Criminal liability in sports Abstract Presented diploma thesis comprehensively deals with issues of criminal liability in sports, considering the expert literature, current legislation and uses current criminal case law. Attention is paid mainly to the issue of sports injuries, marginally also doping and corruption in sports. Thesis is divided into ten parts (including introduction and summary). Second part of the thesis is dedicated to the most significant historical approaches to legal liability of athletes. Third part of the thesis briefly outlines evolution of sports definition followed by sports demarcation in Czech legislation. This part also deals with sports law, which is the source of most doctrinal approaches in subject matter. The general relationship between sports and law is formulated in the fourth part. In this part, basic theories of the effect of law on sports are firstly discussed, followed by individual concepts of criminal liability in sports. The way how Czech criminal law affects the field of sport is also indicated in this part. Fifth part of the thesis is focused on sports rules. After defining the concept and distinguishing sports rules from legal norms, the meaning of sports rules from the point of view of criminal law is explained. Criminal liability of physician for a non lege artis medical procedure Abstract This diploma thesis is focused on the issue of the criminal liability of physician for a non lege artis medical procedure. The main objective of submitted thesis is to define all the requirements and elements of criminal liability of the physician, therefore, to find an answer to under what conditions and in what situations the physician will be criminally responsible, and in what situation he will not be criminally responsible. Another objective of the thesis is to provide a definition of what can be considered as a lege artis procedure, what will be considered as a non lege artis procedure, who will assess such a procedure and what will be the consequences for the assessment of the criminal liability of a physician. In this thesis it was used mostly the method of description, analysis, deduction and a partial comparison. Selected sports problems from the perspective of criminal law

The thesis deals with the issue of criminal liability for actions occurring in the field of sport. Specifically, it chooses and examines the fields of sports injuries caused between athletes and corruption in sport. In its broadest conception it is divided into three parts. In the initial part the specifics of the society-wide phenomenon sport and substantial "non-legal" concepts of issues are described, in particular concept of sport, its category, the autonomy of sport and sport rules are defined here. The main part deals with the issue of criminal liability of athletes for causing injury to another. Whether certain actions involving a sports injury meets the definition of a crime is discussed in the context of current legislation. Followed by the research of the possible application of the concrete legal defenses for mentioned actions. For example researched legal defenses are consent of the victim or excusable risk. In this section are most mentioned and analyzed the selected theories of sports and legal doctrines that are often based on similar concepts as concrete legal defenses. Criminal Law Protection of the Environment The subject matter of this diploma thesis is the topic of criminal law protection of the environment in the Czech Republic. The main attention is paid to the current legal regulation of criminal offenses against the environment in the Criminal Code. In addition to a more detailed analysis of the individual criminal environmental offenses, the thesis deals with the basic theoretical background of the criminal law protection of the environment, with the issues of legal liability in the field of environmental law and with the comparison of criminal liability with administrative liability. Further is discussed the question of criminal liability of legal entities in connection with environmental protection and at last but not least is also described the historical development and current forms of individual international, European and national legal sources of criminal protection of the environment. Criminal liability for sports injuries The master thesis inquires into issues in respect of criminal responsibility for sports- related injuries. The author focuses on historical development of responsibility for sports injuries in the initial stage of the paper, as well as on general delimitation of sports and its segmentation. The goal of the following chapter is to present an interconnection between sports and law, particularly to illustrate relation between sports and criminal law on several diverse approaches of legal doctrine. The subsequent part of the paper analyses the topic of criminal responsibility of an athlete for injuries inflicted to another athlete from the perspective of legislation, sports-legal doctrine and practice of the court. The emphasis is placed on individual requirements for criminal responsibility, elements of crime and a listing of specific crimes relevant for the field in question. Criminal liability in medical law This diploma thesis deals with a criminal liability in medical law, especially with a criminal liability of providers of healthcare, which are not only individuals, but also legal entities. This thesis also compares Czech criminal and medical law with criminal and medical regulations in the Russian Federation. The thesis itself is divided into three chapters, which are subdivided into several sections. In the first chapter the criminal liability in medical law is analysed generally. It concerns general aspects of criminal liability, possible crimes, conditions under with healtcare services may be provided without any criminal sanction and other types of liability in medical law, such as civil, labour, administrative and disciplinary liablities. It introduces into criminal law and medical law in the Russian Federation. The second chapter defines providers of healthcare and shows those providers as possible subjects of criminal liability. 78 14 ABSTRACT The thesis discusses the issue of criminal liability in the sport with a focus on criminal liability of sport's injuries, doping and corruption. After a general introduction to the definition of sport and sport's law, the author focuses on the relationship between sport and law, especially criminal law. Subsequently, the thesis is devoted to sport's injuries from several points of view. At first, attention is paid to the connection between the current Czech Criminal Code and liability for sport's injuries, especially with regard to the mandatory features of the offense. In addition, it is briefly discussed the applicable circumstances excluding criminal liability. These circumstances are also devoted to next chapter which is dealing with the basic doctrinal theories formed abroad. The author attempts to bring his opinion on the possible application of these theories in Czech law. The following chapter focuses on the analysis of all relevant Czech criminal case law with an addition of one crucial civil judicial decision on the field of liability for sport's injuries. The submitted diploma thesis deals with the issue of criminal liability in medical law, which is one of the most discussed topics nowadays. The aim of the thesis is to provide a comprehensive analysis of the criminal liability of healthcare workers, a special attention is paid to analysis of selected crimes which can be committed in relation to delivery of healthcare. This diploma thesis is divided into 4 chapters presented in logical and systematic order. There are also opinions resulting from the case law and considerations de lege ferenda through the entire text. The first chapter deals with the definition of legal liability in general and conditions of its rise at a general level. For deeper introduction into this issue there are further described the types of legal liability in the context of medical law. Following chapter creates the information framework for definition of the basic concepts, such as ultima ratio principle, lege artis and conception of a crime and its constituent fact. There is also a demonstrative enumeration of circumstances excluding illegality.
