The jurist and politician JuDr. František Veselý (1863-1935)

Mr. Frantisek Vesely was born on 18th of September 1863 in Jicin. He was the Jicin confectioner's first - born son and his mother origin was in the burgess family the Kraciks from Jicin. Frantisek's mother died in the year 1865. His father got married for the second time in same year. The father's confectionery did not prosper any more and that is why he left his second wife and their children and moved to Prague in 1873. Frantisek's grandmother from his mother side, who had a small business in Jicin, started to look after the little boy. After finishing the basic school Frantisek Vesely started to attend the grammar school in Jicin. He finished this study by leaving examination in the year 1881. That time secondary school director was Mr. Frantisek Lepar and the boy made friends with his two sons Vladislav and Zdenek. Frantisek used to give extra lessons to a younger student from grammar school Englbert Erben and he engaged with his sister Milada. In the meantime he works as well as clerk in the local law office, which influenced his future job selection. Frantisek's dreams included opening of his private law office and having family with his fiancée Milada Erbenova. Having finished secondary school in the year 1881 he left to Prague, where he studied law. He has finished his studies by getting the title...

Arbitration procedure in the Czech Republic

61 Resumé Arbitration Proceedings in the Czech Republic Arbitration proceedings represent an out-of-court method of settlement of property disputes. It allows the parties that their dispute can be heard and decided before arbitrators or a permanent arbitration court. The basic characteristic features of the arbitration proceedings consist in particular in their promptness, certain informality and in the fact that the dispute is heard and decided in a single instance. The result of the arbitration proceedings consists usually in rendering an arbitral award having the effect of a final and conclusive judicial decision granted by the law. The basic legal regulation of the arbitration proceedings in the Czech Republic is provided by Act No. 216/1994 Coll., on Arbitration and Enforcement of Arbitral awards ("Arbitration Act"). Only property-related disputes may be heard and decided in the arbitration proceedings, namely provided that such a dispute would otherwise fall within the jurisdiction of the courts of general jurisdiction and that the parties could resolve the subject-matter of such a dispute by conciliation. From the subject-matter of the arbitration proceedings, the Arbitration Act expressly excludes disputes resulting from bankruptcy or composition proceedings, disputes over enforcement of decisions...

Foundation and Origin of a Limited Partnership

It is very popular to enter a market as an entrepreneur in the Czech Republic today. A person should be knowledgeable about the Czech law and decide whether s/he intends to carry business either as a sole proprietor or as a corporation. This bachelor's work provides the information and advice how to start, when a business organization, concretely a limited partnership/Ltd., is going to be founded. There are going to be explained concrete steps that lead to a foundation and origin of a limited partnership in this work. Founders of a business organization need to form the Articles of Partnership at the beginning. They should also find suitable premises for their future corporation. The next step that is important to do is to get an entrepreneurial licence for that activity that the corporation will carry on. One of the most important steps to establish a company is to file a proposal for the incorporation of the business into the Register of Companies. When the business is registered in the Register of Companies, then it can perform its entrepreneurial activity according to the incorporation act. In case of a limited partnership/Ltd. the co-partner who is bound to a deposit duty should pay up his deposit as soon as possible after the business is incorporated. After reading the above instructions the reader may think that the establishment and origin of a company is quite easy. I hope s/he will recognize that it is necessary to be well informed about legal procedures for establishment of a business at the end of this bachelor's work. The mere existence of a company itself is not sufficient. The business must find its customers and reach its target. For that reason it is essential to create an entrepreneurial plan and a marketing strategy for a concrete company. Thus, an entrepreneur should combine the knowledge of law and economics if s/he wants to be successful in the market.

It is not possible to buy love, but sex can be bought - research on market of prostitution focused on subjects that represent market supply of prostitution

The bachelor essay deals with the influence of economic, legal, social and moral aspects on subjects that represent market supply of prostitution. At the beginning there are briefly described the reasons and substance of the shadow economy, there are also defined notion of prostitution and possible ways of this activity. The next part of the essay focuses on the market, subjects that represent market supply and market demand, legalization and taxation of prostitution. The theoretical part of bachelor essay also study the prostitution in Czech Republic and it's legal regulations, public notice, draft laws in 2005 and 2008. In practical part there are described research technique, target group and presumed intent of this essay. The information source for market research of prostitution in nightclubs is oral interview with prostitutes and with manager of disorderly house. The target of bachelor essay is to find out what has an influence on behaviour of prostitutes and their managers and to determine whether the market supply of prostitution will be changed.

Land use planning practices in Liberec

The bachelor's work is devoted to land use planning in Liberec. After theoretic introduction of the topic based on definitions, implications and conjuctions of land use planning, spatial development, strategic planning and regional policy I try to analyse socioekonomic, estate and land use charakteristics of town Liberec. The aim is to point out the most important specifics of town's lay out and asses the influence of land use plan, Construction Law, Strategy of town Liberec development in 2007-2020, community and decision making of authorities on features and aspekts of town area.

