Analysis of the WTO Dispute DS 335 (US Antidumping Measure on Shrimp from Ecuador)

Bachelor dissertation analyzes in detail the WTO dispute DS 335 on US antidumping measure on shrimp imports from Ecuador and particularly the practice of "zeroing". The thesis places the dispute in the context of international trade in shrimp, analyzes reasons that led to its opening, i.e. differences between the rules for the antidumping investigation set in the WTO Antidumping Agreement and the rules in force in the US. The thesis evaluates, above all, the consequences resulting from the dispute for the parties as well as the international trade, since the Panel Report was issued until present.

NATO in the fight against terrorism and the formation of collective identity

Diploma thesis "NATO in the fight against terrorism and the formation of collective identity" deals with the impact of the threat of international terrorism on collective identity of the North Atlantic Treaty Organization. The September 11th terrorist attacks on the US soil constitute a milestone in the history of NATO. The article 5 of Washington treaty was invocated for the first time. The main argument of the thesis states that, despite disagreements among allies about the role of the Alliance in the fight against terrorism after the September 11th , NATO was capable of reinforcing its collective identity and reformulating its purpose. The main goal of the thesis is to define a relationship between the perception of the threat of terrorism within NATO and collective identity of NATO, on the basis of arguments of social constructivism and with constructivist methodology. Discourse analysis of key NATO documents confirms the impact of September 11th on the transformation of strategic consideration of the Alliance, which has led to initiation of several efforts to fight terrorism. Outcomes of discourse analysis of United States, United Kingdom, France, Czech Republic and Poland reveal that terrorism has reinforced collective identity among NATO member states and has become a new threat for Alliance...

Analysis of the issue of entry of foreign companies in the Saudi market

This thesis analyzes religious, social and cultural norms, describes economic and trade negotiations specifics of Saudi Arabia and provides advices in connection with business opportunities for potential business partners. In first part of the thesis I focus on general information about Saudi Arabia (geography, population, religion, education systém, role of media) and on constitutional origins, constitution, criminal proceedings and criminality in the Kingdom. In the second part I look at Saudi Arabia from an economic point of view and describe basic macroeconomical indicators, situation in various sectors of the Saudi economy, development of the Saudi state budget and national debts. I also analyze position of the country in international trade and its economic cooperation with the Czech Republic. The third part is devoted to the cultural specifics of Saudi Arabia, such as position of women in society, sexual segregation, way of dress, lifestyle or the Saudi approach to work. In the fourth part, I turned attention to the pitfalls of business negotiation with Saudi partners, focusing on the issue of donation etiquette, greetings and inappropriate conversational topics. The last part is devoted to the results of my research, which outline Saudi preferences for commercial negotiation, shopping or the best method of communication.

The influence of selected ECJ judgements on the forming of common commercial policy of EU

The goal of my diploma thesis is to describe the influence of ECJ decision making on the common commercial policy ("CCP") of EU. Specifically my thesis examines what factors influence ECJ decision making about direct effect of trade agreements implementing CCP. These factors are applied on several treaties, where the court has not yet decided on their potential direct effect and on a present case at ECJ on direct effect of WTO treaties. With regard to the goal of my thesis an important part of my thesis deals with the development of ECJ decision making. Methods applied in my thesis are analysis and comparison of selected judgements that influence the CCP of EU. After proper analysis I found out that the main motiv behind ECJ decision making is that, if the negotiating position of EU is to be deteriorated, the ECJ is likely to find that the treaty does not have direct effect. Other factors are of secondary character. Examining the influence of decision making of ECJ on direct effect of trade agreements is important, because the role of ECJ influences the legal certainty of subjects about direct applicability of international trade treaties.

International Trade in Textiles - chosen aspects

Principal aim of this work is to analyze the impacts of both protectionism and liberalisation in international trade in textiles during the second half of 20th century and the beginning of 21st century. In the first chapter, there is explained the beginning of quantitative restrictions in trade in 1960s as a consequence of Arrangement regarding International Trade in Cotton Textiles. The second chapter deals with the Multifibre Arrangement, its renewal and especially the role of the European Community in the MFA system. At the end, there is depicted the integration of the MFA Arrangement into the GATT system. In the third chapter, there is defined the process of integrating textile products through Agreement on Textiles and Clothing into the liberalized system under WTO rules. The fourth chapter deals with the current situation after the removal of quotas on textile imports and subsequent renewal of restrictions on imports of Chinese textiles till the beginning of December 2008. In the last chapter, there are introduces consequences of Multifibre Arrangement and Agreement on Textiles and Clothing on chosen economies.

