Private International Law and the Issues of Securities Law

Private International Law and the Issues of Securities Law Tomáš Borčin Acts No. 139/2011 Coll. and No. 172/2012 Coll. have introduced a set of brand new choice-of-law rules in respect to securities into the Czech legal system. The same set of rules has rather simultaneously been adopted by the new Act No. 91/2012 Coll., on Private International Law, coming into force on 1st of January 2014. However, despite the fact that these amendments had brought the much needed conflict of laws rules for cross border transactions involving securities, the actual subject of how the securities are treated in private international law remains mostly unexplored by Czech jurisprudence as of this date. Therefore, the core ambition of this thesis is to provide a complex legal analysis of the aforementioned rules by the means of examination of their theoretical basis as well as of practical implications of their application. The thesis consists of seven chapters of various extent and scope. The ratio behind the first chapter is to address the question of what securities are, and how are they treated pursuant to Czech legislation. Private-Law Aspects of Czech Alien Law This thesis is dedicated to Czech alien law regulations in the context of their private law aspects. Alien law is a set of legal norms concerning the legal status of foreign citizens in a territory of a certain state. In general, it is understood as different treatment of aliens than the citizens of that state, a possibility of such treatment, or providing certain advantages to the foreigners. The foundation of this work is a detailed analysis of the material status of foreigners in the scope of their individual and property rights, including a foreigner as a party to a civil suit. Main focus of the thesis is on the description of individual institution and law principles regarding international private and procedural law, taking into account a future regulation from a new norm in international private law. In particular, emphasis is put on an analysis of equal treatment of foreigners, possibilities of refusal of such treatment, principles of reciprocity in the formal and material sense, conditions of the foreigner's claim to be relieved from judicial fees, eligibility of the foreigner as a party to a suit, etc. Special focus has been given to the matters closely related to alien law, such as the definition of an alien, dual citizenship, habitual residence etc....
Liability of the carrier in international carriage of goods

It is expected that the massive expansion of carriage of goods that went on in past couple of decades will soon resume after the worldwide recession. Due to its flexibility, speed, ability to deliver "door to door", low price and other positive qualities the most popular type of carriage is carriage of goods by road, which is also the type of carriage of goods that this thesis is mainly focused on. The goal of the thesis is to describe and explain legal aspects of international carriage of goods by road with a special focus on the liability of the carrier. The most important legal regulation that governs the area of international carriage of goods by road is the Convention on the Contract for the International Carriage of Goods by Road (hereinafter the CMR Convention) that has been signed on May 19, 1956. It is an exceptional piece of legislation, which is in effect for more then fifty years with only two minor changes since its adoption.

Above mentioned topic is explained from general point of view but the thesis especially aims on acquisition of real property by foreigners and its theoretical aspects from the international private law point of view also. Applicable law in international arbitration

The aim of this thesis (The Applicable Law in International Arbitration) is a general and comprehensive introduction of applicable laws in international arbitration. At first the characteristics of arbitration and its differentiation from litigation and other alternative dispute resolution are introduced as well as theories of arbitration as such. In its second and main part this thesis presents various legal systems, which may acquire the status of the law applicable to a particular phase or aspect of international arbitration. Firstly, the effect of lex arbitri on arbitration is discussed. Furthermore, this thesis discusses the effect of lex loci executionis on the recognition and enforcement of an arbitral award. The thesis also focuses on lex causae and both alternatives of its choice, i.e. to the parties choice of lex cause and to the absence of its choice. Arbitration agreement, particularly in relation to its separability from the underlying contract, as well as its relation to the arbitrability is explored in following part of this thesis. Last but not least this thesis takes into consideration the possibility of application of non-state normative systems in international arbitration.
The relationship between rest and the maximum spirometric indicators in the triathlon

Title: The relationship between rest and the maximum spirometric indicators in the triathlon Made by: Bc. Zdeněk Kučera Supervisor: Mgr. Lenka Kovářová, Ph.D., MBA Objectives: The aim of thesis is to analyze the relationship between rest and the maximum spirometric indicators for triathletes, who are members of the SCM. It will be also determined whether the analyzed indicators show statistically significantly better performance of triathletes in the representation compared to other triathletes in the SCM. Methods: Data were collected on basis of standard test, which was attended by triathletes in term of SCM. Data were statistically analyzed based on correlation analysis and unpaired non-parametric test. Statistical significance was assessed at the level of 0.05 or 0.01. Results: In the group of men can be confirmed that between rest and maximum indicators is statistically significant correlation relationship (except for respiratory rate and the economy). Another output is achieved for women, a statistically significant relationship exists mainly between rest spirometric indicators and tidal volume and respiratory rate. Place of Pilgrimage as a Part of Identity of the Region: an Example of Stará Boleslav

The thesis deals with the role and significance of pilgrimage Stará Boleslav in shaping territorial identity. Even in today's secularized society pilgrimage sites still attract people's attention. The importance and status of pilgrimage are discussed both at the regional level and at the local level, attention is paid to its importance to the community or other organizations. Further, a pilgrimage site in terms of its use of religious and secular activities. It was found that the pilgrimage site Stará Boleslav is not a significant factor in shaping regional identity but in shaping local identity and perhaps even national identity. Region as an institution ie in terms of the region it unlike community perceive as important. For believers, it is a place of pilgrimage Stará Boleslav very important but even people without religion is a place of pilgrimage well perceived although they view it primarily from a historical perspective. Utilization of measurer for external performance in preparation period of cyclists and triathlonists in Czech republic

SUMMARY: Title: Usage of measurer of external performance in trainings of cyclists and triathlonists in Czech republic Made by: Zdeněk Kučera Supervisor: PaedDr. Josef Horčic, Ph.D. Objectives: The main goal of this bachelor thesis is to find out, what is the usage of measurer of external performance for training management. The usage of wattmeter will be analysed among cyclists and triathlonists in Czech Republic. Methods: In my research, which was realized for the purpose of reaching the goal of thesis, was used the survey. The obtained information were sorted and interpreted by graphs. Results: It was found out, that performance measuring according to watts is supported and wattmeter plays an important role among other ways of measuring performance. It is necessary, that using of this tool has to be based on experiences, knowledge and individual access of cyclist. In despite of popularity of wattmeter the other ways of performance measuring are still inconsiderable, especially heart rate is not replaceable. VIEWS OF THE GENERAL PUBLIC ON THE ISSUE OF TAKING CARE OF THEIR HEALTH

Subject of my thesis titled : ,,Views of the general public on the issue of taking care of their health" is assessment of opinions, attitudes, and value preferences of the general public for their own health. It is mainly focused on their relation to healthy lifestyle and access to preventive care, which is an integral part of health care. The theoretical part of presented work is oriented towards basic terms related to health as a central topic. After the initial definition of the basic concept of work and its brief historical development, the work focuses on the fundamental determinants of health. Furthermore, this part of the work deals with health care system in Czech Republic, and it focuses on public health insurance system as well. The final chapter describes the importance of preventive care, it acquaints readers with the schedule of preventive check-ups and both preventive and screening programs in health promotion. The empirical part of the presented work evaluates the level of care of general public for their health. It monitors the opinions of the general public on health issues through my own research that was conducted through a questionnaire survey and it evaluates whether the general public accepted responsibility for their health.
