Collective dominance in competition law and its abuse

The aim of the diploma thesis is a comprehensive analysis of the concept of collective dominance, in particular with reference to the evaluation of its applicability and utility in practice. The first chapter deals with the main features of the oligopoly market and Czech and European legal provisions on the abuse of a dominant position and mergers within which it has evolved. On base of the analysis of Court of Justice and General Court judgements the second chapter explains the notion of the collective dominance and examines the obligatory conditions of the collective dominance, as well as the factors which influence these conditions. The third chapter concerns the concept of collective dominance with regard to competition law taxonomy. It compares not only the test of collective dominance applied pursuant to the article 102 TFEU with the test applied according to the Council Regulation (EC) No 139/2004 on the control of concentrations between undertakings, but also the concept of collective dominance with the agreements pursuant to the article 101 TFEU. It also deals with abusive practices typical for oligopolies. Beside the explanation of the UK legislation the last two chapters illustrate decisions of competition authorities in the Czech Republic and in the United Kingdom and analyse and compare them. The diploma thesis is concluded by the analysis of main shortcomings of the concept of collective dominance and the evaluation of actual state of the examined topic with the aim to abstractly summarize knowledge gained through the thesis.

Procedural Periods in Roman Law Submitted thesis is focused on chosen questions of procedural periods in Roman law. It is too focused on chosen institutes of roman procedural law. Firstly the thesis dissertates about general information and about and progress of roman procedura law. The relation of roman procedural law to singular procedurals periods was emphasized in the introduction. The crucial part of this opening leans in analysis of singular judicial magistrates. Further the contexture for individual procedural parties was mentioned. The main part of thesis describes separates procedura periods in detail. It makes through particular roman-law institutinos which are alone influenced by procedural periods. The single chapter disserts on prescription of rights, preclusion and temporal character of some actions. These law institutions are very important. It is also crucial in contemporary law. This chapter follows on discourse about executory periods. The final part of thesis is created by question of time and its computation, especially in law and in standing roman life. ALTERNATIVES TO UNCONDITIONAL IMPRISONMENT Pavlína Sýkorová My diploma thesis deals with alternative punishments which may be imposed as an alternative to imprisonment. The thesis is divided into six chapters. In the introduction of my thesis first I deal with general issues, I define the term and the purpose of punishment and I outline the concept of Restorative justice which presents the base of alternative approaches in the penal law. The second chapter describes the system and various forms of alternative sentences and criminal procedure alternatives (procedural diversions), their historical development in the Czech Republic since 1989 and the activity of international organisations in this domain, especially United Nations and The Council of Europe. In this chapter I also present the institution and characterise the activity of the Probation and Mediation Service which has an important role during the imposition and execution of some alternative punishments. The main attention in the thesis is concentrated on the chapters 3 to 6 which concern particular alternative forms of punishment in the valid and effective Czech legislation, their imposition and execution. Comparison of women's rights in the USA and the Czech Republic

The Master's Thesis deals with women's rights in the Czech Republic and in the United States of America. The aim of the study is to compare women's rights and opportunities in education, labour market and family life. The theoretical part of the thesis deals with the role of women in society in terms of education, voting rights and employment on labour market. Special attention is focused on family law, mainly on benefits for mothers in different life situations. The practical part of the thesis consists of two parts, a primary empirical research in the form of individual personal interviews and an interpretation of secondary statistical data. In the end of the thesis there is a comparison of both countries based on the theoretical information and the results of the empirical research.

Jeho aplikace však znamenala zásah do elementárního lidského práva - práva na život, a proto byl neslu itelný s požadavkem ochrany lidských práv, který by každá moderní spole nost m la respektovat. P edevším z tohoto, ale i z jiných d vod eské trestní právo vypustilo absolutní trest ze svého systému trestních sankcí a nahradilo ho doživotním trestem. Trest odn tí svobody na doživotí p edstavuje nejp ísn jší trest, který sou astná právní úprava pachateli trestného inu dovoluje uložit. Czechs and toleration

In March survey CVVM focused on problems of life together of Czechs. Respondents were given a list which contained 14 different groups of people and they had to say, whether they would not want these people as neighbours. Most Czech citizens do not want to live near by drug addict (89 %), alcoholics (83 %) and persons with criminal pastness (78 %). Then we probed how Czech society is according to obtained opinions tolerant to selected groups of people. Most Czechs suppose that our society is tolerant particularly to people with different religious persuasion and young people (both 87 %). Social and economical analysis of the housing development South Moravia region

Diplomová práce sociální a ekonomická analýza rozvoje bydlení Jihomoravského kraje je zaměřena na bydlení a bytovou infrastrukturu kraje. Cílem práce je provést systémový rozbor bytové výstavby v kraji a analyzovat stav bytového a domovního fondu včetně jeho vývoje a struktury bydlení. Bydlení je zvláštní specifikum lidského života a nedílnou součástí ekonomiky státu. Jedná se o potřebu, která je pro člověka nezastupitelná a pokud si ji člověk vlastními silami nedokáže obstarat sám, přichází na pomoc stát. Počáteční část práce je věnována charakteristice a demografickému vývoji kraje. Hlavní blok se zabývá analýzou bytového a domovního fondu, kde jsou vysvětleny i kvalitativní a kvantitativní znaky úrovně bydlení včetně bytové výstavby v kraji. Tato kapitola je úzce provázána s navazující kapitolou sociální spekty bydlení, kde je zmíněno o právu na bydlení, významu sociálního bydlení zejména z hlediska dostupnosti bydlení pro mladé začínající rodiny. Závěr práce formuluje cíle vhodné pro kraj a možná opatření v jednotlivých oblastech bydlení.