The regulation of asylum law after the Lisbon Treaty entered into force

The aim of the thesis is to analyse asylum law of the European Union with focus on the changes, which introduced the Treaty of Lisbon. The paper describes development of the EU asylum law, establishing of the Common European Asylum System (CAES) and changes that Lisbon Treaty introduced in comparison with the former regulation. The text also deals with the right to asylum, which is established in the Charter of Fundamental Rights of the EU. The thesis is divided into 7 chapters. In the first part of the paper the author follows historical development of the asylum law of the European Union and beginning of the harmonization until adoption of the Amsterdam Treaty. The second chapter is dedicated to the establishment of the CAES, which more than 10 years ago became main priority of the asylum policy of the EU and which aims to harmonize asylum laws of the Member States and therefore ensure a unified application not only of international, but also of European legislation from this area. Recent major changes in the structure and functioning of the European Union, which were introduced by the Lisbon Treaty, are in general outlined in the third chapter of this paper. The Impact of the Khmer Rouge Rule on the Stability and Position of Cambodia in the Region

My work refers to the modern history of Cambodia and the region of Indochina with the accent on the Khmer Rouge regime. It explores the topic of the impact of the Khmer Rouge regime on three levels- local, regional and global. It gives a brief outline of the historical development from the war of independence to the peace talks in the 1980s. It covers some key historical events, e.g. the Lon Nol's coup d'état in 1970, followed by the Khmer Rouge takeover in 1975, the genocide regime, the response of the neighbouring countries, the Vietnamese invasion in 1978, the establishment of The People's Republic of Kampuchea, reconstruction, peace efforts. It deals with both domestic development and the international and diplomatic relations as well. The work also studies the impact of the volatile Cambodian history on the region and the response of the bi-polar world of the 1970s and 1980s, in the context of the Cold War, primarily of the USA, the Soviet Union and China. It attempts to reveal the Khmer Rouge doctrines, the nature, characteristics and origin of their extremist ideology, the connection with global communist teaching. It also focuses on the aspect of the international law. Other topics mentioned in the work are refugee issues and international tribunals.

Accounting for products of Financial Markets department at ING Bank

The banking industry is without a doubt one of the most innovative segments. Its products are continuously evolving with the advent of new technologies, globalization, competition and regulation. IASB attempt to capture what is happening to modify IFRS. On the other hand bank's lobbying actions can also be seen on countless amendments to International Accounting Standard on financial instruments. Therefore, IAS 39 has become difficult to understand, apply and interpret and thus IASB developed a new exposure draft IFRS 9. This diploma thesis compares Czech Accounting Standards, IAS 39 and IFRS 9 for derivatives, bonds and repurchasing agreements, focusing on their different classification, the concept of fair value and own credit risk. The practical part is based on products of Financial Markets department at ING Bank. Finally, it outlined the latest developments in the convergence process between IFRS and U.S. GAAP relating to the issues described.

The Compliance of Legal Environmental Standards in South Bohemia

The aim of the diploma thesis is to assess the compliance of environmental standards in South Bohemia, as well as to evaluate the changes concerning environmental polluters and the condition of South Bohemian environment in last 10 years. The first section is focused on the theoretical attitudes towards environment. General environmental instruments and their practical use in Czech legislation are discussed together with the comparison of the environmental development before and after joining the European Union. Furthermore this section deals with the topic of national and international institutions engaged in the environmental protection. The practical section defines the administrative area of South Bohemia and subsequently analyses the environmental condition in given period of time. Thereafter, the development of the most significant polluters in last 10 years is established with the comparison method. Based on the studies applied, the thesis proposes the way to improve the environmental condition in South Bohemia, discusses the results and follows with the evaluation of the environmental compliance in the examined area.
