Current issues of consumer protection in electronic communication

Consumer protection is an issue affecting a very broad group of citizens of the European Union. EU reflects customer protection in all its policies. I have focused on electronic communication because of my work experience in that field. In my thesis I am trying to compare my experience with valid legislation. In addition, electronic communication services are used by European consumers every day widespread through society. I have tried to follow the development of EU legislation in electronic communication sector focusing on consumer protection. This topic is very closely connected with price regulation and the whole situation on the electronic communication market. My goal is to define main problems of legislation by using case law and my knowledge from practice. In the first chapter of my thesis, I focus on general consumer protection in EU, which is applicable to all contracts concluded by consumers (unfair terms, contracts negotiated away from business premises etc.). I am pointing out issues I encountered in practice. I also compare implementation of EU legislation by EU member states. Consumer protection in financial services

The theme of the bachelor thesis is consumer protection in financial services. At first, the thesis focuses on the history of the consumer law. The thesis also deals with a distinction of the terms public and private consumer law regulations and with an application of their provisions to the environment of Czech Republic. The key issue of this thesis is the consumer protection within a consumer credit, development of consumer protection in relation to European Union. A part of the thesis also deals with consumer protection within an arbitration and an insolvency procedure. Individual parts are confronted with findings, judgments and judicial decisions.
Consumer protection in contracting away from business premises

Bachelor thesis deals with consumer protection, especially in contracting away from business premises. The theoretical part deal with consumer contracts, particularly contracts concluded by a distance and off-premises. Furthermore there is discussed consumer protection in contracting away from business premise in the European Union and also in the Czech republic and activities of the Czech trade inspection. The questioning in practical part research, if respondents are aware about the issue of consumer protection. In practical part, there is also processed interview with JUDr. Věra Knoblochová, Ph.D., who worked in Brusel in the issue of consumer protection. Last but not least is in my practical part statistics of the activities of the Czech trade inspection during roadshow and trades through internet.
The protection of a consumer in consumer contracts

The diploma thesis deals with the protection of a consumer in consumer contracts with the fact that it is based on Czech law as well as on European Union legislation, because there are directions, which had to be implemented into the legal order of the Czech Republic. First of all I deal with basic characteristic of the legal regulation of consumer protection and its sources. The issue of consumer contracts is divided into three parts. The first one is just about contracts and rules, which determine all consumer contracts. The second part describes specific types of consumer contracts and finally I outlined perspective of a next development of this problem. I also try to focus on European aspect of regulation of consumer contracts and I found out, that Czech lawmaker has got a massive lack of knowledge in the implementation.
Comparison of Czech, German and Austrian legal regulation in E Commerce

The thesis compares national legal regulations in area of E-Commerce in Austria, Germany and the Czech Republic. The comparison has been made from several points of view. The first section of the thesis focuses on the area of incorporation of three European directives (93/13/ES on unfair terms in consumer contracts, 97/7/ES on the protection of consumers in respect of distance contracts and 2000/31/EU on electronic commerce), which frame consumer protection on the European level in respect of e commerce contracts. In the next section basic principles of contract law are compared in each of the surveyed legal systems. Each of the contract related conditions are compared step by step to their partner conditions in the other two countries (general terms and conditions, information duty of entrepreneur, consumer's right of withdrawal). The very last section covers an international civil law, and its effects on consumer protection as analyzed in compared nations. The comparison has proved my primary assumption that all three legal systems in the area of E Commerce almost identical, aside from the major difference in the definition of the term consumer itself.
