International impact of unilateral declaration of independence of Kosovo

My goal was to attempt to analyze impact of Kosovo crisis on international relations. Kosovo issue and its solutions have shaped two important principles of international relations in the last decade, which by repeating tend to become precedents. The first principle is humanitarian intervention without the mandate of UN, which was first applied in Yugoslavia in 1999. Similar action was applied in several different states during the last decade. Second principle, which is the main subject of my thesis, is unilateral declaration of independence which was recognized by more sovereign states then in previous occasions. By analysis of events in Georgia I tried to prove that separatism could become an instrument of international relations in future. Authority of UN is shaken in last decade and it could lead to reshaping of world order. Single-sided interpretation of morality and principles can replace international law. Apart from analyzing global impact of Kosovo crises I have tried to explore the problem in detail by researching the causes that let to conflict. Most of the attention I have devoted to period between 1974 and 1999, which I find crucial in the forming a situation that led to unilateral declaration in 2008. Liability for damage in case of occupational injuries and occupational diseases

The intention of my thesis is to analyse legal provisions concerning occupational injuries and occupational diseases, comment amendments in this area of labour law and indicate meaning and content of above mentioned legal provisions in connection with court decisions and practical facts. The entire text is structured into chapters relating to particular topics connected with occupational injuries and diseases. At first the thesis introduces concept of liability with specifics that influence area of occupational injuries and diseases. Subsequent chapter contemplates recent events and system of legal insurance of employer's liability. Fourth chapter describes provisions implementing prevention of occupational injury and disease. Fifth chapter defines conception of occupational injury and occupational disease in detail, elaborates characteristic features, prerequisites, process of solving and possibility of employer's exemption. Sixth chapter reflects findings relevant to compensations provided to affected employee. Result of processing the topic is composed of comprehensive characterization of main terms and issues, with effort to indicate explanation of respective judgements and consider selected legal provisions.

Preliminary measures in international procedural law

The title of this diploma thesis is "Provisional Measure in International Procedural Law". The purpose of provisional measures is a preservation of the rights of each party pending the settlement of the dispute which means pending the definitive decision in the case. It helps to protect the object of the litigation and to maintain in its state as it existed on the initiation of the proceedings. Furthermore, the function is a preservation of the integrity of the final judgment and the prevention of violent self-help. I chose the issue of provisional measures as a topic of my diploma thesis because it is an essential instrument to enable any international court or tribunal to perform its functions. The aim of the thesis is to analyze law containing provisions relating to order of provisional measures and practice of particular international courts and tribunals. The diploma thesis is divided into five chapters. First chapter defines provisional measure and explains its using in International Procedural Law. Second chapter focuses on the exercise of provisional measures in international arbitration especially in respect to proceedings before the International Centre for Settlement of Investment Disputes. Technical equipment of fire protection for the decontamination of people and technology.

This bachelor thesis is describing problems regarding technical equipment of fire-brigade units while decontaminating citizens and technology not in the state of war within the Czech Republic territory. Based on the national conditions this thesis is specializing in the civil area. It stresses out the need of the Czech fire-brigade units to be prepared for decontamination of citizens from dangerous substances in case of emergencies, accidents but also in case of a terrorist attack. This thesis is also taking into account the possibility of setting in the special Czech Army units. Theoretical part of the bachelor thesis is an introduction into the topic, defines historical events connected with the need of decontamination and in general people's comprehension of decontamination of not only themselves but also everything around them and surrounding them. This is obviously closely connected to contamination without which the decontamination would not have been possible. Decontamination chapter contains basic definitions, defining basic procedures including chemical substances used for decontamination with connection to detection and identification of substances, definition of operation and protection area. The description of forces and equipment used for decontamination is in the last chapter of the theoretical part of the thesis. It also mentions the laws of the concerned topic and location of the above mentioned units within the Czech Republic. Research problems and procedure of the thesis has been set up in the second, practical part. Its aim is the compare two different citizen and technology decontamination techniques which are used as a part of equipment of rescue units in the Czech Republic. It is also possible for those two techniques to participate on the same emergency event and based on one-generation distance between those two techniques the main question was perfectly clear from the beginning. Is the new technology used by the Czech fire-brigade units better than the old one, or modernised technology of the Czech Army Forces, considering it as the first solution to special emergency events within all given and defined aspects? Because there are limited technical information available and also not that many units used by the Czech fire-brigade certain types of decontamination lines had to be taken out of the study, such as SDO-A, SDO-1A and SDO-Z, therefor the outcome of this thesis cannot be interpreted unambiguously. Regarding the Czech Army Forces for the research part there was only type of decontamination of citizens used and presented. The rescue teams are currently using two decontamination lines which were compared within the comparison decontamination techniques study. The Integrated Rescue System in the Czech Republic is prepared for mass citizen-and-technology decontamination in both, material and educational, ways based on technical data given in the discussions present in the research part of the thesis. The concerned workers have also mentioned that there are specific trainings missing to crosscheck the whole technology within extreme conditions. We also came across the knowledge of a lot of problematic parts and incomplete systems, this information was given to us directly by the field-workers. The findings based on the research are presented at the end of the thesis as recommendations for practical use and improvement for current situation in case of mass-decontamination in the Czech Republic.

