Dohled a kontrola nad realizací veřejných zakázek v České republice
Nováčková, Tereza
Public procurement is a much-discussed area today. It is about a paid provision of particular goods or services, that are provided from the public funds. Because of the high risk of manipulating with these funds, there is a high level of supervision done from the side of the government of the Czech Republic. This is not just on the national authority’s level, but also on the European community one, where they can with their power, influence the course of implementation of the public procurement in our territory. Except the European regulations in the form of directives, regulation and other documentation, European union also acts like a donator among others, also for implementation of public procurement. This thesis creates an overview about these authorities and their competencies in the field of supervision and control of public procurement. When the public procurement is being submitted and there is a failure in the process, in such case, the public procurement authorities enters the process and checks the correctness of the contracting authority's approach. The practical part is then based on an example from practice, where we encounter above mentioned failure from the side of the submitter and entry of the controlling authority into the realization. Since this contract was granted, the relationship of the hierarchy of supervisory authorities is much more complicated. Practical example therefore states the relationships between particular authorities in their decision-making process. So, what happens when the controlling authority refuses to reimburse costs due to a misconduct in the realization of public procurement contract? To whom the submitter can turn to? These questions are answered by the practical part. Diploma thesis creates a summary, based on the detected misconducts during the implementation of the public contract and drawing of financial support from the operational program and provides following recommendations for the submitter, who initiated the procurement.

Švásta, Pavel ; Prášková, Helena (advisor) ; Průcha, Petr (referee) ; Staša, Josef (referee)
This thesis deals with the topic of privilege against self-incrimination of legal entity in administrative proceedings and in offence proceedings. The following reasons led me to the choice of this topic. First of all, it is a multidisciplinary topic involving criminal law, criminal administrative law, constitutional law, and private law, especially the regulation of legal entities. Furthermore, with the exemption of decision-making praxis of courts, and a few academic essays, attention hasn't been paid to this topic in its complexity. For this reason, this topic has offered novelty and the possibility of observing the progressive development of judicature, especially the decision-making praxis of the Supreme Court of the Czech Republic, the Supreme Administrative Court of the Czech Republic as well as the Constitutional Court of the Czech Republic and the European Court of Human Rights. The first part deals with the historical origins of privilege against self-incrimination and development of the criminal proceedings over the centuries. Special attention is paid to the fact, that privilege against self-incrimination was originally part of criminal proceedings until the 12th century, when this privilege was removed from the canon law and replaced with the inquisitional process which was linked with the...

Černý, Tomáš ; Karfíková, Marie (advisor) ; Vybíral, Roman (referee)
Supervision over Insurance Industry and the Legal Regulation Abstract ČERNÝ Tomáš: Supervision over Insurance Industry and the Legal Regulation; Charles University, Faculty of Law; supervisor of the rigorous thesis: Prof. JUDr. Marie Karfíková, CSc.; 2018, number of pages 183. The rigorous thesis attempts to confirm or refute the author's hypothesis that it comes to harmonisation of national legislations not only in the regulation and supervision in the insurance industry as a major branch of the economy, but generally in the supervision over financial markets as a whole, also apart from the integration and harmonisation within the EU. Based on the conducted review, the results of which are incorporated in this thesis, it can only be said that the subject and the way of supervision are very similar in individual countries compared, despite the diversity of individual supervisory institutions, whether as an independent institutional framework of the supervisory body within the central bank or as a self- established body. The first two chapters explain the meaning of individual concepts and terminology necessary for the proper understanding of the issues of the insurance industry and its supervision. The clarifications concern in particular some terminology in the field of insurance and its supervision, the...

I will concentrate mainly on the current age and therefore on the electronic surveillance, so the history of the surveillance studies will not be dealt with in this thesis in more detail. The first part of the thesis will be theoretical focusing on the main theses and theories of the current surveillance authors, especially the issues of electronic surveillance. The next part of this thesis will focus on surveillance and surveillance techniques in marketing and consumption. In this part I will also build on the theories of contemporary authors discussing the surveillance topic in the commercial sphere, but I will try to complement the theoretical introduction of the issue with the specific functioning of this phenomenon in practice. The main aim of this thesis will mainly be an overview and comprehensive illumination of surveillance and control issues focusing on the field of marketing and consumption and also mapping its operation in practice. In this part, I will focus on the issue of electronic surveillance in terms of marketing strategies focusing on the application of surveillance on the Internet and particulary on social networks. I...
