Předložená diplomová práce se věnuje oznamování škodlivých jednání, kterému se v České republice v souvislosti s úvahami nad možnou komplexní legislativní úpravou dostává čím dál více pozornosti. Účelem práce je tudíž zmapovat a zanalyzovat současný právní stav oznamování nekalých praktik v České republice spolu se všemi aspekty, které by měly být při legislativní úpravě whistleblowingu brány v potaz, se současnou analýzou a zhodnocením již předložených legislativních návrhů. V první části práce se proto autorka zabývá především vymezením pojmu a různými přístupy k whistleblowingu, které lze pozorovat v zřejmě nejznámějších a nejčastěji citovaných definicích whistleblowingu. Dále je blíže analyzována samotná podstata problematiky oznamování nekalých jednání. Tento rozbor odpovídá na otázku, proč je potřeba oblast whistleblowingu právně regulovat. Podrobněji jsou představeny jednotlivé problematické body včetně morálních aspektů, které jsou s whistleblowingem neoddělitelně spjaty. Následně jsou představeny i mezinárodní závazky České republiky na poli whistleblowingu, a to nejvýznamnější dokumenty z oblasti hard law, ale i soft law, a další relevantní činnost orgánů na nadnárodní úrovni, především judikatura Evropského soudu pro lidská práva. Velká pozornost je věnovaná i současné právní úpravě... The submitted diploma thesis deals with the topic of disclosure of wrongdoings, which has lately gained attention due to the recent considerations of the possible complex legislative proposal in the Czech Republic. Therefore the purpose of this thesis is to analyze the current legal situation of disclosure of wrongdoings in the Czech Republic, along with analyzing all the aspects that should be taken into account when considering a legislative proposal, as well as analyzing and evaluating the legislative proposals that have already been submitted. The first part of the thesis presents the subject of whistleblowing and the different approaches to the subject, which are presented by the authors of the frequently used definitions. Then the author deals with the very essence of the issue and answers the question why it is necessary to legally regulate the area of whistleblowing. This thesis also presents various problematic questions including ethical matters inextricably linked with whistleblowing. Subsequently, the thesis provides an overview of international commitments of the Czech Republic consisting of the most important documents, both hard law and soft law, related to the reporting of wrongdoings together with other relevant activities of the international instutions such as decisions of the...