Unprofessional film-making and copyright law

Main goal of this work was to map the area of copyright law connected with nonprofessional film-making. Due to fast expansion of the internet and digital media, the number of non-professional film-makers is increasing rapidly. And copyright law is not able to react on this change. Temporary Czech copyright law is strongly developed, with strong position of colective administrators of copyrights. For non-professional use is this situation quite unsuitable. Copyright laws are too strict and complicated and collective administrators are focused on professional use. The result is massive infringement of copyright laws. One of the answers is the Creative Commons iniciative, which proposed few licenses, based od copyright laws. These licenses can be published along with the artwork to encourage potential user to use the work without asking permission. Author can choose what rights would be limited, for example commercial use, or making derivative works. This bachelors work proves that Creative Commons licenses are good choice for non-professional film-maker. They bring simplicity and null costs, in comparison with complicated and expensive licensing from collectively administrated rights.

Treatment of personal status in jurisdictions of selected Arab states

In my dissertation thesis I tried to explicate the fundamental institutes of Islamic family law, according to modern and contemporary legislation in a number of Arab states. The family law is fairly exhaustively treated in the sacred book of Muslims, in Koran, albeit in a number of scattered passages, mostly in suras from Medinese period. These passages are defined with more precision by the prestigeous method of the interpretation of Koran, with so called taj<;ir and thanks to collected statements of the Prophet Muhammad and his companions, constituting the tradition, so called swma. And the modern and contemporary legislation is based rigid on it with some westernized elements. After a brief acquaintance comprehension of the personal statute in contemporary Near Eastern countries is described in detail. The next chapter contains the description of the sense of marriage in Islamic law in three aspects- legal, social and religious. It is a contract of civil law concluded by the bridegroom with the legal guardian of the bride, so called wali.After this I continue through the short characterization of conditions of the conclusion of the marriage, for example form and capacity, limitations to marry any person of the opposite sex, special time period cidda ... The following part of thesis describes dissolution...

Ethical view on abortion and its legalization

The thesis deals with the question of abortion. It briefly introduces the history of abortion and definition of basic terms. Further, it describes basic procedures for the implementation of abortion, pontential health problems, and mentions the Hippocratic Oath, too. More attention is then paid to the abortion legislation in the Czech Republic, including the current legislative texts, criminal responsibility, but also facts associated with the restrictions on abortion law. The thesis brings information, which characterizes ethics as a scientific discipline and its view on abortion. Finally, there are also mentioned basic differences between adoption and foster care, as well as other ways how to solve unwanted pregnancies.

The Employment of Clients of the Halfway House

This Bachelor thesis is called The Employment of Clients of the Halfway House. The theoretical part consists of three areas which describe the services of the Halfway House, the characteristics of its clients and also the possibilities of searching work. The practical part is focused on the research itself, used methodology, obtained results and discussion. The Halfway House is oriented on young people till they are 26 years old and who leave state school facilities for institutional protective upbringing once they reach a legal age. The other groups which this service is oriented on are people who are released from their sentence or from protective treatment. Last but not least, these houses are also intended for young people who suddenly find themselves in an unfavorable life situation which they are not capable to deal with on their own. The Halfway House provides accommodation at a reduced price, advisory and they also try to make the transition of their clients from institutional environment a little bit easier. During this transition, the people have to face many problems and searching for work is only one of them. Thanks to the institutional upbringing, they lack work habits, tend to be more psychically unstable and they usually have more issues with getting into new relationships. Current situation on labour market when the labour supply highly exceeds labour demand and the job offer is quite limited obviously does not benefit to the situation of these people. The aim of this thesis was to map the situation of the clients of the Halfway House and also to answer the research question what problems on the labour market these young people usually face. I chose a qualitative research to gather required data. As a methodology, I used interviewing with a usage of half-structured technique and a method of document analysis with the help of content analysis data technique. The research was performed with twelve people, four respondents were social workers from the Halfway House and other eight people were clients of these providers from whom three were unemployed. Three respondents came to these facilities from upbringing institution and the rest were from children?s home. Two respondents had only basic education, five respondents reached secondary education with certificate of apprenticeship and one respondent had a secondary education with leaving exam. The output of this research is a finding that situation of clients of the Halfway House is unfavorable at current conditions. To find a job, they use internet, job offers in magazines, personal contact with companies, acquaintances and job agencies. During the time they are unemployed, they are obliged to be registered at the Employment Office of the Czech Republic. The social worker stated that other problems the clients encounter on labour market, besides lack of work habits, unstable psyche, low communication skills, were incorporation into work society, solving of conflict situation with co-workers and high salary expectations. Clients themselves stated that the problems on labour market for them were high education expectations from the employers, complications with curriculum vitae compilation and writing of motivation letter. Two respondents also saw the problem in their ethnic membership and as a reason for their unemployment stated discrimination of a society. None of the respondents stated that was discriminated due to their institutional past. In my opinion, it is important to show the facilities like the Halfway House and social issues of young people who try to integrate themselves to a normal life after leaving institutional facilities because it is important to raise public awareness regarding this topic. This thesis can serve as a study material for students of social-law branches and also as a feedback for social worker of the Halfway House.
