Security Institutes of Civil Law

This Bachelor´s Thesis has focused on the topic of "Security Institutes of Civil Law" and deals with security institutes like a contractual fine, surety, lien and securing bill of exchange. This work is devided into chapters and sub-chapters. After the introduction there is a literature search, that contains the characterization of the contractual legal relationship and the definition of the basic concepts of the law of contract. In the second part of the literature search there are selected security institutes, that are used in the Czech law. Individual sub-chapters of the comparative part are devoted to comparing of security institutes mentioned in the literature search from the standpoint of the legislation in effect prior to 1.1.2014, and from that date. The practical part continues these problems. Here we can find the process of the accounting of contractual penalties and interest rates for late payment. This chapter also deals with the definition of bills of exchanges from the standpoint of accountancy their accounting and writing own bills and someone else's bills.
Legal issues of providing bank credits

The main objective of this thesis is to map and analyze the legislation that relates to each question of the whole process of providing bank credits, and state the most important changes. The work is divided into six chapters, where each chapter presents the area, which is related to providing of credits and includes analysis and explanation of its legislation. Emphasis is placed on new legislation of the Consumer Credit Act and more attention is also devoted to the exaction of debts and significant amendment of the Law on Arbitration and enforcement of arbitral awards.
The records of the material rights to the real estate register

The work containst history of real estate register. Status of land registries. Explanation of basic terms according to real estate register. Adjustment of material rights in civil code ? proprietary right and other material rights. Explanation of terms deposit, entry and note. Legal adjustment of decision-making about deposit permission and entry agenda. Ways of decision-making in land register ? proceeding interruption, proceeding stoppage, condition analysis for deposit permission, decission about deposit permission, decission about proposal denial. The target of this work was to bring a brief description of legal relations records to the real estate register and to clarify the variances between particular record forms. The target also was to bring statistics of Czech Republic vs. South Bohemia District, or rather land registry Třeboň related to South Bohemia District. I also give in my work results of my observation and investigation (research) of selected files (facts) focused on deposit activities at land registry Třeboň. After that I evaluate results of my research, including particular incorrect cases I found. There is an example coneccted to the work ? decission of land registry Třeboň. Choosing of particular incorrect cases, I wanted to implicate the most frequent mistakes, which should be avoided by contract drawing up. I hope, that the target of this work was, according to the task, fulfilled
Valuation of property as a subjet of mortgage collateral

This thesis deals with the valuation of property in connection with mortgage financing. First chapters are devoted to analyzing the current state of the real estate market and mortgage financing in Czech Republic. The second half focuses on the specifics of valuing real estate as mortgage collateral. The last chapter consists of a practical working example of a apartment building valuation.
Analýza vzájemných vztahů mezi bankovním a nemovitostním trhem

Diplomová práce se zabývá vymezením vzájemných vztahů mezi bankovním a nemovitostním trhem a následným popisem způsobů, jakými se tyto dva trhy ovlivňují -- tedy jaké dopady má vývoj jednoho trhu na druhý. Práce je rozdělena na tři části, přičemž první část se zabývá charakteristikou těchto dvou zmíněných trhů a vymezením jejich vazeb. Další část práce se věnuje už podrobně popisu situace, kdy trh nemovitostí ovlivňuje bankovní sektor, k čemuž dochází prostřednictvím zástavního práva. Ve třetí kapitole je naopak popsán vztah, ve kterém působí bankovní trh na trh nemovitostí, a to jak na straně poptávky, tak na straně nabídky prostřednictvím poskytování speciálních úvěrů určených k výstavbě či koupi nemovitosti. Jedná se především o hypoteční a developerský úvěr.
Securing of contractual obligations in the international trade (economic and legal aspects)

The first part of the thesis deals with a description of legal relationships in the international trade and explains the term "international element." Further there is a short description of private international law and international trade law. The second part of the thesis is focused on securing of contractual obligations in the international trade. The third part concerns with explanation of the basic forms of legal relationships in the international trade regulation with regard to securing of contractual obligations. The final part of the thesis deals with a description of securing instruments used in the international trade. At the end of this part there are listed factors which influence the choice of a suitable securing instrument.
Comparison of commercial contracts securities in the Czech republic and in Germany

The diploma thesis deals with the comparison of commercial contracts securities in the Czech Republic and in Germany. The first part of the thesis describes the general question of secured transactions. The second chapter deals with comparison of the lien and the right of retention. The third part analyzes penalty, warranty and recognition of an obligation. The last chapter summarizes the main differences between commercial contracts securities in the Czech Republic and in Germany.
Signification of Public Auctions on the Financing of Living

Public auctions are one way of public negotiation, which leads to transition of property right or another right to the auction subject. All the process is based on the proposer's proposal. This act often becomes a reason of unpaid debts arose during the financing of living throught mortgage. In this case the mortgage proposer is the bank, which offers this mortgage. This bachelor thesis is trying to define relation between the financing of living and public auctions, how they are connected and where the trend works independently on each other. There are included neither theoretic processing of public auction nor process of auction in use. This thesis doesn't handle all the detailes of public auction, but only targets involuntary auction and the reasons of financial restutition from debtor's side. Involuntary auctions become very important part of market with living even in this critical economical situation.
Význam zastavené nemovitosti pro hypoteční banku v České republice

Diplomová práce obsahuje základní informace o hypotečním úvěru jako produktu bank se speciální licencí, zabývá se vlastnostmi nemovitostí a jejich oceněním z hlediska přijatelnosti do zástavy hypoteční bankou a z hlediska možnosti uznat pohledávku z hypotečního úvěru do řádného krytí hypotečních zástavních listů. Cílem práce je prokázání vzájemné vazby mezi hypotečními úvěry a emisemi hypotečních zástavních listů, která vyplývá z existence zastavené nemovitosti.
