Free software licenses

The aim of this bachelor thesis is to deal with the topics related to public software licenses, their use, their properties in the form of specific contractual agreements (license aspects), mutual compatibility and followingly take this information and systemize it of a form of an information portal, which is the practical output of this thesis. At the beginning of the thesis, the current issue of why public software licenses are used today and how they are legally perceived is examined. Emphasis is placed on Czech law in the context of civil code and copyright law and with them associated licensing agreements, since the vast majority of the license terms of the world-wide used free software licenses is only written in English, and the terminology is based on the United States legal system. Consequently, the nomenclature and the necessary terms for working with the license terms are unified. In the main part of the thesis specific licenses are selected according to their relative usage and their characteristics based on relevant market surveys. These chosen licenses and their license agreements are analyzed more in-depth. Specific contractual agreements of said license agreements are expanded upon whilst being named in the thesis as “license aspects”. In the practical part of the thesis is described a solution for a web information portal, which should serve the laic as an initial view on the issue of public software licenses. The site addresses the issues of selecting a specific public software license for its original work (software), introducing specific licenses and comparing them based on analyzed licensing aspects, compatibility of more public software licenses in a larger composite software unit in which the individual software components of the whole are licensed under various public software licenses. Also, the consequences of choosing one of the selected public software licenses for the future of the software are described. At the end of the thesis, the vision of the future information portal, its expansion with other functionalities and its overall possible improvement based on feedback from the public are also presented.
Natural monopolies in Electricity and Gas Sectors (the legal aspects)

The purpose of this diploma thesis is to use relevant economic knowledge for the analysis of the key legal aspects of the natural monopoly, particularly the main theoretical aspects thereto. The interpretation is not limited to principle features, however, it covers also the related issues. The text is focused mainly on electricity and gas industries. Apart from applicable law and legal books, the relevant case law of the Constitutional Court and Supreme Administrative Court of Czech Republic has been also a significant source of knowledge hereto. The European Union legal regulations and expert opinions of the European Commission have been taken into account as well. The diploma thesis is divided into five chapters. The first chapter is focused on economic aspects of the applicable law. It provides thorough overview concerning the model and its introduction into reviewed fields. The principal information, historical background and view of the critics are introduced. This chapter also labels the entities under the Czech law that are considered to be the natural monopolies. Trade in military material: the Czech and Slovak law perspective

This thesis focuses on the mutual comparison of the Czech and Slovak legislation in field of international trade in military material and its purposes is to identify which one of the legislations is more arms businessmen friendly in terms of legally-administrative costingness. The paper consists of three main parts. The first part is dedicated to the theoretic frame of the legal regulations in question with emphasis on the private international law. It contains the definitions of the well-known terms such as arms, trade in arms or military material. The second part focuses on international legal basics of the issue in question with respect to the most noted international treaties or key European regulation forming core of the trade in military material. The third part of the thesis compares the acts on international trade with military material in the Czech and Slovak Republic.
License Agreements concerning trademarks

The thesis deals with license agreements in relation to trademarks, specially the trademark license agreement. The thesis contains in its theoretical interpretation of the concept and sources of the license agreement. There are also analyzed various types of license agreements, including modifying the license agreement in the new Civil Code, and related types of contracts as a franchising or merchandising. Another interpretation is more concerned with trademark and trademark license agreement with regards to contentious issues. The part of the thesis are some of the issues of competition law and criminal law in connection with trademarks.
Legal limits of the cross-border movement of military materials

Legal limits of the cross-border movement of military materials The global trade with military materials is an important, however often under- researched, area of academic enquiry. Such attitude is not correct, because in fact it is a massive global industry in which also Czech companies play a significant role. Given the newspaper headlines and statements of arms dealer, it is obvious there have long been unsolved problems burdening arms dealers caused especially by an inappropriate legal framework. This theses aims to provide an analysis of legal framework in respect to cross-border movement of military materials covering especially European and Czech legislation focusing on its potential limits arising and important for arms dealers. On a global international level the Arms Trade Treaty and other relevant treaties regulating international trade with military materials are identified and described. Attention is also paid to limitations of arms trade such as embargoes or restrictive measures imposed by the UN and the EU respectively as well as to limitations resulting from domestic and European legislation or from its different interpretation. Agreements and contracts withing copyright law

CONTRACTUAL COPYRIGHT LAW This thesis is dedicated to the Czech Copyright Law, which is part of Intellectual Property Law. The core of this work is lying on description and recognition of contractual concepts of Copyright Law in Czech Republic, namely the last two Copyright Acts. The first Copyright Act was valid from 1965 till 2000. The second Copyright Act is effective since 2000. Chapter 1 covers the sources of Czech Contractual Copyright Law on different levels, from the constitutional grounds to the regulations. Chapters 2 and 3 are initial introduction to the Intellectual Property Law. It provides basic explanation of intangible property terms. Chapter 4 tries to briefly show the history and the development of the Copyright Law on the Czech territory, particularly Czech Contractual Copyright Law. Chapter 5 deals with provisions of Copyright Act 35/1965. It concentrates on contracts for the distribution of a work and contracts to produce a work. Chapter 6 is devoted to the effective czech Copyright Act 121/2000 and its provisions related to contractual law. With short notice about contract for a work done. Summary: Contractual copyright law The aim of this thesis is to analyse the current state of regulation of contractual copyright law in the Czech Republic. I have chosen this topic, because I am an amateur photographer and knowledge of different kinds of contracts dealing with copyright might be very useful for me in the future. Knowing most of details affecting final conditions of the contract is the best way, how to exploit my work well, and, what is even more important, I should be able to answer all of questions concerning copyright to my friends (and, in later, professional life, also to my clients). The thesis is thematically divided into seven chapters. The first chapter is introductory and outlines all the content, which is to be dealt with in latter text. It attempts to define the position of copyright in the Czech legal system. Chapter Two focuses on the grounds of contractual techniques and the way of their implementation in the basic civil codex. Layout of Tools to Restrict Software Piracy

I will try to solve and point to current problems connected with piracy in software industry in my project. I will do analysis of actual situation based on information sources. My suggestions will be made by backward synthesis which should show optimal solution as well as how software piracy reduces to minimum also how to defend and prevent against it.
Information System for Software Licences

This work treats the creation of an information system for software license management. The ordering company is Codasip, which deals with processor manufacturing and creation of related software tools. This company has been using its web portal and licenses management system is its expanding module. That is why the source code of the project is written, as well as the original web interface, in PHP language, using the Nette Framework. Moreover there is the LM-X technology of software licensig described here and so the deployment in a rival solution. The specifications of the product by X-Formation and Codasip's requirements are setting the basics for license system design. The design itself and the description of the implementation according to MVP design pattern, are part of this work.
