The position of migrants in the social area within the EU

The aim of this work is to provide a comprehensive overview of the European social system as a whole, including the initial efforts on the coordination of social security in Europe and the gradual development until the present legislation. It explains all the main principles underlying the coordination of social security and systematics of the legal system. The first part contains the historical development and the current form of this issue, which is demonstrated on concrete examples. The second part involves primarily an analysis of selected CJEU judgments that significantly affect the interpretation of applicable law.

Se vstupem Lisabonské smlouvy v platnost dne 1. prosince 2009 se přistoupení EU k Úmluvě stalo pro EU povinností – podle čl. 6 odst. 2 Smlouvy o Evropské unii „Unie přistoupí k Evropské Úmluvě o ochraně lidských práv a základních svobod. Přistoupení k této úmluvě se nedotkne pravomocí Unie vymezených Smlouvami“. Práce pojednává o souvislostech přistoupení EU k úmluvě.

Infringement risks concering taxation in the Czech republic

This bachelor's thesis deals with an infringement concerning taxation in the Czech Republic. The main aim is to identify risks associated with the infringement, to estimate their quantification and to propose a solution for their reduction or complete restriction. The first part deals with European law in general and the risks resulting from its disobeying which is important for the practical part of thesis. The next part describes a process of the infringement and a method of determining sanctions. The last part is specifically focused on the Czech Republic, where two solved and three ongoing infringement cases are described. Estimated sanctions and suggested solutions for these cases are also described in this part.
Consumer Protection in New Czech Civil Codex

As a member of the European Union, the Czech Republc is obliged to implement European directives and regulations, also in consumer protection policy. The revision of European consumer acquis has begun in the same time as the long awaited recodification of Czech civil law -- new Civil Codex. The thesis focuses on how the new Civil Codex reflect the most important recent European regulations and directives. A few were chosen to be analysed more thoroughly -- directive 2011/83/EU, Draft Common Frame of Reference, draft of common European purchase contract, draft of directive 2011/793 and regulation 2011/794. Moreover, it focuses on a few selected issues included in the new Civil Codex, notable from the view of European legislation transposition -- e. g. the definition of consumer, distance and off-premises contracts, unordered supplies and unfair contract terms
The Relationship between International and European Law

The Diploma Thesis deals with the relationship between International and European law in the context of actual events. The main aim is to analyse this relationship on the particular case of Yassin Abdullah Kadi by means of the wide scale of expert opinions and discussions. The main aim will be achieved through several partial aims (theoretical definition of essential conceptions relating to the theme, description of particular UN resolutions and their implementation into European law, analysis of the judgements of EU judicial authorities in the Kadi case).
Comparison of European and Czech law of environmental taxation

This bachelor work deals with the differences between European and Czech environmental tax adjustment. The first part focuses on the general definition of environmental taxes. Further, in the introductory section, is describing the harmonization of taxes through the tax reforms. For subsequent defining differences is state analysis of European energy directive and also the Czech law, called stabilization of public budget act, which includes environmental taxes. Susequently, the differences are analyzed in one area of immunity in a particular case. The conclusion attend to compliance the Czech law with European directive text, which are used by the ruling of the European Court of Justice.
Expression of Condition in the French texts of the European Law in comparison with the Czech equivalents (EurLex)

The theme of this thesis is the expression of conditional clauses in the French version of European legistative texts in comparison with the equivalent expressions in the Czech language. The first part is focused on different types of conditional sentences in the French and Czech language. The second part deals with conditional clauses in the French version of chosen European legislative texts. Using Adobe Acrobat 9 Pro Extended I selected sentences with chosen lexical collocations used in French language to connect a subordinate conditional clause to the main sentence. Then I found selected sentences in the Czech version of the chosen European legistaltive texts. Finally all chosen sentences and their translations were analyzed and compared.
Possibilities of Drawing the Grants from the Funds of the EU and Their Realization in Selected Communes in the South Bohemia - a Case Study

This work includes a basic outline and introduction into the EU regional policy problematic. This theoretic background is then transferred into the practical part of this paper, where the author presents an overview of grant systems (both the EU´s and national programs) and their utilization in two south bohemian cities ? Český Krumlov and Hluboká nad Vltavou. First, the cities are shortly characterized and later a comprehensive briefing of the national and EU´s grants is described, especially within the 2004-2009 period. The collected data clearly show the fact, that during the whole period, Hluboká nad Vltavou managed to acquire 6 mil. Kč more from the EU´s resources, than Český Krumlov did. This conclusion is highly interesting, since Český Krumlov is by far a larger city, compared to Hluboká nad Vltavou. This proves that the acquisition of the EU donations is significantly dependent on administrative or project skills of the given cities. The difference in these skills has projected in the grant-success percentage of both cities, while Český Krumlov received only 30% of requested donations, Hluboká nad Vltavou reached almost 60% rate. Based on this outcomes of the two cities and their EU donations, it is evident, that the 2000-2006 period was fairly poor, while this trend has started to change significantly between 2007 and 2010. This work concludes that the rate of grant requests is rapidly increasing as the EU moves towards the closure of the second program period in 2013, which mean the end for the grant system whatsoever.
Periphrastic Verbal Forms and their Czech Equivalents in Texts of European Union Law.

This Bachelor Thesis is focused on the frequency of infinitive verbal periphrases that are inherent in authentic texts of the European Union law. The aim of the Thesis is to provide an overview of the occurrence of verbal periphrases and to introduce different options of their translation in legal documents. The introductory chapters examine the definition of verbal periphrases and characterize them. They also present various authors and their methods for the identification of verbal periphrases and describe their classification. The practical part analyses concrete texts of the European Union law which are included in the eur-lex database. It assesses the occurrence of this phraseology in selected legislation and case-law documents and it makes comparisons of the representation and translation of the periphrases found. The observations are summarised in graphs and tables that provide a picture of the frequency of each group of verbal periphrases {--} modal and aspectual and their comparisons are also provided.
