85 ZÁVĚR Otázka nebezpečných odpadů patří mezi největší globální problémy současnosti a to i přes skutečnost, že produkce nebezpečných odpadů představuje přibližně jen 15 % z celkové produkce odpadů. Nicméně hrozba, kterou tyto odpady, vzhledem ke svým fyzikálním, chemickým nebo biologickým vlastnostem, představují pro životní prostředí a lidské zdraví, je natolik značná a závažná, že bylo nutné podrobit danou problematiku právní regulaci. Na mezinárodním poli je pozornost věnována především úpravě přepravy nebezpečných odpadů. Nejvýznamnějším dokumentem je zejména Basilejská úmluva o kontrole pohybu nebezpečných odpadů přes hranice států a jejich zneškodňování. Na komunitární úrovni se jedná o právní úpravu podstatně kvalitnější a rozsáhlejší, která navíc prochází poměrně dynamickým vývojem, což ale na druhou stranu přináší určité úskalí v podobě nesnadné orientace ve značném množství právních norem. Komunitární předpisy odpadového hospodářství jsou do českého právního řádu transponovány zejména zákonem č. 185/2001 Sb., o odpadech, v platném znění, a řadou prováděcích předpisů. Municipalities and the Protection of the Environment The main aim of this Master's Degree thesis is to analyze mutual relations between two important branches of Czech law, the environmental law and the legal regulation of municipalities, which is the key part of a system of public administration in the Czech Republic and also a reliable measure of citizen participation in politics and the functioning of the state. There are two reasons why I have decided to choose this topic. The first one is that it is very close to me personally because of the region I come from, White Carpathians Protected Landscape Area where small municipalities play an important role in administering daily matters of public interest. The second reason is that I consider the subject very challenging due to the lack of existing sources and works, which are devoted to it. The diversity in environmental compartments and subsequent extent of the topic resulted in the necessity choose one group of closely related legislation. RESUMÉ 96 Legal regulations of fishery Thesis RESUMÉ We have an extensive fishing law and directive in the Czech Republic and practically everything is prescribed including size limits, bag limits, periods of protection for individual species, number of rods, hooks, flies used, simply everything. There is lots of legal regulations associated with fishery. In the Czech Republic, all the rivers are state. If you like to manage a fishery, you will have to win in the intimately defined selection. Fishing-office lays down species and numbers of fish, which you have to regulary stock (they negotiate it with you). You can get the authorisation for management of the fishery for 10 years. But in fact, nowadays all riverine fisheries are under the management of the Czech Fishing Union and there is no chance for another applicat because the Czech Fishing Union holds older authorisation which has no limited validity. Fishing-office can take away the authorisation if you don't keep the rules. If you want fishing, you must have a fishing licence. You have to prove some knowledge. Czech people have to go to a course, foreign people have to show a licence from their country. State fishing card (fishing licence) in the Czech Republic is sold in the state offices only in bigger cities, which are opened three times a week. So...

62 Sedmá kapitola: Závěr Základním cílem předkládané diplomové práce je popis a rozbor platné právní úpravy rostlinolékařské péče v České republice a v komunitárním právu. Rostlinolékařská péče zahrnuje v současnosti tři základní oblasti, které jsou upraveny právem. Jedná se o opatření proti šíření a zavlékání škodlivých organismů, oblast přípravků na ochranu rostlin a oblast mechanizačních prostředků. Cílem současné rostlinolékařské péče je péče o zdraví rostlin. Tento pojem sám o sobě implikuje nejenom opatření proti šíření a zavlékání škodlivých organismů, nýbrž - a fakticky převážně - prevenci. Historický exkurz vývoje právní úpravy rostlinolékařské péče ukázal na příkladech, že se nejstarší právní úprava rostlinolékařské péče v českém i komunitárním právu týkala pouze izolovaných škodlivých organismů a boje proti nim. V československém a později českém právním řádu byla rostlinolékařská péče až do roku 1996 součástí zákonů o rostlinné výrobě. Až etapa samostatných zákonů o rostlinolékařské péči se stala výrazem změny pojetí rostlinolékařské péče jako snahy o uchování zdraví rostlin. Genetically modified organisms and the legal regulation of their disposal

This thesis aims to give a complex insight into the framework and problem questions arising in connection with legal regulation of genetically modified organisms (hereinafter referred as "GMOs"). As the use of GMOs is spreading it brings along many discussions regarding their positive and potential negative impacts on human health and the environment. After the introduction into the GMOs from the practical and technical point of view, the analysis of the underlying principle, the precautionary principle, follows. Different approaches to the risks connected with GMOs formed different views on construction and application of the precautionary principle and caused its uncertainty as to its position in international law. Significant part of the international law relating to the GMOs consists of soft law documents. The willingness of states to be bound by binding rules in this area is still lacking. The only exception is the Cartagena Protocol on Biosafety focusing on the transboundary movement of GMOs. The Law of European Communities comprises of Regulations, Directives, and Recommendations. Protection of cetaceans in international law

In four chapters that this thesis consists of is presented the protection provided to cetaceans by international law. The first chapter gives insight into the biology of cetaceans, names facts relevant to their conservation and its legal basis. The second chapter deals with legal regulation of whaling. It analyzes the history and current situation in the International Whaling Commission as the only global organization to manage the exploitation of large cetaceans, particularly in terms of adopting protective measures for the recovery and conservation of whale stocks. The third chapter focuses on the species approach in protection of cetaceans as endangered animals. The fourth chapter addresses the protection of cetaceans' environment. First it deals with the protection of marine environment in general and then with the protection of cetacean habitats.
