím řízení pro mě byla názornou ukázkou střetu speciálního zákona se správním řádem. Poslední kapitolu jsem věnoval speciálním vyvlastňovacím zákonům, jakožto snaze řešit velké stavební projekty jednorázovými zákony, které nastaví speciální pravidla, která mají takříkajíc zatočit s nepohodlnými vlastníky. Administrative delicts relating to the construction and occupancy of buildings

This thesis deals with administrative offences relating to carrying out a construction and to occupancy of a construction. The main reason I have chosen this subject-matter consists in the fact that building and construction law has been, is and certainly is going to be one of the legal domains of major importance in the life of a society. What has, furthermore, motivated me to deal with this subject was the coming into force of the new Construction Act which brings, in many aspects, substantial changes to the current regulation. The subject-matter of my thesis led me, through analysis of different facts of administrative offences under the Construction Act, to a better understanding of all the key institutes of the construction law. The whole work is divided into eight chapters. The first and the second chapter introduce the subject of administrative offence and make for understanding of this institute in a wider context. The first chapter deals with penalty in administrative law which is understood as the decision process of administrative agencies on culpability and liability for illegal conduct.
