Social security of disabled persons

The purpose of this thesis is to analyze the social protection of handicapped persons and its legal regulations in the social law of Czech Republic, the evaluation of the actuality and quality of the current settings of the social benefits and their valuation, with the focus on the benefit for care. This thesis is divided to three chapters. First chapter is introductory and defines the social security system itself. Furthermore, the first chapter introduces the history of the social security law in Europe and Czech Republic as well. The second chapter is focused on the specific benefits for physically and mentally disabled persons in accordance with the law 329/2011 Sb., of administration of the social security benefits for handicapped persons, which modulates the benefits to two parts; mobility benefit and benefit for the medical instruments. This law also includes the specification of the different levels of the identification cards for the handicapped persons. This part also concludes the current legal regulations, entitlement for benefits, the hearings and height of the allotted benefits. Resolving disputes in labour law relations - czech-german comparison

Diese Arbeit ist als Übersicht der Wege der Lösungen der arbeitsrechtlichen Beziehungen mit dem Fokus überwiegend auf die kollektiven arbeitsrechtlichen Streitigkeiten konzipiert. Die Arbeit teilt sich auf drei Hauptabschnitte: die tschechische Gesetzgebung, die deutsche Gesetzgebung und dann ihren Vergleich. Ein unbeträchtlicher Teil der Arbeit verfolgt den Vergleich der Gerichtsbarkeit in Arbeitssachen, wo die tschechische Agenda im Rahmen der allgemeinen Gerichte gelöst wird und die deutsche das Institut der Arbeitsgerichte benützt. Das Kapitel des Vergleichs beginnt mit einer tabellarischen Übersicht des Verfahrens. Erwähnt ist auch die Effektivität beider rechtlichen Ausgestaltungen. Unwesentlich sind die alternativen Wege der Lösung arbeitsrechtlicher Streitigkeiten erwähnt, und zwar mit dem Vergleich der Schlichtung und der Mediation. The topic of this rigorous thesis is called "Administrative infractions and delicts in the field of labour matters". The thesis is focused on an analysis of particular bodies of an administrative infractions and delicts which are regulated in various employment legislations, on an analysis of legislation and possible sanctions in case of breach of statutory duties. However the main focus of this rigorous thesis is an analysis of illegal employment and a relevant legislation of the Employment Act. The thesis also deals with an analysis of possible sanctions in case of accomplishment of elements of illegal employment and with their adequacy, with decision-making of appropriate administrative offices, and finally with a conformity of their decisions with employment legislations and judgements of the Supreme Court of the Czech Republic and judgements of the Constitutional Court of the Czech Republic. Termination of employment contract

in English The objective of the thesis rests in analysing the problems of the termination of the employment contract as per the Czech law. The ambition of this thesis is also to research and assess whether the Czech law fulfils an adequate protection of employees' interests in the present working environment in diffident conditions and under all and any circumstances and whether such protection is in balance with legitimate employers' interest to keep the working process development or enable its termination. The thesis is divided into five parts. The first part deals with legislation development and present legislation, principle and forms of the termination of the employment contract. The second part describes the termination of the employment contract by the Labour Code, i.e. a bilateral or unilateral will of one of the entities of the employment contract, which results in the termination of such employment relation. The events which result in the termination of the employment contract are outlined in the third part. The fourth part then supplements the thesis by all any other aspects relating to the termination of the employment contract. Redundancy payment and other forms of compensation in employment

The dissertation discusses problems of redundancy payments and other forms of compensation under labour law. Its focus is to describe in depth the current Czech law system's range of compensation which is related to employment termination. Every termination of employment comes with certain rights as well as obligations for either the employer or the employee. Among some of the obligations, provisions of different types of compensation are found, to which the rights are gained by termination of labour relations that are implied by the law as well as the agreement made by both sides. This dissertation is divided into five chapters. The introduction describes the labour law in general, because labour relations are ones of the most fundamental law relations in the life of almost every person. In the second chapter, we encounter the main topic of this dissertation - redundancy payments issues, what is their purpose, how one's rights to the payment are gained, on what legal grounds, what is the amount paid in specific cases of employment termination, and how it is calculated. Resümee Die vorliegende Diplomarbeit setzt sich mit dem Thema des Vergleichs der deutschen und tschechischen Regelung des Tarif- bzw. Kollektivvertrags auseinander. Zielsetzung der Arbeit ist, das Institut des Kollektivvertrags einschließlich der damit zusammenhängenden Institute zu verdeutlichen und zugleich mit Anwendung der vergleichenden Methode die Bewertung der aktuellen Rechtslage in der Tschechischen Republik und in der Bundesrepublik Deutschland darzulegen. Der erste Teil der Arbeit untersucht den breiteren Kontext des kollektiven Arbeitsrechts, seine historische Entwicklung und Rechtsquellen. Als nächstes wird die Problematik der Formen der kollektiven Arbeitsverhältnisse mit der Zielrichtung an das Recht der kollektiven Verhandlung beschrieben. The subject of my thesis is Human resources management and its legal regulation. The thesis is composed of ten chapters. Chapter One is about Human resources planning. In this chapter I describe how to schedule optimal number of employees and which planning methods to use. Chapter Two is Human resources marketing. This chapter presents a marketing approach in human resources management, formation and retention of the workforce, creating a good reputation and good standing of the employer in the labor market. Chapter Three concentrates on the principle of equality and prohibition of discrimination in the Czech legal system and in the European Union law. Chapter Four is Recruiting. The liability of an employer for damages caused by industrial accidents and occupational diseases Resume This graduation thesis deals with the topic of the liability of an employer for damages caused by industrial accidents and occupational diseases. It is conceived as the compilation of regularization, theory of the notable experts in this field, interpretation of the practice of the Supreme Court, examples from practice and of my own remarks which I try to offer to a reader in each chapter. The wide variety of topics is solved in the thesis, starting with the liability of an employer for damages, continued with labour-law relations, and ending with compensatory damages. Also the explanation of the terms is not forgotten. The extensive changes in the legal order of this topic will be implemented soon. I deal with this fact in the thesis, and I try to explain the main news we are expecting probably in 2013. My aim is to make the thesis available not only to the professional public but also to non-specialists without law education who can get awareness of the topic after they read the thesis. I would like the thesis to serve them as the manual in case of an industrial accident or labour disease.

THE RIGHT TO STRIKE AND LOCK-OUT ABSTRACT The content of this thesis is to outline the issue of strikes and lock-outs in the Czech republic, both in terms of current legislation, as well as in future ones. On previous pages I try to describe strike actions from the historical and economic points of view, but I also try to compare their individual characters within the EU countries and to accent their specific features and patterns, which are typical for the state or region. I spent an essentional part of my work by studying strikes not modified by acts and the questions of their legality. I gradually evolved into a full knowledge of complete state of freedom of association in our country because of Judicial decisions I didn't know before. I drew my conclusions primarily from literature, articles from distinguished academics and renowned experts and of course from court cases. The importace of legislative was relative because the lawmaker did not fully explore this area. I describe strikes and lockouts as a general phenomenon, whose presence is desirable in every developed community. But I also realized the individual typological aspects of employment law entities.
