Statute of limitations of a plea concerning the voidability of a will as part of inheritance proceedings Abstract This thesis deals with the possible statute of limitations of a plea concerning the voidability of a will as part of inheritance proceedings or, as the case may be, identification of the conditions under which such statute of limitations is possible, since this becomes a current issue in a situation when there is an increase in the number of drawn up wills and length of inheritance proceedings. The thesis describes related legal institutions, including an analysis of related case law, and is applied to a specific case, whereas the author concludes that the statute of limitations of a plea concerning the voidability of a will as part of inheritance proceedings is possible, when the limitation period commences on the day that a disinherited descendant provably learned of the existence of a will and not the drawing up of a will or death of the testate. The author's conclusion, to a considerable extent, contradicts the very latest judgement of the Supreme Court of the Czech Republic which is also analysed in the thesis. Testament with a special focus on fideicomissum

This rigorous work deals with the testamentary succession which is complemented with a new institute within the law of succession regulation - fideicommissum. The content of the work is divided into five main chapters whereas it is proceeded from general interpretation of law of succession taking into account history because above all the law of succession it one of the branches of the Civil Law which was a subject of great changes within the re-enactment of the Civil Law and it is getting back to the institutes which the existing legal regulation did not know. The introduction addresses explanation of basic terminology within the matter of law of succession; it elaborates fundamentals, principles and functions of the law of succession and its categorization within the legal regulation. A part of the work which is dedicated to the historical interpretation focuses on regulation of the testamentary lineage in the Roman law and then analyzes testament regulation within the General Civil Code, Civil Code No. 141/1950 Sb. and preceding Civil Code No. 40/1964 Sb. Legacy in law of succession

The present thesis discusses the legislation of an ancient and new-old institute of inheritance law, legacy. Legacy was in the Czech legal environment in the 60's of the last century as a traditional institute of inheritance law, allowing the testator wide opportunities of acquiring his property mortis causa. With the effectiveness of the Civil Code No. 40/1964 Coll., that released its regulation, completely disappeared from the public's legal awareness. The topic of the legacy became recurrent in connection with the recodification of private law, because adoption of Civil Code No. 89/2012 Coll. caused a return of legacy to the Czech law. The specificity of the legacy is its disruption with universal succession, which is otherwise typical for inheritance law. The main objective of the thesis is to evaluate the legacy and to conclude about the quality of the current legislation and its usefulness for legal practice. The secondary objective is to acquaint readers with the legacy and define its position in the legal environment. Testamentary succession Key-words: inheritance, inheritance proceeding, notarial registration, public record, successi- on, testament. Abstract This rigorous thesis deals with the questions of testamentary succession. These problems re- present main section of law of succession and they are also very actual in the context of a new legal form respecting freedom of the testator will. The thesis aims to provide reader compact and practical view on testamentary succession and analyze especially polemic questions, which are problematic in practice. The thesis issues not only from the study of contemporary literature and practise of the courts, but also closely explore historical legal forms, especially legal form included in General Civil Code. With this is connected analysis of authentic literature and practice of the courts (e. k. Supreme Court from 1859−1915 and Supreme Court of Czechoslovak republic from 1919− 1948). Last but not least the thesis gathers from the wide variety of foreign sources and offers comparison with the similar legal forms like Austrian, German and Swiss. The main goal of this thesis is the complex description of the testament. The problems of this ancient and utmost important instrument of law, which is given to the testator to decide who will get his property after his death, is comprehensively described in the five chapters of this work. This thesis mainly focuses on the key element in the Czech civil law of current time, which is the new civil code that brings severe changes especially to the hereditary law. Major differences can be seen especially in comparison with the so called socialistic civil codes. The new civil law regulation surpasses the ideologically motivated and oversimplified provisions of these old laws. The most important changes are bound with the new basic principles, especially with the testator's will as a leading principle of the hereditary law. This principle is in fact mostly applied in the testament law; therefore the new civil code has great impact on the examined topic. The will of the testator under the new Civil Code

The subject of my diploma thesis is to show in detail and describe the basic institutes of inheritance with regards to the autonomous will of the testator, according to the Civic Code after the recodification in force since 1.1.2014. With regards to significant and extensive changes of the means, with which the testator can manage the treatment of the inheritance mortis causa, I considered this subject relevant and that is why I chose it. I tried to supplant a wholesome view of the possibilities open to testators in case they decide to change the division of their property out of the lawful hereditary succession. The thesis is divided into six chapters that contain the history of inheritance in our country, basic terms, reasons for the creation of the current codex, institutes governing the transition of the estate to the legal successor and the largest part explains the inheritance titles according to the changes brought about by the alteration of the civil law. V ANGLICKÉM JAZYCE The aim of my thesis was to carry out a detailed analysis of one of the most important institutions of the law of succession - testament. My secondary objective was to compare briefly the Czech legislation of testament with the legislation of Germany, which was one of the sources of inspiration for the Czech recodification works. Legislation of this institute after the adoption of the Civil Code significantly transformed and strengthened the testing freedom of the testator. Testament is one of the three forms of testamentary disposition that make it possible for the testator to decide how his property is going to be managed after his death. The first of the six chapters deals generally with law of succession, explains the key terms, concepts and important leading principles. Furthermore this chapter presents various prerequisites of inheritance and generally characterizes and defines the institute of testament. The thesis debates one of the modes of succession, namely testamentary succession. A testament is, in accordance with Law No. 89/2012 of the Civil Code, one of the dispositions mortis causa. Inheritance contract and testamentary clause on legacy, along with testament, belong among dispositions mortis causa according to the law cited. The deceased exercises his or her will through such. The target of this work is to describe the current form of testamentary succession in its effective rule, focusing on facultative elements of a testament. The work is divided into six chapters. The opening chapter contains a discussion on succession rights, first in general and then the requirements of the creation of succession rights follow, as well as the other inheritance titles in their effective rule. The second chapter defines a brief excursion into the Roman law. In the subchapters, individual testament forms in the Roman law, testamentary competence, succession against testament, revocation and nullity of testament are included. Testamentary disposition - recent legal regulation and regulation in the new Civil Code The theme of this thesis are testamentary dispositions, therefor such legal acts, by which the testator still during his lifetime decides how to be loaded with his property after his death and who then become his heirs. My main purpose in writing this thesis was to try to compare the current legislation (Act No. 40/1964 Coll.) with the legislation, which brings the new Civil Code (Act No. 89/2012 Coll. effective from 1.1.2014). The text of the thesis consists of eight sections, i.e. introduction, six chapters and final summary. Introduction acquaints the reader with the regulation of the succession law, presents the heritage titles, and brings the general characteristics of the testamentary disposition. The following four chapters are devoted above all to the regulation of the will as a traditional institute, which is used for the acquisition of the inheritance, and they focus on the testator, formalities and essentials of the will, and its cancellation.
