Marriage and divorce in the Czech Republic in light of present morality

The work draws a comparison between different views on marriage and divorce (e.g. from the perspective of the Catholic Church, profane view, the legal system of the Czech Republic). The aim of the study is to compare convictions and development of views on marriage and divorce in contemporary society. The work observes the release of morals under the influence of television and commercials. A question, whether art reflects the reality of people's lives, or determines them, also needs to be asked. Further, it examines if current people are able to think critically and looks at people's motivation. Other question is, how hard it may be to do a right thing when major society became reconciled to wrong. The issues will be answered in questionnaires. It is necessary to note though that the work is not binding as the research does not include a sufficient amount of questionnaires. In the work, the released sexuality and reasons for being "single" will be investigated. Using statistics we will try to predict the future course and to analyse natural and sacramental values of marriage, double indissolubility and unity, the relationship of marriage and society. Manželství z křesťanského pohledu Marriage from a Christian Perspective Šárka Ambrosio This work is based on the provisions of the biblical creation of man (as male and female) and the concept of marriage in the New and Old Testament. I reflected on the legal status of marriage in modern society and the provision of marriage according to the order of the Roman Catholic Church, the Czechoslovak Hussite Church society and the Christian community center as well as comparing their views on marriage and their wedding ceremonies. This literal work is divided into two parts. The first section is a biblical description of marriage from the old and new testament and its perspective regarding marriage from these three individual churches. The second section describes ten moral values of a healthy Christian marriage from my own personal observations and studies from the Bible. This chapter may be an inspiration to many people and to their marriages. The various questions about marriage are answered in the Bible. Processus iudiciarius secundum stilum Pragensem by Nicolaus Puchnik, critical edition of the treatise

Abstrakt_anglicky The PhD thesis is focused on canon procedural law in Prague at the end of 14th century. The purpose is to prepare a critical edition and summary of the treatise Processus iudiciarius secundum stilum Pragensem and to contextualize it to iuridical and administrative connections in the period at the end of the 14th and beginning of the 15th centuries. The researched treatise was a very useful theoretical and practical vademecum of procedural law and was used not only by students of law at The University of Prague as a manual but also by archiepiscopal clerks, as well as plaintiffs and defendants in the single cases. The thesis consists of the biography of the author Nicolaus Puchnik, canon law analysis and commentary incl., local customs, manuscript analysis based on paleography and codicology, European context analysis based on the juristic style and, last but not least, the edition. The edition is composed of four manuscripts (Munich 677 as the basic text version and other three manuscripts originated in the 14th century).
Legal position and administration of Roman-Catholic parishes, parish communities of the Czechoslovak Protestant Church and religious communities of the Czechoslovak Hussite Church

This thesis is about the legal position and administration of the elementary institutions of three churches in the Czech Republic. These churches are significant in the Czech Christian churches and they are based on other system of administration. The aim of this thesis is to make comparison of this three systems. The thesis is composed of five chapters, each of them dealing with different church. Chapter one introduced to the problem and it presents all churches. Chapter two is about parishes of Catholic Church, which is controled by a episcopal papal system of administration. In the Czech Republic is the most dominant Roman branch of church. The thesis react with this fact and the first part is mostly about this branch, only one chapter is about the other branches of this church. This chapter consists of eight parts. The first part is about the legal position of parishes, second part is about establishment, termination and change of parishes. The third and fourth parts are about the position of priests (third part is about parish priests, fourth part is about other priests in the parish) and the fifth part is about councils in the parish. Catholic Theological Faculties and Seminars in the Czech Republic from the Point of View of the Canon Law

This thesis describes catholic theological faculties and seminaries in the Czech Republic from the point of view of the canon law. Canon-law rules are presented in the first part - especially from the Code of Canon Law and from the apostolic constitution Sapientia Christiana and the Norm of its application. In this part it is mentioned how these rules are applied at respective faculties i.e. at the Catholic Theological Faculty of Charles University in Prague, the St. Cyril and Methodius Faculty of Theology of Palacký University Olomouc and at the Faculty of Theology of University of South Bohemia in České Budějovice. The second part focuses on different faculties and completes information not stated in the first part and further focuses on the status of priest seminaries in Prague and in Olomouc and the Theological Convict. Some problems resulting from the legal status of the faculties and seminaries are treated in the closing part - especially the troubles connected with the discrepance between the Czech and the Canon legal order.
Marriage according to the Czech civil code in comparison to canon law

This thesis analyzes the institution of marriage in the legal order of the Czech Republic in comparison with the canon law of the Catholic Church. The first part specifies legal adjustments of marriage in the Civil Code and the Code of Canon Law. Moreover, attributes and purpose of marriage and the rights and responsibilities of spouses are described. The second part discusses the origin of marriage, and also the relationship between civil and religious marriages. Following sections examine invalid and void marriage. In conclusion, case studies of termination of marriages are compared. Canon law does not compete with secular law; in the Czech Republic, canonical matrimonial law is legally irrelevant to the secular law. Secular law is legally binding for all citizens of the Czech Republic, canon law is legally binding for Catholics.
The Civil Divorce and Ecclesiastical Nullity of Marriage

Content of graduation theses is focused on civil divorce and church nullity of marriage. Graduation theses are divided in three Themes, secular law, canon law and comparison. First part is aimed at civil law which regulates divorce. Second part is focused on canon law. It conducts a study of church nullity of marriage in consequence of marriage agreement failure, canon form or impedimenta presence. Third part compares ways of marriage termination in Czech secular law and ways of marriage cessation in catholic canon law. It tries to find their equivalent components, their dissimilarities and relationship. The canon law is a base of comparison. Secular law is based upon the tenet of marriage dissolvability. Canon law is based upon the tenet of marriage indissolubleness. Marriage divorce in the civil law is ineffective in the canon law respectively church nullity of marriage is ineffective in the secular law of the Czech Republic.

The inventory of the personal papers of the Czech lawyer Kamil Henner senior (1861–1928). He was especially concerned with questions of canon law. His papers are preserved unfortunately very fragmentary. They contain personal and institutional correspondence, his scholarly essays and books, auxiliary material, and documentation from his public activity and of other people.
