Criminological and legal aspects of the ransomware phenomenon

Criminological and legal aspects of the ransomware phenomenon Abstract This diploma thesis deals with the current topic of cybercrime and focuses specifically on the phenomenon of ransomware on a scope unprecedented in Czech legal literature. Ransomware is a malicious code that interferes with the operation of a computer system, and later requires ransom for the victim to recover the access to the computer system and the data contained therein. Basic concepts necessary for the definition of ransomware (such as cyberspace, cybercrime, computer system, malicious code, cryptocurrency and darknet) are introduced and explained. The specificities of cybercrime and its development and current range in the Czech Republic are analysed. The main part of the text deals with the analysis of ransomware, starting with its history and leading to the possible future developments of ransomware. Different variants of ransomware are described such as false antivirus, police, locker and encryption ransomware. From a criminological point of view, the text focuses on the unique interaction of the perpetrator and the victim, which takes on surprising forms of customer support, answers to frequently asked questions and instructions for acquiring virtual currencies. Malware and comparison of antivirus products

This bachelor thesis deals with the issue of possible danger in the Internet environment, namely malicious software. It is a variety of computer viruses, worms and Trojans that are comprehensively called malware. This risk should be closely monitored because its development is constantly moving forward and everyone should be familiar with this topic. The theoretical part includes the characteristics of malware - clarification of the concept and definition. The following part is history, which is described from initial ideas, the first malicious code in the 70's, and other well-known programs. It is led to the present day which is mainly focused on today's goals and direction of development of further malware. Next part involves the distribution of malware to basic, other special types and other such related forms. The final part describes the preventive and protective measures, and how to reveal and what to do if computer is infected. On this last section follows up a practical part, in which is analyzed antivirus protection, which is available in Czech and world market. Based on this analysis is done comparison of selected free antivirus programs. These are compared according to established criteria, such as web pages, installation, the use, user settings, appearance and ability to detect malware. The goal is to determine the safest and most comfortable user program. The result is used for ordinary users as possible support when they are choosing antivirus to their own computer.
Criminal Aspects of Cybercrime

The purpose of this thesis is to introduce the issue of cyber crime, a phenomenon which is gaining importance in recent years. The first chapter outlines the basic problem: Mass use of information and communications technologies may have downsides. Consequently, the reader learns briefly about development of computers, which resulted in the emergence of the Internet. Especially, how this short evolution affected the terminology regarding crimes related to information technology. The term "cyberspace", from which we derive the term "cyber crime", becomes crucial. This virtual world is not only a place of fun but unfortunately also full of malicious behavior. Further, the work deals with the specifics of cybercrime and its differences that distinguish it from other types of crime. The fifth chapter deals with the legal regulation, both domestic and international. It lists major legislation related to the cyber crime and is especially dedicated to analysis of the Criminal Code, the law on cyber security and the Convention on Cybercrime. Next comes the main section of the thesis dedicated to crime in cyberspace. It describes the most common malicious activities which occur in cyberspace. Legal framework of computer crime investigation

Master's thesis is focused on computer crime, with an emphasis on the process of investigation. New systematics in Czech computer crime terminology is offered. Within the thesis, cybercrime is perceived as a part of computer crime. Special attention is put on various aspects of criminalistics, as the topic of investigation itself is understood from the point of view of such science. Nevertheless, criminological findings are discussed likewise. Particular emphasis is put on a link between Czech legal regulation and expert literature from the fields of law, criminalistics, criminology and technology. Master's thesis is based on Czech literature, as well as English and French writings, in addition to national and international case law. The text itself is divided into three chapters. First chapter is introducing the issue of computer and cybercrime with selected criminological characteristics, including specifics of offending within the Internet. Second chapter discusses evidence of computer crime, the electronic or digital evidence, from the point of view of criminalistics. Internet and computer criminality Summary This thesis, as its name indicates, deals with the problems of our times associated with computers and the Internet, which make it possible to commit all sorts of crimes. Computers are part of our daily life and the sphere of information and communication technologies are constantly and rapidly developing, which gives space to potential perpetrators to find new approaches. The thesis is composed of eight chapters. The opening chapter of this thesis describes the basic concepts related to computer and Internet criminality. It includes the definitions of computer criminality, cybercrime, cyberspace, as well as basic technical concepts such as computer, hardware or software. Approximation of this terminology is essential to understanding the issue. Next chapter is devoted to some illegal activities in cyberspace, which are then legally assessed. 1 Thesis title, keywords and abstract Thesis title: Sexually motivated cybercrime Keywords: cybercrime, virtual child pornography, sexting, pornographic performances, cyber grooming, sexual solicitation of children This master thesis deals with the issue of cybercrime against persons more specifically with sexually motivated crimes. The thesis is divided into five separate chapters. The first chapter deals with cybercrime in general, its taxonomy and the necessary terminology, it also describes some of the criminogenic factors of cybercrime relevant for the issue. The second chapter presents the most important applicable international legal instruments. The third chapter describes the issue of illicit pornography especially child pornography. For the subsequent chapters the author's own taxonomy was used and they overlap in part. The fourth chapter explores the phenomenon of sexting and the use of web cameras for sexual purposes as a consensual activity. Cybercrime: Selected issues of prosecution in international environment

The thesis deals with an issue of cybercrime prosecution in international environment. The text focuses on particular problems met by law enforcement agencies when prosecuting cybercrime. Within the prosecution, the emphasis is put on the aspects of detection and investigation of cybercrime. Within the thesis, cybercrime is understood as a part of computer crime. Computer crime is approached rather as global crime due to typical characteristics of information and communication technologies. Therefore, the international cooperation of law enforcement agencies is considered crucial. First chapter introduces the issue of computer crime, including adopted terminology. It discusses the transformation of computer crime and cybercrime following its historical development and broad forms of modus operandi. Development of information technology is one of the most dynamic parts of today's global society. Along with the coming of new technologies it generates new types of crime, eventually existing types of criminal activities in this area are moving from the real world to cyberspace. This rapid development of cyber crime enforces corresponding changes in the legislation related to cyberspace. In the Czech Republic the most fundamental changes in cyber crime law have been made along with the new Criminal Code. The new code has modified some areas, that were not mentioned by previous criminal code, refined or amended previous terminology related to cyberspace and added institutes required by international commitments, especially by the Convention on Cybercrime. The purpose of this diploma thesis on "Cyber crime" is to outline the issues of cyber-crime, point out some troubling topics, which are currently present in cyberspace, and outline possible future development of criminal law in cyberspace. Security of Work with Electronic Data in Industrial Enterprises

The aim of this thesis is not only to characterise the key terms related to this field, but also to analyse the possible solutions to the area in a particular industrial enterprise in the Czech Republic by means of a case study which is a reliable method of qualitative research. The thesis is divided into theoretical and practical part. In the theoretical part the terms such as information, electronic data, know-how, enterprise information systems, cybercrime, and cyberterrorism are defined. The practical part drawing on the theoretical part gives a thorough analysis of the initial state of an industrial enterprise in food industry. Furthermore, it deals with the implementation of the ECM (Enterprise Content Management) which is considered a possible solution to the security of work with electronic data in industrial enterprise.
