Representatives and the represented: trust vs. alienation
Přibyl, Daniel ; Kysela, Jan (advisor) ; Urban, Michal (referee)
These days are western democracies in serious crisis. We could observe this crisis in disconnection societal topics, not only, but especially political, from the citizens, who are affected with these topics the most. The citizens are becoming apathetic; they have no interest file their energy beyond their own private and professional life. This situation could develop in two directions. The first way means conservation of current state, status quo, and it leads to not so happy future. Or another way change of course happens and the interest in public life will be activating in the citizens. And I believe in the second possibility. However, there is lot to do, to revise many aspects of public life, e.g. political parties, funding to these parties, institute of representation and how community perceive it, or elections, the way legitimation.
How the Constitution of the CR was formed: political contexts, persons, influences.
Fuksová, Veronika ; Kysela, Jan (advisor) ; Pithart, Petr (referee)
This thesis deals with topic of creation of the Constitution of the Czech Republic. The main aim of the thesis was to map all relevant circumstances that led to approval of the final form of the document in December 1992. The thesis is divided into chapters that deal successively with historical circumstances, sources of inspiration, various actors involved in the creation of the Constitution of the Czech Republic, the sequence of negotiations and finally with critical issues that provoked widespread debate. The question was how the Constitution was influenced by previous proposals and other sources. The finding that these effects were substantial and that actors of creation of the Constitution explicitly invoked them is partial result of the work. Another question was how the text of the Constitution itself was affected by specific political influences. Based on an analysis of various historical documents, it appears that an attempt to influence the constitution-making process by the government coalition was strong, however, in the result there were compromises in the framework of fundamental issues accepted because there was need to adopt the Constitution in the Czech National Council in December 1992, which was eventually successful.
Right to challenge
Černý, Tomáš ; Kysela, Jan (advisor) ; Urban, Michal (referee)
This thesis aims to give a reflection on the doctrine of the right of resistance in the Czech Republic, its liberal democratic system and legal order. The first part of the thesis presents a short description of the background and the development of the doctrine. It also deals with Article 23 of the Charter of Fundamental Rights and Basic Freedoms as an attempt of embedment the right of resistance in the Czech law. The subject matter of the second part are the transformation processes taking place in the current world that have an impact and threaten liberal democracies including the Czech Republic. This part also gives examples of the application of right of resistance. The first chapter contains a short historical and a modern definition of the right of resistance. It also defines the following related notions - the revolution, the coup d'état and civil disobedience, that this thesis applies. The second chapter focuses on the history of the right of resistance. It goes back to its roots in Ancient Israel, looks upon the Enlightment authors dealing with the theory of Social contract and concludes with the post-war development. Special focus is turned to the disputed aspects of the right of resistance. The third section deals with possible interpretations of Article 23 of the Charter of Fundamental...
Direct presidential election in Czech Republic
Ryčlová, Dorota ; Kysela, Jan (advisor) ; Ondřejková, Jana (referee)
- Direct presidential election in the Czech Republic: reasons, conditions, consequences This diploma thesis is concerned with different aspects of implementation of the direct presidential election in the Czech Republic. It is aimed to discover the actual reasons for passing the Constitutional Act No. 71/2012 Coll., which introduces this institute into the Czech constitutional system. For the purpose of doing so, the thesis is divided into three parts. The first one presents and evaluates particular arguments (historical, political, constitutional, legal etc.), which were used by the proponents of this institute on one hand and by its opponents on the other. The content of the second part is the most extensive as it follows up the comparison of bills attempting to implement the direct presidential election into the Constitutional Act since 2001 up to the present. Therefore this part contains thirteen bills in total, including the one, which later becomes the Act No. 71/2012 Coll. Individual bills are compared and contrasted. The pertinent political and social circumstances accompanying their origin are also briefly mentioned. As the result of this comparison the author comes to the conclusion that the true motive to pass the Constitutional Act No. 71/2012 Coll does not lie in its content or its...

Presidential systems
Niklová, Dominika ; Kysela, Jan (advisor) ; Pithart, Petr (referee)
The topic of my study is presidential system. I have chosen this topic because I am interested in situation of Latin America countries. These countries have decided to follow establishment of The United States. Many authors affirm that presidentialism is occasion of instability in these countries. The thesis is composed of ten chapters, which are divided into subsection or other parts. At the beginning I introduce political systems in our society. And I chose one of them, presidential system, to analyze in details. Chapter Two is about history of creation Constitution of The United States. This part of history is important because this Constitution is model for countries, which have decided for presidentialism. In this stage I explain the term presidential system and its particular signs. Without knowledge about it we don't understand how this system function. And we can't confront it with other political systems. Chapter Three describes presidentialism and its different forms. In my work I describe presidentialism in Latin America and in The United States. In Europe, there are many countries, which after year 1991 have decided for presidentionalism. But there always are relics of communism. There absent elements of democracy. In some of this countries govern strong presidents and we mark them like...
