Legal regulation of international trade in endangered species
Vítková, Eliška ; Stejskal, Vojtěch (advisor) ; Fabšíková, Tereza (referee)
Legal regulation of international trade in endangered species Abstract International trade in wildlife products has been ongoing for centuries. However, in recent decades, due to globalisation and technological progress, it has become so extensive that it now poses one of the most significant threats to biodiversity. Illegal international trade is closely linked to various other types of criminal activities and is comparable in scale to drug trafficking or arms trafficking. Consequently, effective and robust legal regulation is absolutely crucial. The objective of this paper is to provide a comprehensive overview of the existing legal framework and analyse its practical effectiveness. As international trade in endangered species is a global issue, regulation at the international level is imperative. The Washington Convention on International Trade in Endangered Species (CITES), adopted in 1973, plays a vital role in this regard by offering the most effective legal instruments to combat illegal trade. This paper describes in particular the role of CITES Permit system, which is the backbone of the regulation of trade in specimens of species included in the Appendices of this Convention. Additionally, the European Union plays a significant role in regulating international trade by ensuring implementation of...

Jašek, Petr ; Stejskal, Vojtěch (advisor) ; Žákovská, Karolina (referee)
Protection of owl species living on the territory of the Czech Republic in international, EU and national European law Abstract There are ten species of owls in the territory of the Czech Republic. The once widespread order of carnivorous birds has faced unprecedented pressures as result of landscape change and civilizational demands in recent decades, as a result of which their European populations are shrinking. For these reasons, a need has risen to protect owls at the level of individual national legal systems, at the level of EU legislation and in the sphere of international conventions. In the first part of this thesis, the biological specifications of owls as well as their ecological and agricultural importance are explained. The thesis also follows the legal mechanisms, the overall level of legal protection of owls and the application of standards for the protection of owls in international law, European Union law and nationals' law, all of which is reserved for the second part of the thesis. The international legal protection of owls is emphasized due to the large fluctuation of bird species across countries and continents. On the other hand, the law of the European Union, on the other hand, brings an unprecedentedly successful model of unification of national legal systems in the joint regulation...

Welfare of farmed animals in European Union law Abstract: The dissertation deals with the protection of farmed animals and their welfare in the European Union law. On the basis of this analysis and comparison, recommendations are then formulated which address the identified shortcomings and could improve the current state of farmed animal protection in the EU. The thesis is divided into an introduction, five chapters and a conclusion. The introduction provides an outline of the issue and highlights the links between the protection of farmed animals and the environment, lays down the research questions, outlines the structure of the thesis, summarises the methods used and...

Brtnová, Marie ; Stejskal, Vojtěch (advisor) ; Sobotka, Michal (referee)
This diploma thesis aims to analyze the legal regulation of liability for environmental damage in the Czech legal order. Given that the regulation of legal liability for environmental damage in Czech law is highly fragmented, this thesis attempts to give a more comprehensive view of the whole issue. By dividing it into individual chapters, the thesis presents individual aspects of legal liability for environmental damage and systematically offers insight into its issues. In its first part, the thesis focuses on legal liability in environmental protection and compares the individual components of legal environmental liability. In particular, it focuses on legal liability for damage under the Civil Code, where, on the basis of a detailed analysis, it defines the main characteristics that distinguish it from legal liability for environmental damage. The concept of environmental damage is introduced according to individual laws, with the greatest attention being paid to Act No. 167/2008 Coll., on prevention remedying environmental damage. The application of legal liability for environmental damage through preventive and remedial measures is viewed both by Act No. 167/2008 Coll., on prevention remedying...
