The extent of legal liability of the State for misconduct in the exercise of state powers

In the presented work I study the concept of liability of the State for misconduct in the exercise of state powers. The main aim is to show why this concept needs to be different from the one we know from civil law. The legal relationship between the State and an individual is a relationship that differs from the one we know from civil law, given that it is related to the exercise of power. Therefore we have to construct specific legal conditions in order to find the State liable for damages that an individual may suffer in such a relationship. In the first part I question the main function of the State's liability for damages. I show that it has good influence on the administrative bodies in the way that it forces them to follow the law. On the other hand this influence must not be overestimated. In the next part I study the basic elements and conditions of liability. I work with the domestic law as well as with the liability principles formed by the judicial decisions of the EU Court of Justice. I compare both these systems of liability for damages with regard to how they respond to the specific features of the relationship between a State and an individual. The potential of the Czech factoring market

The diploma thesis deals with the issue of factoring and its aim is to assess the potential of the Czech factoring market and on its basis to evaluate the possibilities of entry of a new competitor into the factoring industry. The theoretical part explains the economic substance of factoring, describes the process of factoring operation and emphasizes the main advantages and disadvantages, that factoring provides to the clients of factoring companies. The analytical part analyzes the current state of factoring market, describes the major trends and estimates the future development. The key part of this thesis is concerned with analysis of external and internal environment of domestic factoring market conducted using PEST analysis and Porter's five forces model. The analysis' outcomes result in list of conditions for the entry of potential investors into the factoring industry in the Czech Republic. The practical part contents three scenarios by which the author suggests three options on how to implement the entry on the domestic factoring market.

Comparison of attitudes of Germany to a minority issue (by way of the examples of Turks in Germany and German minority in Upper Silesia)

Since 1950s when the first influx of cheap labour force appeared the social situation changed rapidly. The original labour force managed to get over the denial of the majority society and administrative obstacles and turned into a permanent part, but not part and parcel of the German society. The German government trying to support economic growth decided to use foreign labour force as a less dangerous option for the future. The second option was to allow the admission of foreign capital investments. However, the project which should have been controlled by the migration policy and should enable the foreign workers to satisfy the demand of the German labour market has not met the expectations.

Diplomats in France

French diplomacy has a long and rich history; it used to be one of the most important players on the international scene and even in the present it seeks to influence it. The aim of this thesis is to describe how this country by force of the internal legislation regulates the status of its diplomatic agents and how it treats foreign representatives who come here to assume the Foreign Service. It's generally known that France is a country with complicated administrative apparatus, bureaucracy and system of precepts of law. We can suppose that the diplomatic one will be alike and this thesis attempts to overcome these difficulties.

European audiovisual politics: public service broadcasting and the competition rules of European

For the broad problematic of European public broadcasting service (PBS), we chose a rather narrow view point of its financing. The competition law in EU, which is called by many an economic constitution for its force and prime role in the process of European integration, has much larger impacts than solely economic ones. The respect of competition rules in PBS financing can also indicate a good level of political end economical media independence. This thesis consists of three main parts. The first part treats PBS as a fraction of a far larger field of general economic interest services. Those services, essential in European social model, are represented on EU level legislation mainly as exceptions of strict competition rules. Regarding this topic, we follow the development in practice of the European court of justice. We follow the struggle between two conceptions - the "compensatory" and the "state aid" conception which ended in compromise Altmark judgment of the European court of justice in 2003. The problems of services of general economic interest and its place in European national societies represent a strong social dimension, to which PBS add also the cultural and national one. Stimulation Mechanisms in the System of Assistance in Material Deprivation

The system of assistance in material deprivation regulates aid to people in need, i.e., persons who finds themselves in a situation where they are unable to provide for themselves. At present, greater emphasis is being out on each citizen?s responsibility for themselves and their families, as well as their active role in the finding of solutions for social events that impact on them. The point to try to motivate people in need to improve personally and actively their income. The aim of the Diploma Thesis is to map the findings gathered in the process of applying selected mechanisms in the system of assistance to persons in need. Five basic questions have been formulated for our research: 1. How do the clients see the idea of selling property or other uses of property? 2. How can we prove a client?s endeavor to improve his income by working? 3. What requirements and demands do recipients of welfare benefits have when they improve their income by working? 4. Is the concept of positive effect of higher income earned by own work apparent more on the part of social workers than clients? 5. What options of controlling do the recipients of welfare benefits have when trying to prove their effort to improve their income by own work? The qualitative survey was conducted by questioning, using the technique of semi-structured interview. Data collection was done from July to October 2011 ad in March 2012. The survey sample consisted of 12 recipients of welfare benefits selected by random, 12 social workers from municipal offices, and 5 social workers from regional branches of the Labor Office. The collected data were processed by casuistry specialists. Other data were sorted by theme, mutually compared, and summarized in the form of tables. The research survey revealed that most of the questioned social workers do not consider the system of material assistance stimulating. They believe that the system forces clients to rely on the system, rather than seek employment actively.

Options to expand production on small family farms

This diploma thesis deals with the financial analysis of "Bláhův dvůr". It is a small starting young farm in the Central Bohemian Region. In the first part, I analyzed the financial analysis using financial ratios such as rate of return, liquidity, asset and debt. To determine whether a company is a profitable one, I have made the financial analysis using status indicators which are following: Altman's Z score, indices of credibility, Taffler's z-score and Quick test by Kralicek. At the end of this analysis the Cash flow is provided. The next part of my diploma thesis deals with the evaluation of the current market position of the farm using the external economic indicators such as the analysis PEST and Porter´s five forces model. After completing all the above mentioned analyses, all risks and divergences in agricultural commodities were evaluated through price trends. Using all the information, economically recoverable and revenue possibilities for future development were suggested. The main purpose of this thesis is the SWOT analysis, where I have mentioned weaknesses and threats, which will be eliminated and minimalized through business opportunities and business strengths.

The firm strategy project of the company Gentech, s. r. o.

The aim of this thesis is (i) the introduction of the small company Gentech, s. r. o., which operates in building industry, (ii) the assessment of its current activities, (iii) the internal analysis of the firm, (iv) the analysis of the firm's industry and (v) the external macroenvironment (PEST) analysis. The internal analysis identified the firm's strengths and weaknesses and the external analysis revealed opportunities and threats. A profile of the strengths, weaknesses, opportunities, and threats were generated by means of a SWOT analysis. An industry analysis was performed using a framework developer by M. E. Porter known as Porter's five forces. On the bases of the information from the environmental scan, they were outlined possibility options for the firm strategy which should be necessary for this small company to survive and prosper.

Compensation for differences of hardness in the components during the profile rolling

In der vorliegenden Masterarbeit Kompensation von Härteunterschieden an Bauteilen während des Profilwalzens wird die Einfluss der Härteschwankung auf die gefertigten Werkstücke beurteilt. Die Einflüsse wird mit der praktische Versuche mit Methoden der statistische Versuchsplanung auf die verschiedenen Verzahnungsprofilen und Prozesseinstellungen untergesucht. Die Auswertung der Versuche durch das Software Minitab ergab, dass die Reduzierung der Schwankung des Maßes über Messrollen durch die Onlinesteuerung aufgrund gemessene Walzkraftdifferenz möglich ist.