The sovereignty of Parliament: its substance, development and consequences for the judicial review of rule-making
Píša, Radek ; Kysela, Jan (advisor) ; Pithart, Petr (referee)
My thesis deals with the legal concept of sovereign Parliament, the very keystone of British constitution according to A. V. Dicey. This model has been challenged both normatively and descriptively. Concerning the normative point of view, concept of unlimited sovereignty is incoherent. Descriptively, courts don't simply take the parliamentary supremacy for granted, even if they say so. Relationship between the Parliament and courts is certainly more complex than Dicey suggested. Goals of this thesis are rather tentative. Since the popularity of this topic among British constitutional lawyers, comprehensive analysis is implausible due to the limited space. This paper aims to gather fundamental theories and disputes regarding the parliamentary sovereignty and its relationship with courts. In other words, it explores connection between the Parliament and courts in contemporary British constitution. First chapter analyses the constitutional conventions, which forms the basics of several other fundamental concepts in UK constitution. It suggests that there are no clear boundaries between law and conventions. Second chapter focuses on the general concept of sovereignty and Diceyan classic theory of Parliamentary sovereignty. There is also a brief explanation of sovereignty's connection to Scot's law....
Finding of the Archetypes of the Political System in the Law and Political Philosophy
Chválek, Jan ; Kysela, Jan (advisor) ; Maršálek, Pavel (referee)
Jan Chválek - Rigorous Thesis Abstract (English) The main objectives of this work are summarised on a separate sheet, which I have named the Fundamental Theses. I intentionally bring forward additional issues for discussion, which, I hope, will be received positively. In fact, it is an area that I would like to focus on personally in the future. The thesis is interwoven with the effort to interconnect issues with law and philosophy that, in my opinion to our common detriment, are not put into context. These namely include technological development, art, or, in a wider sense, the cultural aspects of the society. The thesis seeks to identify the archetypal idea of a political system, purged of any value load after the fashion of how the methodology of the genuine doctrine of law purged the idea of law itself. This methodology will be presented in greater detail so that it may be shown as a certain analogy to what I would like to achieve. At the same time, however, the purpose and the final goal of my intent differ. I believe that these differences will be clarified in the following text. I am aware of the complexity of this project; nonetheless, I am also convinced that it is due to the complexity of the subject of the intent itself, which is largely universal. The thesis follows a pre-determined scheme by...
The origins of Bohemian Oppida: The Role of the Mediterranean and the Urbanisation processes in the European Iron Age
Kysela, Jan ; Salač, Vladimír (advisor) ; Bouzek, Jan (referee) ; Vitali, Daniele (referee)
The presented study analyses on the example of Bohemia the question in what extent the creation of oppida (and more broadly the cultural transformation of the Transalpine world in the recent La Tène period) were influenced by Mediterranean impulses and to what extent they may be on the other hand considered as a local phenomenon. The historical and chronological background are studied in detail, the question itself is approached by an analysis of the corpus of Mediterranean imports in central Europe intended to evaluate the role of Bohemia (within the central European context) in the contacts with the Mediterranean. In the concluding chapter the oppida and their settlement systems are confronted with the Mediterranean towns. The contacts with the Mediterranean turn out to have been constant and significant for the Transalpine word, the oppida, however, seem to be a largely local phenomenon. Šurda Malcová, Karolína ; Lebeda, Tomáš (advisor) ; Kysela, Jan (referee) ; Reschová, Jana (referee)
The objective of the Ph.D. thesis "Analysis of the Elections and Electoral Behaviour to the Senate of the Parliament of the Czech Republic" is an analysis of Senate elections on a micro- level of districts in regular terms from 1996 to 2012, including by-elections. Data file comprises a total of 2153 candidates and their election results at the municipal level aggregated to five defined categories by number of registered voters. Analysis is mainly focused on the differences in electoral support for candidates in municipalities up to 999 voters, in municipalities between 1000 and 4999 voters, in municipalities between 5000 to 9999 voters, in municipalities over 10 000 voters and finally in districts covering territory of the four largest cities in the Czech Republic (the Capital City of Prague and cities Brno, Ostrava and Pilsen). In the theoretical part, the Ph.D. thesis presents the Senat as the second house of Parliament of the Czech Republic and deals with the majority run-off system. A quantitative research of Senate elections is performed in the analytical part, where electoral success of candidates conditioned by their political parties, socio-economic and political circumstances in districts and individual profile of candidates is examined. The analysis describes differences among...