Railway Tracks Possessions Analysis

The thesis deals with describing, evaluating, and proposing of possible changes in planning, placement and describing possession activities on railway lines in order to improve transmission and quality of the services provided by the SŽDC. The first chapter describes the environment of rail transport focusing mainly on law and regulations. The second chapter describes the aim of the study, additional category focuses on describing the method of processing of materials. The fifth chapter focuses on selected lines to describe the various closures in specific line sections. Sixth chapter aims on comparison methods of implementation lockout activities on examined lines. The last chapter has to summarize and evaluate results to submit any additional recommendations.

Selected legal issues of international passenger transport The topic of the diploma thesis is 'selected legal issues of international passenger transport'. The aim of the thesis is to analyse the issues of substantive law related to the liability of carriers and rights of passengers in the international rail, road and air transport. The thesis focuses on applicable legislation of liability of carriers and rights of passengers, but also deals with the legislation proposed pro futuro. The diploma thesis is divided into seven chapters, further divided into subchapters. In the introduction the thesis defines the term 'international passenger transport' and summarises its key legal sources. Further, it addresses the conflict of law rules applicable to the contract on international passenger transport. The core of the thesis is in the following chapters that deal with the direct substantive rules governing the liability of carriers and rights of passengers in individual types of transport, which are contained especially in multilateral international conventions and secondary legislation of the European Union. Cross-border transformations of commercial companies

This thesis discusses a method of implementation of the freedom of company establishment in the form of cross-border transformations after the amendment of the Transformation Act, which came into force on 1 January 2012. This right which a company is guaranteed is analyzed in the context of relevant CJEU case law. This thesis follows the structure of the Act. The first part deals with general issues of cross-border transformations and is followed by a chapter on the types of cross-border transformations. The final part of this thesis is devoted to a discussion about the possible kinds of economic movation for the tranformations. The goal is to analyze the possibilities of cross-border transformations and to assess their historical development with respect to both major CJEU decisions and legislative activities of the EU and the Czech Republic.

A comparison of ways to ensure autonomous services in public interest by municipalities with extended powers

The main aim of this work is to analyze approache of different methods providing public goods in the public interest by municipalities with extended powers in the Czech Republic. In addition to the characteristics of individual methods the work focuses on legislation, particularly the new regulation on public procurement under the Act no. 134/2016 Coll., On public procurement. The aim of this study is to compare internal regulations of local governments for the procurement of small scale, beyond what the law requires. It refers to the release of the required transparency in these processes and the associated increase in administrative burdens for procurers and suppliers of public procurement.

The appraisal of development of tax proportion of budgetary incomes of municipalities and regions in the Czech Republic

The aim of this diploma thesis is a detailed analysis of tax incomes of municipalities and regions with focus on four particular municipalities and one region in a practical part. From the year 2001 to 2015 the share of tax incomes and their development are evaluated as a part of total incomes. The theme is highly topical due to ongoing discussions among lawmakers on the subject of budgetary allocation of taxes. The law determining the budgetary allocation of taxes is modified frequently, that is why knowing the impact of changes on particular municipalities or regions is helpful. This knowledge can be useful base for planning new adjustments of budgetary allocation of taxes. In the theoretical part there are mentioned expert opinions on financial management of municipalities and regions that arise from their functions and positions. The emphasis is put on incomes of municipalities and regions, especially on tax incomes. Particular changes from 2001 to 2015 in law regulating budgetary allocation of taxes are described here with their impacts on municipalities and regions. Incomes and management of selected municipalities representing various size categories and Liberec region are analysed in the practical part. Financial self-sufficiency is evaluated here. In general municipalities are more financial self-sufficient than regions. This thesis is further dealing with individual tax incomes and impacts of changes in budgetary allocation of taxes on their size. Making models of theoretical incomes is used to simulate effects of diverse law adjustments. Results of the analysis show that tax incomes of municipalities and regions are generally increasing. During the observed period there was tendency to lower the growth of tax incomes of large cities, to increase the growth of tax incomes of small municipalities and to straighten the level of tax incomes of medium municipalities thanks to changes in budgetary allocation of taxes. Tax incomes of regions were increased thanks to changes in budgetary allocation of taxes despite of partial decrease in particular segments of tax incomes after 2012.

Male and Female Identity in Contemporary Society Focusing on the Labor Market

The aim of the master's thesis is to describe male and female identity in today's society. The first chapter includes basic expressions connected with key terms gender and gender stereotypes. This thesis is focusing on equality of genders and the enshrinement of equality rights in law. This thesis also includes the analysis of the current status of women in the European Union based on data from the Eurobarometer and the Czech Statistical Office survey. The aim of the graduation thesis is to analyse the perception of men and women in today's society, to determine how strongly are stereotypical perceptions rooted in society, how is perceived the equality of men and women in labour market and how opinions on this issue differ among Czech Republic citizens and among European Union citizens.
