1 Free Access to Information and Public Procurement, Abstract and Keywords Abstract The aim of this thesis is to analyse free access to information of public administration in relation to public contracts, especially in regards with the issue of trade secrets protection in contracts concluded as result of public procurement versus the right to information from public authorities. The thesis focuses on several key aspects of this relationship, the interpretation of which is currently problematic. The thesis examines whether freedom of information legislation applies to all types of contracting authorities, procurements and procurement procedures; whether mandatory disclosures also relate to information on public procurement of the authorities concerned; and whether there may be information provided on request in public procurement. It also focuses on manifestations of restrictions of the right to information in public procurements and manifestations of the right to information in protection of trade secret contained in contracts concluded in public tenders. Tactics of construction companies in preparing bid prices for public works contracts

Diploma thesis deals with the analysis of the approach of construction companies to the preparation of price offers. The theoretical part contains an explanation of the basic concepts of the issue and possible ways to determine the price of the construction work. In the practical part, this topic is researched in practice using a questionnaire survey. The results of the questionnaire survey are followed by two interviews with representatives from practice. After evaluating these data, the established hypotheses are verified and recommendations are expressed.
Investment project in the municipality

The bachelor’s thesis is devoted to explaining keynotes of the investment in public sector. The first part of the thesis is theoretical. There are defined the concepts of public investment, public contact and posibilities financing of these investments. Municipalities management, municipal budgets and regional development are further solved topics in this section. The practical part describes the financing and influence of the investment on the development of the municipality. As a speific investment, I choose a project called „New building of kindergarten in Dolní Loučky“.

This bachelor thesis deals with the conclusion of contracts in the public sector. In particular, public procurement by the contracting authority. In the theoretical part, the basic terms are explained. Part of the thesis is the analysis and subsequent comparison of the conclusion of contracts in the private and public sector. The practical part deals with the errors occurring during the conclusion of contracts in the public sector. Finally, recommendations are made to improve contracting in public administration.
Sources optimization for public construction investments

This bachelor thesis deals with the optimization of sources for public building investments. The thesis is divided into the theoretical and practical part. The theoretical part deals with public procurement, possibilities of financing public procurement, municipality and the budgetary system of the Czech Republic. In the practical part, the development strategy of the municipality of Červenka is analyzed using SWOT analysis, problem analysis and their solution and long-term investment outlook. Based on these analyzes, the public construction investment of the sokolovna building reconstruction is selected. For this investment, several funding options are proposed. At the end of the thesis, these variants are evaluated and the most suitable one is selected.
Geographical aspects of corruption in Czechia on the example of public procurement in selected regions

This thesis deals with the issue of corruption in public procurement. The main aspect of the work is to compare the transparency of public procurement in selected towns of Pilsen, South Bohemia, Karlovy Vary and Ústí Region in the years 2006 - 2014. Based on the data of public procurement were observed characteristics, that highlight the risk of corruption. Partial aim was to assess possible influence of political environment and their changes on the practice and transparency of public procurement. The results show, that the towns, which are positively evaluated in terms of their transparency are characterized by high participation in elections and low unemployment rate. According to the results, towns with higher levels of economic and social capital rate are generally better evaluated in their transparency. The influence of variables characterizing the political environment on the transparency of public procurement, was not proved. Bid Protests in Public Procurement: Czech Case

Bid protest mechanisms provide supervision over public procurement processes. If set up properly, these mechanisms improve both ex-ante and ex-post e - ciency of public procurement. However, decentralisation of the oversight can create opportunities for bidders to strategically abuse the system at the soci- ety's expense. In order to assess e ciency of the Czech bid protest mechanism, an empirical policy analysis of was conducted using a unique combined dataset of all bid protest rulings of the Czech supervising authority linked to a com- plete dataset of public contracts procured between 2007 and 2014. Econometric methods for panel data analysis were employed in order to estimate e↵ects of bid protesting on returns in form of awarded contracts. The selected approach made it possible to focus on individual relationships between contracting au- thorities and their suppliers. The results show significant di↵erences between returns of protest against EU co-funded and EU unfunded contracts. Moreover signs of strategical system abuse related to public works contracts were found.

Selected issues of public procurement - tender requirements This thesis deals with the public contracts from the perspective of an important institute - "tender requirements". The thesis looks at the issues of tender requirements from perspective of the contracting authority in an open procedure. In the introduction (chapter I) thesis is briefly interpreted by the systematic and historical incorporation of law of public contracts. In the second chapter of the thesis tender requirements are unloaded according to the section 17 subparagraph l) Public Procurement Act, including the definition of the requirements of the contracting authority shall not, without complying with the terms and conditions. The third chapter includes the interpretation of the qualifications which are the nearest institute of tender requirements. In addition to the general definition and enumeration of each qualification it is summarized the common features of both group requirements. Whereas there is not a full list of tender requirements, some of the most important of them are enumerated in the fourth chapter. The concept and types of public procurement contracts The title of the thesis is "The concept and types of public procurement contracts". The thesis is based on current legislation of public procurement law (Act No. 137/2006 Coll., on Public Contracts), which is heavily influenced by European Union legislation. The basic purpose of public procurement law is to regulate the effective distribution of public funds. The basic aim of this thesis is an analysis and evaluation of some basic legal institutes of public procurement law. The thesis is divided into four chapters: The first chapter can be considered as an introduction. This chapter is divided into three parts. The first part includes a short definition of the law on public procurement. Public procurement law is divided into two main areas (1. awarding public contracts; 2. revision of the awarding process). Finally, this part describes the position of public procurement law in the Czech legal system. Part Two deals with the legal sources of this type of law (national, international, European Union) and its development on the national level. In the third part are defined the basic principles of procurement law: principle of transparency, principle of equal treatment and non-discrimination principle.
