The Concept and Development of Strict Liability in Czech Tort Law and its Inspirational Sources Abstract The thesis deals with an analysis of strict liability in Czech tort law taking into account the inspirational sources of its regulation, including in particular German and Austrian law, the Principles of European Tort Law (PETL) and the Draft of Common Frame of Reference (DCFR). Further, a historical and possible future development of strict liability is analysed as well as the risks for which strict liability is imposed. The thesis is divided into two main parts. The subject-matter of the first General Part is especially the concept of the strict liability and the reasons for its application. Further, some related problems are analysed in this part which are relevant for the legal theory as well for the legal practice (e.g. defences, contributory negligence, possibility of the concurrence of claims). The subsequent Special Part contains an analysis of the types of strict liability and consists of four main chapters. The first chapter deals with a short overview of the historical development of the strict liability in Czech tort law. 102 Summary Liability based on Fault and the Concept of Fault in Czech and German Law of Torts The aim of the thesis is an introduction and comparison of the Czech and German law of torts - a branch of law which determines liability for damage caused by breach of a duty imposed by law - in the area of liability based on fault and an introduction and comparison of the concept of fault as one of the conditions for the application of this liability. That the subject is tort law of these two particular countries is not an act of arbitrariness, but it relates to the fact that the new Civil Code of 2012 is significantly inspired by the German system of tort law in the field of liability based on fault. This thesis attempts to provide not only comparison of the Civil Code No. 40/1964 Sb. with the new Civil Code of 2012, but also comparison with the German Civil Code - BGB. The thesis consists of four parts - "The Concept of Law of Torts", "General Conditions of Liability in the basic tort Provisions", "The Concept of fault and its forms" and "Liability based on fault". Voluntary sterilization of women in Europe: Study 5.314

Práce se zabývá komparací právních úprav vybraných evropských států týkajících se možností provedení lékařského zákroku sterilizace na žádost pacientky jako formy antikoncepční metody. Zhruba od 70. let dochází k postupnému přijímání zákonů, které umožňují podstoupit sterilizaci na základě dobrovolné a svobodné vůle pacientky. Komparace srovnává zejména podmínky, na jejichž splnění právní úpravy vážou možnost provedení tohoto zákroku. Právní úprava v České republice v porovnání s úpravami ostatních zpracovaných zemí zakotvuje poměrně přísné požadavky a omezení, za nichž může být sterilizační zákrok proveden, zatímco jiné, zejména severské země, volí výrazně liberálnější přístup a ponechávají toto rozhodnutí na pacientce samotné. Společným znakem většiny úprav je pak zvýšená ochrana mladistvých či právně nezpůsobilých pacientek při podávání žádostí o provedení sterilizačního zákroku.
