70 Collective bargaining Resume The thesis written by Lukáš Manhart concerns about the issue of a social dialogue and a collective bargaining in The Czech Republic, as these issues have been formed during the process of the social and economical development in the country. Social partnership, tripartite, bipartite, collective bargaining, collective agreements and their expansion, strikes, social conciliation are the conceptions which emerged in connection with the solution of social conflicts between employees and employers, labour unions and employers' associations. The conception of a ,,social dialogue", after which is usually the communication between social partners and their representatives called in its whole width of possible topics and forms that take place in a company social dialogue but even at a sectorial, regional or national (tripartite) level, is not definite. "Collective bargaining" The topic of my thesis is collective bargaining. I have divided my thesis in six chapters to be well-arranged. The first charpter describes the collective bargaining from the historical point of view and its significance nowadays. I try to express the important moments in the development of the collective bargaining and emphasize its importace in todays world. The second chapter contains regulation of the collective labour law as a whole. I am focusing mainly on the subjects and forms of the collective labour law and collective bargaining is right one of them. I am placing the emphasis firstly on the description of a state as a subject of collective labour law relationships and union organizations. The third chapter focuses on collective bargaining itself, contains its domestic and international legal form. The fifth chapter targets the process of collective bargaining, especially its initiation and strategy. The main goal - a collective agreement - is included in the fifth chapter. A collective dispute elaboration is included at the conclusion of my thesis because at the collective bargaining each party can have a different point of view on a certain topic. Postavení zástupců zaměstnanců v pracovněprávních vztazích Resumé Tato práce pojednává o zástupcích zaměstnanců v České republice. Rozebírá právní vývoj tohoto institutu na našem území, vznik a význam činnosti odborových organizací, rad zaměstnanců, zástupců zaměstnanců pro oblast bezpečnosti a ochrany zdraví při práci a evropských rad zaměstnanců a také pravomoci, které jsou jim svěřeny. Je v ní uvedeno i několik příkladů, které ukazují, jaký je systém činnosti zástupců zaměstnanců v několika zemích Evropské unie, a to konkrétně v Německu, ve Francii, v Belgii, v Dánsku a ve Švédsku. Práce se také zabývá požadavky předpisů Evropské unie na legislativu členských zemí v této oblasti práva a jejich promítnutím do právního řádu České republiky. Na několika stránkách je také popsán sociální dialog, jeho význam a způsoby jeho vedení. S tím též úzce souvisí popis činnosti jedné z nejvýznamnějších mezinárodních organizací při OSN, a to Mezinárodní organizace práce, stejně jako rozbor několika úmluv MOP, které jsou nejdůležitější pro dané téma. Disclosure of wrongdoing in labour relations

The submitted diploma thesis deals with the topic of disclosure of wrongdoings, which has lately gained attention due to the recent considerations of the possible complex legislative proposal in the Czech Republic. Therefore the purpose of this thesis is to analyze the current legal situation of disclosure of wrongdoings in the Czech Republic, along with analyzing all the aspects that should be taken into account when considering a legislative proposal, as well as analyzing and evaluating the legislative proposals that have already been submitted. The first part of the thesis presents the subject of whistleblowing and the different approaches to the subject, which are presented by the authors of the frequently used definitions. Then the author deals with the very essence of the issue and answers the question why it is necessary to legally regulate the area of whistleblowing. This thesis also presents various problematic questions including ethical matters inextricably linked with whistleblowing.
