Postauditing in the EIA process

ABSTACT Environmental impact assessment (EIA) is an integral part of the protection of the environment. Although it is a tool which considers the impact on many different elements of the environment, the process also has many deficiencies. Because of its limitations, an audit has been forming since the beginning of EIA. An EIA audit evaluates the performance of an EIA by comparing actual impacts detected after the realization of the project to those that were predicted, those that were listed in the environmental impact statement. This paper will offer an insight into the EIA and the post-auditing process and contains three basic parts of these areas. The first part explores the EIA, its historical evolution and application in the Czech Republic. The second part will discuss the post-audit itself. In this part, the different post-auditing processes, which were carried out in different parts of the world, were chosen. Within the selected post-auditing, the predicted data from the environmental impact statements are statistically compared with resultant data from reality. It is therefore necessary to analyze the percentage given for how many predictions were wrong in a positive way, accurate or wrong in negative way. Land-use planning as a tool for environmental protection

My thesis deals with town and country planning as a tool for environmental protection. It is necessary to take into consideration the environment impacts by procurement and issuing the planning documents and to make available tools to protect the environment in this process. The second chapter defines the term town and country planning and describes its objectives and tasks. I described the history of legislation and focused on the principles of the current legislation. The last part of this chapter considers with the powers in town and country planning activities. The third chapter contains the characteristics of individual tools of town and country planning and process of procurement and issuing of these documents. It includes the planning materials, the spatial development policy as a statewide conception, spatial development principles issued on regional level, local plan as a basic instrument determining conception of municipality development and protection of its values and the regulatory plan. Territorial Procedure in view of the Environmental Impact Assessment

The main theme of this diploma work is the characteristic and analysis of the placement of buildings under the Building act with relation to the assessment of the influence on the Environment according to the current legislation that came into force on 1 April 2015 by Act no. 39/2015 Coll., amending Act no. 100/2001 Coll., on the assessment of the environment. In theoretical part, we discuss the ways the buildings are placed, participants of regional governance, administrative proceedings and zoning decision. Furthermore, the thesis describes the difference between land use management plan for the building, which are not subject to the assessment of environmental impact and intent, which is subject to this assessment. The practical part contains the case study and the comparison of individual Territorial managements pointing to shortcomings of the legislation, which can cause complications and slowing the whole planning procedure.

This bachelor thesis describes the process of assessment of environmental impacts from their inception to the present. It deals with the procedures of the EIA and SEA, which are analyzed by legislative norms and laws. Further, there are specified principles and processes of individual phases for comparing both methods. In the practical part, this process is demonstrated on biogas plants, which are subject to assessment under Act no. 100/2001 Coll. The concluding part of this thesis discusses the analysis of the evolution of biogas plants in the Czech Republic in the years 2002 - 2015. This illustrates the huge boom of buildings producing biogas.
Environmental impact assessment (EIA) in european law

The main goal of this diploma thesis, called Environmental impact assessment (EIA) in european law, is to explain the procedure of environmental impact assessment. Emphasis of this diploma thesis is placed on legislation dealing with the environmental impact assessment and its development. The diploma thesis is divided into five chapters, further it contains the introduction, the conclusion, the list of abbreviation, the list of pictures, attachement and the list of literature. Chapter one defines the environmental impact assessment itself and distinguishes the project (EIA) and strategic (SEA) assessment. Chapter two describes the international law concerning the environmental impact assessment. The most important part of this diploma thesis is chapter three, which contains the analysis of european and czech legislation regarding to the environmental impact assessment. The czech legislation is then compared to legislation of other member states of the EU. Chapter four characterizes the procedure of environmental impact assessment within the Natura 2000. Chapter five analyses the case Temelín with respect to environmental impact assessment.
National and EU Legislation in the Field of the Environmental Impact Assessment

The aim of the bachelor thesis is to summarize and descript the current legislation concerning the process of the Environment Impact Assessment (EIA) in the Czech Republic. The basis of the thesis is the description of the relevant legal provisions of the EIA on the EU level, which should be - due to the accession of the Czech Republic to the EU - transposed into the national legal order. On this background the compatibility of the national legislation with the EU rules has been assessed. The thesis is divided into five sections. The first section contains the description of the main aspects of the EIA process in global. The second and the third parts summarize the development and current state of the Environment Impact Assessment on the EU and national level. The fourth section deals with the role of state administration bodies and courts in the EIA process. The last part has been devoted to the question of compatibility of the national legislation with the relevant EU rules concerned, from the perspective of the infringement procedures initiated against the Czech Republic.
The Effectiveness of the EIA Procedure in the Czech Republic from the point of view of the Particular Actors Involved - Actual Stage and Recommendations for Improvement

The aim of the theses is to assess on the background of the actual stage of the international, European (EU) and national level of the EIA procedure legislation the effectiveness of this procedure in the Czech Republic, both regarding the requirements laid down for this procedure on the EU level as well as from the view of the particular national actors involved (i.e. developers, competent authorities, expert's reports makers and public concerned). The thesis has been divided into five substantial chapters. The first one describes the outcomes of the EIA procedure as such. The subsequent second and third chapter summarise the actual stage of the environmental impact assessment procedure on the supranational (international and EU) and national level. The fourth chapter deals with the effectiveness of EIA procedure in its current stage in the Czech Republic: it describes and compares the particular shortcomings of this procedure from both the point of view of the requirements laid down for the EIA procedure on the EU level as well as the point of view of the national actors concerned. On this background, the fifth chapter assesses the overall effectiveness of the EIA procedure in the Czech Republic and submits recommendations for possible improvements.
Environmental Impact Assessment of the project Administrativni objekt Pankrac

This bachelor thesis describes the process of Environmental Impact Assessment on the basis of the valid legislation applied on a specific investment project from experience. Following, a procedure of elaboration of SWOT analysis is defined and the effectiveness of Environmental Impact Assessment as an instrument of Environmental Protection is demonstrated. In the conclusion of the thesis, the SWOT analysis of above mentioned specific investment project is performed from the two different positions, first, from the social point of view and the second, from the point of view of an investor.
